I agree! And, I believe that their poor cat died from licking that toxic liquid. I wish they had asked for a written testimony from the vet about the cat’s poisoning. I am sorry they didn’t counter-claim for their security deposit! That building should be condemned and the slumlord jailed. 🤬

Either the landlord is senile or he is a slumlord. That water wasn't dripping! It was flowing! The immediate communication of the couple is evidence that they were more concerned about their living space than the landlord. I believe the couple's cat died due to drinking some of the leaking water because my cats explore everything with their mouths and feet. Unfortunately, the vet didn't write down that they suspected the cat was poisoned. What would have proven that would have been an autopsy report, but those are expensive especially if the report doesn't determine the cause of death.

You can’t get pain and suffering in this type of case. It’s black-letter law. If you file a similar case, ask for punitive damages-not pain and suffering. She could have awarded punitive damages if they asked for them, but she can’t change the essentials of their complaint.

They weren't suing for the security deposit form that apartment. I'm not sure why, maybe they didn't pay one?.. but they were trying to get security deposit they paid at the place they moved into.

When you move to a new place a security deposit is required even if you move at the last minute; why would some else be responsible to cover it for you? You also will get the deposit returned to you when you move if you are caught up with rent and haven’t caused damages.

Wow, that place needs to be condemned!!! It’s disgusting and uninhabitable. I’m curious how long these defendants lived there and I would love to see photos of what it looked like when they moved in. Also, what is with these defendants? They actually thought they could get money for the security deposit of their new place. Obviously you would have to pay that no matter what. Then there’s the whole cat thing. Even if they could have proved that their cat died from some sort of chemical poisoning from something in the apartment, that doesn’t mean that the plaintiff should or would have to pay cremation costs. Just because the cat dies, doesn’t mean it HAS to be cremated. They could have buried it or put it in the trash. That would have zero cost to it.

It doesn't. Likely they did testing etc to try and save the cat first. Most people who would cremate a cat wouldn't put it down without knowing what's wrong. Ours cost around $100 to cremate alone and get their ashes. It's cheaper for "group cremation".

A complex I lived at redid some landscaping outside our apartment. Next rain I had water flowing in under the floor kickboards. Lol They took care of it pretty fast though. The central air was another story. The ceiling near the unit caved in due to their shotty fix. Had fire ants coming in under the same kickboards as well. We only lived there 4 months! Annoyed them so much with complaints they let us out of our lease. Haha

cat cremations sure don't cost $1,000, unless you're getting a gold plated urn...maybe. The most in Canada is about $500.

some landlords are strange about leaks. We lived in an apt over a store for 25 yrs.....for the first 22 yrs, the skylight leaked like crazy. I told the first landlord numerous times...she said her son, a roofer, would fix it but it never happened. After a few yrs she sold the building to her niece.....we had a walk through with her and i pointed out where the ceiling paint was peeling and a hole was appearing from the water. And that was the last i heard from my landlady...nothing was done. After 20 YEARS of this, a square foot of ceiling next to the skylight had caved in, and a 4 ft ceiling panel was coming down....i duct taped it back into place, climbed onto the roof and put a tarp over the skylight. (I told my landlady about all of this....nothing happened.) It seemed to work...then one night in a severe rainstorm, the bedroom ceiling started to leak through a number of cracks that had always been there, and water ran down the wall next to the bed. I duct taped everything, except for a couple of spots where it was convenient to keep pails to catch the water......nothing was done til almost a year later. Her hubby finally patched the roof and fixed the skylight to the poine where it stopped leaking. By the Grace of GOD, we didn't see any mold....but i sure wouldn't have wanted to look behind the walls or on the other side of the ceiling panels!!

@Leigh Hartman it was a REALLY nice apt, downtown in our small town. Convenient to everything, and there were no neighbours blasting music/ shouting at each other through the walls. AND a lovely garden out back...fenced...and i could have cats (rare 25 yrs ago.) Every apt has some problems....i could live with putting a bucket in a place under the ceiling that was out of the way. I was just shocked that they were so careless with their property! They both agree to drop the case in court and sign a paper they will go by the judges decision. They will not be able to sue for it again. Unless the judge dismisses it without prejudice.

My grandparents owned and maintained a mobile home park for 30 years. I remember being so little and laughing at how crazy they acted when a tenant called about a water leak. The way they acted over it always reminded me of fire men running around loading tools and calling for reinforcements to rush to fix the problem. I understand now the importance of fixing it quickly because with water even the smallest of leaks can damage so much. Lord forbid a tenant not reporting it or it happened where it was hard to see. But that would be a completely different story on behalf of the defendants because they weren’t the neglectful ones. Hell they literally had Niagara Falls happening in the property. Lol How the plaintiff acted throughout this case just baffles me. Taking 3 days to show up for a service call is despicable. I know for a fact my grandparents would not be able to sleep a wink worrying if their property and responsibilities were causing hardships on tenants that were paying us to provide them with a safe and comfortable home. If the plaintiff can’t handle the job then sale it. It’s less shameful to admit you’re too old to repair these things than just staying in denial.Jeez!! Have some self respect!! I feel so bad about that poor kitty. RIP defendant kitty. Oh, I laughed so hard when he actually said the leak was from the above tenants shampooing their carpets. Can’t wait to run that one by my grandparents. That’s one hellva cleaning.

Nope… The attached to an individual or items. Mean every time somebody leaves their house who has bedbugs, they can take the bedbugs with them. In addition if you’re in an apartment building the bedbugs can crawl through the walls just like roaches or mice

Yes, yes you can. The reason they are so insidious and nearly impossible to track is due to them navigating and spreading everywhere. As the other person above said, as simple as the neighbor leaving their infested apartment, some drop off of them in the communal hallway, or they can go between apartments via the ventilation system, if there’s shared laundry, etc….. I check hotel beds/mattresses and hope I never have to deal with them.
