@@RickMartinKZfaq I would say all the 3 letter agencies are way too political in its actions, and these are fairly easy to see. FBI with Trump, including spying on his campaign. DOJ, decides on who get and doesn't get soft glove treatment, IRS gets weaponized all the time, including with Hunter. Guess that leaves the CIA, and this are scary, let's talk JFK.

That is just sad! I used to think Supreme Court Justices were "experts" in LAW above all else, and were non-partison once they had been appointed to the bench. Clearly, the Trump appointees do not live up to such high standards.

Seems all courts should recuse themselves, since they are all federal appointed judges. DC court is a joke, especially for all the J6 cases, from the judges to the jurys.

But, let's say that Thomas helps swing the SCOTUS vote toward giving Trump full immunity, that would mean Biden would also have full immunity, and Biden could have Trump and Justice Thomas and Alito thrown in Guantanamo prison, or worse, and Biden could cancel the 2024 election, and could appoint successors.

Biden has no hand in the DoJ's decision to pursue this, and that same DoJ initially refused to proceed, until the evidence became so clear that the boss of the DoJ chose Smith to prosecute it independent of the DoJ. The judicial system as it currently operates in the US is overly ponderous, largely anachronistic, and no longer offers equal justice for all, if it ever did. Fairness before the law requires both easy access to the courts and timely adjudications. Wealthy citizens shouldn't be able to play the system and delay, delay, delay, while ordinary Joes and Janes languish in jails from day one.

@@jeeveekaa5880 If the Supreme Court says Trump is immune, then every president will now be immune. We can potentially have these insurrections, anytime a president chooses to exercise this option. They will have 3 hours to allow people to attack the capital police and destroy property. After that, by precedent of Trump, they must call off the attacks but can say that they “love” them. And still not be outside the Supreme Courts ruling. I was being a bit facetious. I doubt that the Supreme Court will allow presidents to legally act like Trump did and not be prosecuted. But it would allow all future presidents to behave like Trump and not be arrested. I really doubt the Supreme Court will allow our country to become a 3rd world nation. They will opt for the “peaceful transition of power” that we always have had. And Trump will not be found immune. The SC may want Trump to be immune, but if they allow it, this is the new USA, every president can do what Trump did or possibly worse. Immune is immune. The SC will never allow a King as president. They want to be the top dogs. It would go against their nature to put someone above them. But if by some wild hair, they do, I have my passport updated and will find a quieter democracy some other place that is cheaper to live. This place will no longer be safe.

Another web site says that the obstruction statute has two parts, one that lists things like destruction or hiding evidence and documents, tangible items. But the second section begins with the word "or" and then lists more general disruption or interference with official actions and meetings, basically anything, even physical disturbance or obstruction. If that is the case the broader interpretation should apply since by putting the word "or" in it means either section applies by itself. Instead of saying "and" where both sections must apply on any charge.

Should Trump fail to respond to SCOTUS by the close of business on 20 December (as might be anticipated, given his record), how would SCOTUS proceed? Additionally, in Fischer -v- United States, 18 U.S.C section 1512 (a) (1) separates the subsections (B) and (C) with 'or' rather than 'and', so doesn't this mean that acting as described in EITHER (B) or (C) would render the actus reus unlawful, so that the correct interpretation does not require that BOTH (B) and (C) be satisfied? Thank you!

The obstruct case is gonna be very interesting. That law has at least 2 subsets, separated by 'or otherwise'. Will they say 'or' now means 'and'? I think they should change the question being asked for Sec 3 at the scotus level. Is the Presidency an office under the United States Constitution? Answer that and your good. I mean the Senate answered that in the 1860s but... satisfy the masses and declare it again.

18 U.S.C. 1505 (Obstruction of a Proceeding) provides in part: "Whoever . . . by threats or force, . . . obstructs, or impedes or endeavors to influence, obstruct, or impede the due and proper administration of the law under which any pending proceeding is being had before any department or agency of the United States, or the due and proper exercise of the power of inquiry under which any inquiry or investigation is being had by either House, or any committee of either House or any joint committee of the Congress" Given the foregoing, I don't see this as a difficult case for SCOTUS to decide. I think Fisher's case is a loser.

@simonwood1461, The SCOTUS judges are appointed for life, so there's no reason for them to be in Trump's pocket unless they want to be, unlike members of Congress who cow-tow to him for fear of losing re-election. And so far, Thomas is the only one who seems to be interested in being bribed & flattered with extravagant gifts that might influence his decision-making.

They will rule that it is too early in the process for them to be involved and it must go through the proper appeals channels. They may even rule the appellant has no standing to appeal since they won the case. When did you hear of the winner appealing the decision?

I wish that Professor Vladek had mentioned that the 14th Amendment §3 also applies to those who have given "aid or comfort" to insurrectionists, which Orange J. Man unequivocally has done. (Shout-out to Andrea Rovenski for calling this to my attention and for giving us the monicker Orange J. Man.)

The Supreme Court likely will not state that a judge would have to be rock stupid to call a group with no guns or other weapons who assault no one enough for an insurrection. Disturbance and inappropriate sure. Likely they will say it's not for any individual state to determine who can run in a federal election. It's a federal issue.

It is so tiring to hear trials hinging on just parsing of words like when Clinton was saying, "It depends on the definition of what the word 'is' is." It is disgusting to see get guilty people getting off or getting wrongly convicted, not on the basis of a legal technicality rather than actual guilt or innocence.

The Court has to reestablish its law-abiding position to the Constitution and Laws of the land and leave behind its seeming corruption in support of financial and political leanings towards the moneyed influencers. Otherwise, more questions regarding its existence will continue to shadow its role throughout history.

The problem with the 14th Amendment is that is disqualifies only federal offices instead of any elected office. This allowed so much of the Confederate ruling class to reassume their old jobs as state legislators.
