The law states offset is illegal as well. What needs to take place is that the homeowner writes a check for the deductible and the work you don't they keep the difference of the final check.

Fences splatter marks and dented grills are my favorite thing to see. Saw one metal natural gas meter that got destroyed. Utilities replaced it the same day.

Very informative! Thank you. Unfortunately, client I spoke with today, whose roof was extremely damaged due to hail, mentioned to me that they want everything (gutters, fence, roof, AC, etc) fixed without paying a deductible because he has been offered by other roofing companies that they would "cover his deductible." I was at a loss for words as I did not understand how this was possible. Thank you for all you do.

My insurance company takes the deductible from the total pay out before hand. Makes it easier for me the home owner.

I love it man, this is how we operate. If they end up not having enough ACV to cover the deductible or plywood you can always finance!

Awesome vid. So to close the deal use acv towards deductible but, let them know next storm they pay out of pocket. Only collect rcv on things your doing and acv towards Deductible

Thank you your vids are really helping me understand the nuisances of the entire process. I’m new to the industry and excited. One question I had from another vid was we chalk the roof in the initial inspection but you said Dont chalk anything during the assessment w the adjuster. If it’s already marked would that be a problem?

My company I work for requires me to report all insurance fraud to the insurance fraud department😅😅 ive already called in 3 companies 2 of which are not around anymore...

PLEASE HELP, insurance is not paying for fence, siding, ac unit ect unless I get a receipt form the repairs?

Sounds like you need a supplement company, public adjuster, or attorney to support ya here. My focus is sales and I'm not the best person to help on this front.

GREAT question. First, I would look harder. If it's hail, then it'd be hard to believe that hail damaged the roof and NOT gutters + downspouts at the very least. Hail doesn't always fall straight down. So there's usually going to be some collateral damage on some elevations of the property. Wind damage (or minor wind damage) could create this problem as there may not be any other collateral damage. IF there truly is nothing, AND if you're homeowner can't afford to pay their deductible. Hi Adam, thanks for your insight. Still Confused - If the total summary is for 10K including the RCV (roof)and ACV (fence, other structures), and you sign the contract for 10K and you submit the Cert. of Completion for 10K., is that not insurance fraud. It still seems to me that it is b/c you did not do 10K worth of work.

It never went into other trades (like the fence, or gutters). That is where I am confused. I thought somewhere you mentioned that the homeowner (if they wanted) can use the ACV for example the fence for the deductible. Is that correct? And if so, how do you write the invoice?

Has a home owner my deductible is 5000$. My room is messed up no question , the gutters have a few dings 1900$, my shed which is like metal on top is 1300$, a door on the side is 250$ one ding, and ac rake 250$ I was going to use that as my deductible, is that legal for me to do and I do understand that I can’t re claim those but it’s so dam minimum that I’ll do it my self. What’s your guys opinion?

Would this still apply if the full replacement cost value is paid out to the customer less their deductible and no depreciation held on the entire claim? Couldn't you technically charge less if it meant losing the job? Same as with car insurance where they pay you the loss, less deductible and stroke a check. If you end up with money left over you don't need to return it or provide recepits. Around here, every paintless dent removal company blatantly advertises that they'll refund your deductible as well. No out of pocket. It seems the law was written around refunding deductibles are specifically intended for the roofing industry only. In my state of CO, the only law regarding refunding or rebating deductibles only applies to roofers and is in fact called: An Act "measures to protect consumers who engage a roofing contractor to perform roofing services on a residential property" I guess PDR, siding, windows, stucco, gutters and any other contractor or repair facility is not bound by the same restrictions. Any theory on why that is? Shouldn't the same laws apply to say general contractors that do all of their types of work other than roofing? To protect consumers from roofers only seems a bit defamatory and discriminatory.

Great questions. PDR is handled differently. Why? Don't know. To answer your 1st question - technically if the claim was paid in FULL (less the deductible), you can legally charge whatever you want. The legal issues lies with how the insurance money is handled and how you invoice the carrier. But if you are NOT invoicing the carrier and handle it like a retail deal, then all is well in the world so far as I know.

The depreciation check is paid to the homeowner who then pays the contractor.

Genuine question (I am new to the business) how is it legal to take that money from the fence and use it for “out of pocket expenses”? Would that mean that it’s legal to make a roof claim and not get the roof done?

Yes that’s legal. Just can’t lie and said you did replace it and get reinsured. Most mortgage companies wouldn’t let you do it.

Yup! What Michael said :) And yes - a homeowner CAN make a claim and NOT do the roof. If they pocket the cash - they can keep the ACV -- but their roof is no longer insured :) I answer these questions in the later half of the video :)

At the end of the day the only way to ever stop deductible eating/fraud is if the insurance company and government do stings and prosecute and jail property owners...they are the driving force behind this fraud...not the contractors even the ones using it as a sales tool in an overly competitive industry....the homeowners really do not care if contractors work for less or contractors go to jail...

That's frustrating. I'm not as familiar with Canadian law. However, I do have a number of customers and private clients in Canada. They've had success positioning the deductible as the "contractual agreement" between the homeowner and insurance company.
