As a songwriter you own the compositions you’ve written - whether you officially register them with the US Copyright Office or not. But how do you actually get paid the mechanical royalties you’re due when a copy or version of your song is sold or played?
That’s exactly the question I answer in the video above, part 4 in our series on the Basics of Music Copyrights and Royalties. The video answers the following questions:

Great explanation as always but here's the big issue with going that route...let me preface by saying I LOVE CD Baby and have been with them since 2001...great company and great people. the problem is when you sign up with their Pro Publishing plan they essentially become your "Publisher" which negates you from signing with a Song Publisher but more so, negates you from signing with a Music Library in an Exclusive deal in order to get Sync placements. A single Sync placement could easily amount to much more than the Mechanical royalties from streaming.

ASCAP collects Radio, TV, Streaming and Background music and live music. You are wrong about they can only collect live performance

Two questions. Say an independent artist releases a C.D with 10 songs, 9 original songs that they own the sound recording and publishing rights to, and one cover song. 1. Where does the money to pay the mechanical royalties come from? Does the band have to pay it out of pocket, or does the manufacturer pay it? 2. What about the royalties generated by the other 9 songs? Can an artist collect royalties on something they themselves had manufactured?

You should have put it in your ASCAP or BMI to give the % splits. Same with SoundXchange...they do all that for you

Hey thanks for the video. I used CD Baby standard and I got pay abour $3 last month for my streams, what kind of royalties are these? Would I have gotten paid more if I signed up for the Pro option? Hope that makes sense, thanks again for the video.

This advice in hiring a Pup Admin is good if people are covering you songs, and you're huge outside of the US. How many people watching this fit into this category? The return from the Pub Admin controlling your publishing is not worth it. Thank you Tony for your great insight to the industry, but people please do your homework before signing anything.

Actually, no. You need a pub admin to collect your own mechanical royalties from streaming sites, plus other global mechanicals for your music. Collecting mechanicals from cover songs is just the bonus.

@@tonyvv Like I said, who's getting played oversea's enough to fork out $100 to Songtrust? Give them 20% of everything your music makes for basically doing nothing. Good luck negotiating your publishing with a real publisher when your lucky enough to have that conversation. In America where you're getting your plays is where you need to focus on a Pub Admin which at this point is yourself. Take on the world next.

Like I said: if you want to collect mechanicals from streaming companies (in the US!) you need a pub admin. This could add 15% to your streaming royalties. If those 15% on top of your streaming royalties are more than the $20 or so extra it costs per song to sign up for a pub admin service like CD Baby Pro, then it’s worth signing up. If they aren’t, then don’t. It’s a simple economic decision.

@@tonyvv Very true. I personally would always look into any service that binds you and your music for a year contract. There are other company's in the US that are more flexible because they understand we're not huge in Germany like David Hasselhoff. Haha. Much respect. Make a decision but make an informed one. Love your company and thank you for opening our eyes to how important understanding this business is.

No, they pay through third parties like the Harry Fox Agency, never direct.

is there any way to collect your mechanical royalties independently without going through something like Songtrust. If so how would I collect my money from popular streaming platforms such as Spotify, Pandora, etc.

What if you own the recording, hiring a singer? Is the singer listed as the "Artist?"

Sorry but isn't it the other way around ? Song recording = mechanical royalties. Composition = performance royalties. or am I missing something here ? Many thanks in advance

Nope. BOTH mechanical and performance royalties are paid to the owner of the composition (songwriter and/or publisher). Neither go to the owner of the recording. In fact, in the case of a cover song recording, the artist recording the cover song (owner of the recording) needs to license the cover and pay a mechanical to the owner of the composition.

Please explain me the below state ment please please....... . . Controlled Compositions: If any selection or musical composition, or any portion thereof, recorded in the Masters hereunder is written or composed by Producer, in whole or in part, alone or in collaboration with others, or is owned or controlled, in whole or in part, directly or indirectly, by Producer or any person, firm, or corporation in which Producer has a direct or indirect interest, then such selection and/or musical composition shall be hereinafter referred to as a "Controlled Composition". Producer hereby agrees to issue or cause to be issued, as applicable, to Artist, or Artist's designees, mechanical licenses (including, without limitation, any "first use" mechanical licenses) and other licenses in respect of each Controlled Composition subject to the same terms and conditions as are applicable to selections and musical compositions written, composed, owned, or controlled, in whole or in part, directly or indirectly, by Artist, which are embodied on the Master or any recording recorded under this agreement. For that license, on the United States and Canada sales, Artist will pay mechanical royalties at one hundred percent (100%) of the minimum statutory rate, subject to no cap of that rate for albums and/or EPs. For license outside the United States and Canada, the mechanical royalty rate will be the rate prevailing on an industry-wide basis in the country concerned on the date that this agreement has been entered into. Producer hereby grants Artist a license to reproduce Controlled Compositions that are embodied on the Master produced hereunder in synchronization with and in time relation to visual images featuring Artist's performances in so-called promotional "video programs", on a royalty-free basis and in so-called commercial "video programs", in being understood that Producer shall be entitled to Producer's pro-rata share of any royalties attributable to such commercial "video programs". Upon Artist's request Producer shall execute or cause Producer's publishing designee to execute and deliver to Artist, as applicable, all documents required by Artist, as applicable, to effectuate the purpose of this paragraph.

How can I collect my overseas royalties without a publishing admin. They want to take 20% of my BMI/MLC/Soundexchange royalties too !!! No NO NO !!!!

It's pretty much impossible to do on your own. There are too many PROs globally, and you can't make direct deals with them. Trust me, the 20% is worth it.

@@tonyvv BMI says they collect worldwide for publishing royalties. How to collect the overseas mechanicals only? Publishing admins want a cut of everything and I only want them to collect overseas mechanicals.
