Seller needs to sign and it has to be notarized

What county are you in that makes the seller sign? If you're using our affidavit in REIPro, the seller does not sign, and of course, as mentioned, it must be notarized.

No, the memorandum does not need to be signed by the seller. I just submit the contract, that they sign, with the memorandum that is signed by me and notarized.

If the seller doesnt need to sign, can't people just go put a memorandum on any property at any time?

The seller has to sign the actual contract, just not the affidavit. Someone could file it on any property but it wouldn’t hold up if they do not have a purchase and sale agreement in place.

I "lock up" my sellers to the point that the only reason I need a contract is to make it legal.
