Stories like this is why many people absolutely despise HOA's, stratas and anything similar... they ALWAYS try to screw people around and act like the own the entire world. The moment the HOA cancelled the exemptions, that just shows that they were slimeballs and the OP should've taken immediate legal action against them for it. I dont know the laws in South Africa, but im pretty sure there's something that is different there if the judge claimed that a lot of that was legal... something doesnt sound too right here. Good thing the OP fought back on all of the HOAs crap and i think his counter proposal contract was brilliant. I find it even more funny and ironic that the dumb HOA president had the nerve to say that the OP wanted him to sign a contract that he didnt want to.... when he did the exact same thing to the OP to begin with. It's also a good lesson for the HOA president to shut up and listen to his legal advice, rather then telling him to shut up... and read what you are signing before you sign something. I also love that the OP built a paddling pool (badly) and the HOA had an issue with that as well... HOA's seem to think everything is an eyesore... and he brought up all the details in the contract to get them to replace it. Glad things seemed to work out in the end and the jerk HOA president ended up selling off and moving out of country.

I'm glad the courts here in Australia have generally limited HOA and equivalent organisations power in most cases brought. It's generally referred to as a body corporate or strata org here, whether it be a collection of farm plots, houses, townhouses or apartments. Most of the time they are pretty limited in what they can make you do, the only thing they can force out of people is money for emergency safety related repairs. I remember a few years ago, some big tower apartment building tried to ban all pets because an older lady had a small very well behaved dog. They basically tried to evict her and it ended up going to court. Not only did the appeals court side with her, they also ruled that ALL blanket pet bans by strata orgs are INVALID and unenforceable. They basically ruled that strata orgs cannot legally restrict individual owners property rights without reasonable justification, IE if what you're doing on your own property isn't having a meaningful impact on your neighbours then they have no right to regulate you. It ended up being a huge headache for the entire industry here because the ruling went beyond pets and basically cut the balls off strata organisations.

Once you sign the contract it cannot be changed unless both parties agree
