How Does Child Support Work in Florida?

In this video, Christine Thornhill (family law attorney in the state of Florida for nearly 20 years) fully explains how child support works in Florida and specifically answers these questions:
How can I avoid paying child support in Florida?
Can I get full custody of my child and still get child support?
Do you have to pay child support if you have 50/50 custody in Florida?
Christine goes in depth on the Florida Statutes 61.30 which is what the court uses to determine who will pay child support and the amount of money the parent will pay each month.
This number is determined by adding the Mother's Gross Monthly Income with the Father's Gross Monthly Income and subtracting Taxes. The court will also give a credit to whoever is paying for their own insurance, a credit to the parent who pays for the child's insurance and a credit to the parent who pays for daycare.

I have a question, I’m starting child support through Florida child support revenue and my husband that I’m married to supports me and my daughter and I’m a stay at home mom. We are trying to get child support from my daughters father. Now will my husbands income be looked at even tho he is not her father but has been support her finically and health insurance and all??

Only your income and the fathers. They may look at the health insurance tho.

Hi! What if my child (who is a US citizen) lives in another country with her mom (Chile). Do I provide child support according to these calculations or do we use the chilean child support system? (also my daughter will get her chilean citizen very soon). Long story short, we were both immigrants, had a daughter in the states and then separate, and she went back to Chile with my daughter.

First, you need to know if there is an order requiring you to pay child support. Is it a Florida order or a Chile order? Child support is calculated and ordered by the court. Were you two married and divorced? I think you may want to consult with an attorney to determine what exactly is going on. What if you are on public assistance and can't afford an attorney, but need the services?

If you receive public assistance and need to hire a family law attorney, you may want to consult the Legal Aid services in your county or call around and ask if there are any attorneys taking pro bono cases. You may be able to work out payments with an attorney. Unlike dependency and criminal cases, family law attorneys are not provided free of charge.

WHat do I do, if a Child Support agency managed to garnish my wages, without a contract or undertaking, without giving me due process and no warning WHATSOEVER??? There is no contract in place. I am in Florida and the agency is in California. ALso, the agency sent my employer a fake withholding order, where the case worker typed his name in all caps where the judge was supposed to sign, so there is no competent judge's wet-inked signature.

That's very upsetting news. That is NOT how it is supposed to work. Unfortunately, it sounds like you have to handle this matter in California though. I would suggest contacting a California attorney through the state bar agency. Ask the attorney to determine whether the order was obtained administratively or through the court system. Then, you will know what division you have to go back through and show that you were not given proper notice of any proceeding. There are different requirements for different divisions. I wonder if the order that you think is fake is simply a conformed copy because conformed copies only have the judge's name stamped on it. I wish you luck.

Hello, please help! My baby daddy hasn't been paying child support from court order since January 7, 2021. He also does not talk to my daughter which is 9 years old. So no contact at all. I want to go out of the country for vacation but he does not answer my calls or text messages. What can i do to solve this situation?

There are several things to consider in this situation. Assuming that Dad has been declared the father since he is court ordered to pay child support, the next step is to determine whether Dad has any way to stop you from going on vacation out of the country. Do you need a passport that he refuses to sign consent? If he is supposed to do something that he refuses, you may need to have the issue addressed by the court.

@@FloridaFamilyAttorney I have no contact at all with him. But I know that both parents need to go in person to renew my daughter's passport. If both parents can't go then atleast a notarized letter. But i have no contact with him. I don't know what other solution i have in this situation.

Yes - but I would not suggest it or recommend it. In most situations, it is better to go through the state disbursement unit.

I live in FL. My husband cheated and a child was born in 2017. During this time my husband was receiving SSI . He was on SSI from 2017-2019. His first official day of child support started 3/1/2020. But the state added back pay up to 24 months. The child mom applied for public assistance which started the case. My question is, is it legal to calculate back pay during the time he was receiving SSI?

Child support can be calculated back 24 months prior to the date of filing the petition to establish child support and yes, support can come out of his social security. For further insight, call me directly at 863-295-9300

Your husband needs to FIGHT...I'm guessing there was NO paternity test and his SSI was garnished because of a CONTRACT he hasn't signed, and in my book, this is FRAUD 🙄

The woman who filed for public assistance opened a Title 4-D child support. The title 4-D child support program is voluntary. Your husband does not need to be in this program if he does not consent or give jurisdiction.
