If you've filed claims in the past the VA retrieves all your Military Medical records (they had mine from 1967 forward to today). You can get all that plus any C&P Exam DBQ's etc. by submitting a FOIA for your C File. Mine took just over a year to come in on a DVD.

VA no longer suggests requesting information from Regional Offices, " they tend to lose things". Send requests to the Evidence Intake Center in Wisconsin.

The VA no longer recommends them doing their job on any front lately. That is them passing the buck to the more bogged down system. I say push forward on all fronts. The squeaky wheel gets the grease ;)

You should also check it carefully, two times my C&P came back with errors. My original came with the math done wrong at 80% when it should have been 90%. Two years later I got an artificial hip it stated that my rating was “raised from 30% to 20%” (yes, really) when it should have been raised from 30% to 60% and they didn’t state that I was permanent and total. It did only take about 6 weeks to fix them since they were admin errors and not medical ratings.

Truth! You have to be your own biggest advocate and make sure you have all your documentation for CYA purposes if nothing else

VA RO's are closed due to Covid for in person requests to get ur c&p outsourced exam records. I heard with the FOIA request it can take up to a year to process. FOIA request won't work if ur on limited time schedule. Our representative DAV VSO states he has access to my husband's c-file but cannot give us records due to being a contract company of the VA. It's conflict of interest is what they say 🤷‍♀️

The 1-800 number tells you to submit a FOIA. I did and 3 weeks later got a letter saying this will takes months to comply

If your claim is still pending, it may not be releasable yet. Even post decision, it takes a while 😞

Hello. I Hope all is well. I have a question for you or anyone watching. I have 10 percent for Tinnitus and during my C&P exam the doctor told me that I was going to be awarded the 10% and additionally he told me to file for hearing loss because my hearing loss was substantial and that he was linking it to my incident on active duty. He further told me to file within the next 3 months so they will have to use the report he was preparing. So I filed for the hearing loss and they attempted to schedule me for another C&P exam through "Veterans evaluations services" . Its a private company the VA uses to do exams. I then I called the VA and they agreed with me that they will go off the first C&P exam. The term they used was to "Use original exam findings". But they they asked me to cancel the exam. I thought that was odd and they said it was because they would be able to cancel it in time and that if they didnt cancel it in time I wouldve had a no show on my record. So I went along and cancelled it. My question is - have you seen this before and does me cancelling it look bad for me?? I know Hearing loss is probably going to be a zero percentage, but since the C& P Doc told me to file i figured I had nothing to lose and I thought it wold be good to have the Hearing Loss service connected regardless of the percentage because I have Migraines and Anxiety ready to go as "Secondary" conditions to my service connected Tinnitus. Would love to know your thoughts. Oh , one more thing , My MOS was (BU) Builder in the Navy and thats on the DOD Presumption list for noise and hearing related conditions . Thank you. Hey there! If the examiner did a hearing test along with the C&P questionnaire for Tinnitus, you should have recent enough evidence to not need the additional evaluation! Since you have an MOS that is on the presumptive list, cancelling shouldn't come back negatively for you at all. If you deny a C&P exam without enough supporting evidence they are often automatically denied, but your case is much different. Let me know how it turns out! 0% is still something to build off of, and you can always file an increase later if it worsens. If you need advice on additional secondaries, don't hesitate to reach out!

Along with my Service-connected Tinnitus I was also diagnosed with Severe migraines and Hyperacusis as directly related to my Tinnitus . I will be filing secondary claims for each as I have Nexus letters for both as well. Any advise for me ? Also on the VA form where it asks how to decriibe that your Migraines are connected to my Tinnitus. What should I write? Thank you ,.

A FOIA request usually takes about 2 months. Do you have your decision letter already?

@@TheVeteranCoach As of yet no, so I cannot see the full denial. I also have other issues and diagnosis that the VA denies due to no regular complaining. I have documented in my final physical and some PHA's but always get denied.

You actually want to do a Privacy Act request for your C&P exams. The FOIA request will delay your request. Sign your request in ink. Must have a WET signature.

@@williamjewell2600 If the FOIA was for your own records, the VBA RMC will automatically change it to a PA request. Remember this, we are requesting our own records that may have information about others in it, for example a Rating Code Sheet has the RVSR (Rater) information on it. So, that is the RVSR’s private information, and we as vets don’t have the “freedom” to see it without redactions. So, the VA used Privacy Act to let us request them and the other information is redacted. Think of it like this with regard to VA records requests. A FOIA would be used if you were requesting a record of a deceased veteran. Since they are gone, the information is not redacted, because they no longer have an internet in it. But if we are requesting records of someone alive, even our own, it is a Privacy Act request. PA requests can be done on the VA form for FOIA. Just check the correct boxes for PA instead of FOIA.

I had a C&P Exam through LHI a few weeks ago. Do I need to wait for the VA to give me a final rating decision before I can see the doctor’s note and DBQ from that exam?

Sorry for the slow response, but yes usually they will not release any reports until your claim is finished.

you dont have to wait that long, wait about 5 to 7 business days after your c&p exam then go to your local VA affairs office and ask for a copy. I knew long before I got my decision letter whether I had a good or bad c&p exam

What was the reason for denial in your decision letter? You can always appeal again, but likely will need new evidence to overturn their decision.

I had my c&p exam dec 25th and got service connected for closed nasal fracture. They gave me a 0%, I want to appeal it but I’m kind of confused on if I need more evidence & if so how to go about doing so for HLR ! I want to have my ducks in a row

Hey there! First thing I would do is look up the CFR (rating criteria) for your condition and see what the requirements are to get above a 0% rating. Many fractures are rated at 0% since they have "healed" but if it still causing you issues, you can fight for a higher rating! A personal statement in support counts as new evidence as well :)

Correct. They will not release any exam results until a decision has been made. It makes the whole process very long and arduous, but once your claim is closed always request them all.

They did for a while during the height of COVID, but they are starting to conduct C&P exams directly at the VA again as well. This video was from Nov 2020, so I see I need to make an update!

@@shawnsisson920 I never said you were lying, I'm not debating you. This was VA news directly from both The Military Times and the VA directly. You can read the articles for yourself. This was simply a public service announcement for Veterans, like you, who may not have been aware. This was a moment in time (video posted in 2020) because the VA halted ALL in person C&P exams temporarily in 2020 due to COVID and this was the VAs attempt to get caught up. @@TheVeteranCoach by saying "they did for a while", its implied that I'm incorrect. If that's the case I'm not sure who at the VA gave me my C&P exam that lead to a 90% rating then. They must have made an exception for me I guess
