But that line of attack completely backfired after her campaign team tweeted a political attack at Sanders, using the children killed in Sandy Hook as a political football...
Immediately, the comment thread for that tweet was full of angry Sanders supporters, but even Clinton supporters were disgusted, calling out the former Secretary of State for her insensitivity toward Sandy Hook victims. the tobacco companies were successfully sued because they were committing fraud, not because their products cause cancer. If the companies had been upfront about how their product causes cancer, rather than hiding it, no lawsuit would have convicted them.

exactly. big tabaco was liable for lying about the dangers of there product, illegally targeting minors in ads, and presenting there product as safe when they knoew it wasnt. everybody knows alcohol can kill you. you dont sue the beer distiller when the college kid drinks himself to death.

Agreed. I really don't understand how Cenk can say with a straight face that Bernie Sanders is wrong on guns. Sanders is right, if I sell you a product legally and you misuse it, that's your fault, not mine. Cenk won't admit it, but he's a Prohibitionist on guns and tobacco who would support imposing laws that punish businesses into bankrupting lawsuits for selling certain products. Support education programs on guns like we've done on tobacco, not nonsense rules holding sellers responsible for the buyer's crimes.

I have to disagree with the idea that Bernie is not progressive on guns. Progressivism shouldn't be one unified view, but a method of viewing policy that allows for open-mindedness and progress. In not for guns, but everytime he expresses his views on guns, it's a progressive view for liberals to have. Accepting the fact that a large number of people in this country wants to own guns. Fine. So let's discuss smart and comprehensive rules and regulations regarding them.

+Chad, Don I consider myself a progressive but I disagree with the left on being rabidly anti-gun. Bernie is 100% right on this gun immunity law. They can still be sued for selling to someone they know will commit a crime with it, for negligence, for illegal sales or skirting the law, for product defects and by the government enforcing laws. The law just prevents activists from suing the gun sellers and manufacturers out of business. Which is a bad thing because the demand won't go away and would result in a huge unregulated black market. Now imagine a future where the right uses the same precedent to sue the makers of abortion equipment out of business, gangs and cartels have extremely bloody turf wars over profitable gun sales, and mass shootings are committed with actual full auto assault rifles instead of the current semi auto rifles. Not smart.

I agree with Bernie on the firearms lawsuit issue. You can't allow people to be sued for selling a legal product. What kind of precedent does that set? Nobody will want to produce anything that might be dangerous because they can be sued if it's misused or involved in an accident. It's not the way to go about gun control. We have the power to change the laws, we can make anything illegal that we agree should be illegal. If guns (or certain types of guns) should be banned, great we ban them and then there's legal grounds to arrest people for selling them. Throw them in jail, make them do tall time, cast them down with the Sodomites, whatever. Firearms should be treated like automobiles; you must pass a safety test to obtain a license to drive a car because a car can kill people and destroy property if used improperly. Sounds a lot like a gun to me; an item that can kill people and destroy property if used improperly. If we enforced reasonable gun care and safety testing before allowing anyone to own a gun then people would be educated and much safer with them and probably better able to use them for their stated purpose (normally self defense) to boot. Some would slip through the cracks and there would be accidents but it'd be better than the free for all we're dealing with now.

Cenk, you are totally wrong on the gun lawsuit issue. You compared it to tobacco. Well first of all, today we have warnings on tobacco products and so lawsuits against the tobacco industry won't win these days. Second of all, the reason why we had lawsuits against tobacco products was because the tobacco industry was knowingly and deliberately selling products that they knew caused cancer and were addicting. And they were trying to hide this fact. NOBODY is confused about the purpose or dangers of guns. There aren't people who buy a gun, shoot someone, then realize "Oh shit, I didn't realize this thing could kill'. IF the manufactures were selling guns that say, had a 10% chance to explode in the hands of the wielder, THEN you would have a case that the gun was defective and the company should be liable. Or if you could prove that a dealer was selling a gun to someone that they knew ineligible or didn't follow the law when they sold the gun, then would have a case. Both are cases of negligence. Just like when the tobacco company didn't warn it's users of the dangers and addictive nature of their product. The only thing that the law Bernie voted for did, is if you sue and you can still sue if you want; and if you lose, you have to pay the court costs of the winner. That's it. Honestly ALL lawsuits should be like this, it prevents people who have legitimate claims from having their payouts cut in half by court costs. And it prevents companies from having to settle because a legal battle would have been more expensive, even if they know the case is fraud.

+Matthew Ciaramitaro I also think that that's what Cenk's point probably is, but so far as I can tell, most marketing of guns is done by the people selling them to eventual gun owners and the NRA, not the manufacturers themselves, even though they have a hand in the overall process. So I'm still a little flummoxed as to how the normally very reasonable Cenk came to the conclusion that suing the gun manufacturers as opposed to simply trying to get an assault weapons ban passed is justified.

+Robert Miles Until guns are banned, they are legal to purchase. And the manufacturers as long as they adhere to the rules and regulations should not be held liable for actions of people. But assault rifles are tools for killing people. And other guns should require some stipulations on purposeful use, before being permitted for purchase.

Agreed. Even Hamilton wrote that "no freedom is absolute." While I do believe the right to self-protection is essential, it should be left to each community and state to decide this. What would be bad would be to end up like Venezuela where only criminals have guns, because they have taken an extreme position that 'smoking, guns, and racism are bad' and have managed to collapse their society with notions that are every bit as nonsensical on the far left as we have idiots on the far right.

+Logic Time I'm not in favor of suing the manufacturers but you have to remember the primary function of a firearm is to kill things, in the case of an assault rifle, many things in quick succession, they were designed by arms manufacturers to kill people specifically. The primary function of a knife is as a kitchen utensil or as a tool, that is what they were designed for.

+Russell Gorall so if a gun dealers sells a gun to person conducted all the current regulations and background checks and it's all okay ,years later that person goes insane and kills a bunch of people why should that business be held accountable ? It only should be held accountable if they didn't do those checks

I agree that you shouldn't be able to sue gun manufacturers in the case of Sandy Hook.... Suing the manufacturers would be like a drunk driver hitting me and me suing Ford or Chevy.... But I also think like Bernie that if a manufacturer knowingly sells guns to a group for nefarious purposes they should be held accountable....

Very bad comparison: cigarettes - guns. Everyone knows what guns do but (allegedly) only the cigarette companies knew smoking was addictive and caused lung cancer and on that basis they were sued.

When has ANY Democrat EVER completely gotten rid of guns? When? When have they stopped their sale completely? The answer: Never. So until you do that, you cannot argue that you're "better" on guns just because you back the idea of lawsuits. The guns aren't going away, today, tomorrow, or forever. Not as long as established candidates get in. They give lip service, but the things never go away. At least Bernie, being more moderate, is keeping it real.

I don't see why would we should stop people from suing. It is the American way. But I would expect the case to be dropped/lost if a manufacturer or seller isn't doing anything unlawful.

I'm with Sanders on this issue. I'm all for more gun control but you can't just go suing people for making legal products unless they break a law while doing so just because people use their product for something terrible.

That's stretching the facts a little, but some people feel a lot a anger when they see someone deeply corrupt, who committed war crimes , greedy for power and trying to act like they are open minded, peaceful and honest person. I am a liberal gun owner. I have had an "assault" rifle for 35 years.........I have never killed anyone. Do I need it? No. I would comply with a ban on assault weapons. Do I favor rigid background checks? Yes. I grew up in a rural area where guns are part of the hunting and recreational shooting norm. If there was a way to make sure bad guys didn't get guns I would support it. I guess I would get a D- also. I agree with Bernie as he is from a rural state where the same things are normal. I support the whole Constitution.....not just the 2nd amendment. To me a gun is a tool used for various purposes. It is my heritage and I do not apologize for that.

All right, someone explain to me on what grounds the families of sandy hook could sue the gun manufacturers? I'm not pro gun, I think that we do need an assault weapons ban, so I'm not pro NRA, but Cenk has been a bit unclear about exactly why he disagrees with Bernie on this issue. From the way Cenk has presented this, I'm not sure how Bernie would be wrong.

After actually doing reserch on weapons in america, i find the ban on assult weapons to be a moot point, when none of these guns, pistols, assault rifles, rifles, ect, can be fired on full auto. so essentially all the guns are the same weapon, semi automatic. Only difference is in caliber and .50 cals are legal so its not the rounds, its just how they look, you can take a wooden 30-06 and do WAAAYYYY more dmg on semi than some wussy NATO 5.56 but they wont ban that 30-06. If you gonna ban them all do so, but why just assault weapons that dont... assault?
