Күн бұрынI Have Been SUED For The 2nd Time and I cannot believe it. This is the BS you have to deal with as a mobile mechanic and something has to change with the lawsuit laws. Right now anyone can go to the clerk of courts and pay $75 and fill a piece of paper in 5 mins and have there lawsuit filed and a courtdate. It blows my mind. My mobile mechanic business cannot handle another lawsuit and if I win my reputation still isnt the same. No matter that I will have won both of my lawsuits and people wont pay attention to that all they will say is that my mobile mechanic business which is named Semper Fi Mechanic is a bad company and has been sued a few times. So no matter what you lose money and respect

That is what is wrong with our court system. Anyone can file or charge anyone with anything. Like a person can say you raped them and then you have to spend money to prove you didn't and once you do prove it you are out a lot of money.

I'm glad it waa dismissed! I run our mobile auto repair service (my husband is the tech) and this is why I am extremely careful about paperwork and money. Customers put their pen to paper for a signature 5 times before our transaction is done. 3 signatures and $125 before we even touch their vehicle for the initial diag. Then they sign an estimate with an agreement for a mechanics lien before we'll order parts and schedule a follow up to perform the repairs. Once repairs are completed they don't get their keys back even for a test drive until they've paid in full and signed a paid invoice. Our liability waiver paperwork they sign makes it clear they're agreeing we aren't liable for anything that happens once they have their keys back and if there are any lawsuits they pay all costs including our legal fees. My husband doesn't think we need all that paperwork so I show him your videos! Also, anytime a customer does not like one of our "rules" of doing business I blame it on our liability insurance. For ex: they don't like paying up front for the first service call? "Sorry, our liability insurance says we have to do it this way." and I refuse to budge on it but still try to be nice about it and blame the insurance. Like, "oh I'd love to just do the work for you and let you pay me later if I could but those insurance aholes won't allow it!" same with parts. We won't install any parts unless we sell it to the customer. Idk what junkyard or whatever they pulled their parts out of plus our parts suppliers are the ones backing our warranty. So if we don't sell it we don't install it. A lot of customers get mad at that because they want to buy their own parts thinking they're getting a great deal and I just tell them liability insurance won't allow us to install anything we don't sell them. But the truth is I'm just not willing to risk it. And that's the biggest lesson of all I try to get my husband to understand. It doesn't matter how bad the business needs money. NEVER be afraid to walk away from a customer and say, "We won't do that but there's probably places around who will. I hope it works out for you." better to lose 1 sale and 1 customer than face a lawsuit and ruin our business reputation!

The complete and total lack of morals is destroying the world. People buying stuff then putting their used parts back in the box for a refund. Breaking the product and then claiming it was broken when they opened the box. Amazon does not even check returns and just sends out the same broken part to the next customer. It's an endless cycle of greed.

Is there a permanent dark cloud over your house? Luckily the case was dismissed. It doesn't dismiss the anxiety that it caused. It may be worthwhile to record your jobs and archive them. Pictures are worth more than words. Being that it's a 2007 vehicle I'll bet a rusty brake line failed in a panic stop situation. Since you were the last person to work on the vehicle these people saw an opportunity. It sounds like they were the guilty party in the accident. They are probably being sued themselves.

If I was you I would counter sue them for fraud and all the money you lost wasting your time going to court plus any lawyer fees you had to pay. This woman sounds like a person that wanted the job done for free and she was probably at fault for the accident and figured she would get you to pay for it since you were the last person to work on the car. I wouldn't let these scam artists get away with it. Good luck!!!

That is true I have been brought to court 2 times in 7 years both were dismissed but the first come me like $2500 in lawyer fees.

The moment a customer acts like they're in charge or they tell you how you will run your business (great example when the wife said you wouldn't get $500 upfront) that's when you walk away and tell that customer to take their car somewhere else to get fixed. If someone acts that way before they're even a client, they will be a lot worse as a client and even after.

What I have issues with is what to charge folks. I’ve been a ASE certified Master Tech for 17 years, after I was medically disabled from law enforcement. How does everyone decide what to charge on their jobs?

Whatever the book times are and your hourly rate. I charge $100 per hour so says its a waterpump book time says 2.5 hours then thats $250. So charge anywhere between $80-$120 per hour is average for mobile mechanics

People like this customer ate the reason that when my rear brake line went nobody could make me up a piece of brake line with the fitting on it , instead I had to buy it all separately and also a flairing tool to do it myself , all the stores say they can't make them anymore because they get sued if they are installed wrong and someone gets in a wreck

Trust me it will get even worse. The mobile mechanic shit is nothing more than cheap ass customers looking for cheap ass work and they will hang you anytime they can period!!!!! I have been in the industry 34 years now in my family auto repair of 50+ years. People will do anything to try and rake you over the coals. I hope you have good liability insurance man you definitely need it. Hang that mobile shit up and either go work for someone or start a brick and mortar business. Your dealing with cheap ass people dude !!!!!!

Not always true. Most of my customers live in high end neighborhoods. The 1st few yrs you might deal with bottom feeders but once you raise your prices alittle and have a minimum fee you won’t have to deal with too many of them. If they think a $65-$100 diag fee is insane then that’s not a customer you want! It’s an easy way to weed them out

You need to listen to the asog podcast. Lucas and David discuss all the issues you are having and how to solve them. You have all the ingredients to succeed but need the training on business. Try to listen to their podcast and see if you can learn some processes and business practices to improve your business.

Bruh, somehow this pops up in recommended. I've been having the worst year of shop ownership, it's destroyed my love for racing engines and drag racing. Calm down, it’s going to be alright. I’m trying to start a photography business on the side. I had a gig with a partner for awhile but some of the clients were straight up asshats just like the people that you are dealing with now. I KNOW what you are going through. I haven’t gotten sued, but some of the clients were just not happy at all with my work. I have a top notch camera, with all of the accessories to get the job done, but some of these people were just looking for a way out of paying the full price. My partner has put me on the back burner for now telling me I need to get my skills up a little better. I’ve dabbled in photography for well over 20 years. I tried to go semi pro, and it didn’t go so well. I’m down, but not out. Instead of looking at photography vids on KZfaq, I now look at Techs like you, Rich and Rainman….LOL. Car repairs interest me, but I watch you guys for knowledge so I can work on my own vehicles. Keep on trucking and look at some of the good advice in the comments section.

great video again! i just got let go from my company after coming back from workmans comp. shitty but living in a right to work state, it is what it is. i'm gonna start a mobile mechanics business and have been following you since winter of last year while i was off. i'm sorry about these damn lawsuits i can see you're frustrated. you're lucky you had a receipt and a contract they signed. what do you use for your invoicing and where did you get your contract from? did a lawyer draft it? i really want to make sure all my bases are covered when it comes to this and don't want to end up in a situation like this or if i did, i would be covered like you are!

I’m going to make you a custom digital invoice that you can make every customer sign that requires the customer to do arbitration an makes them pay for the full cost of Arbitration By doing that you’ll stop frivolous lawsuits as soon as you walk in to court with a signed copy the judge will dismiss the case

Yep will never be a mobile mechanic. My time, my tools, my know how and just my cars only. I had to learn this the hard way. All the calls you get wanting free repairs stopped about a month after. I would tell them just find a shop near you, they can help you.

My step brother has my dads truck now. 2007 Dodge Ram 1500 4x4 5.7 hemi. His brakes randomly don’t work at times. Like nothing. Then bam they work again and it will work fine for ever until it just randomly happens again

I'm glad it worked out for you. It sounds like you could've got your retainer fee back plus lost wages in a countersuit, especially since you had all the paperwork and those shady b@st@rds had zero evidence! But I'm far from a lawyer, it just sounds right to me. I'm sure you just wanted to get it over with and move on.

They say in America, “ you’re innocent until proven guilty“ but I say that’s not the case you’re already guilty until proven innocent. Everyone will assume you’re a bad person because you got lawsuits like I said in this country you’re guilty automatically in public eye and in the courts unless you prove your innocent.

Innocent until proven guilty is only guaranteed for criminal matters. Pardon my ignorance; but are you licensed and insured? Try Next insurance for liability if you are ASE certified. Ours is like $30 a month. Super cheap.

I like how you conveniently leave out the fact that would forsure had the brakes apart to do the upper and lower ball joints, not saying to did anything wrong but any real mechanic would know that you’re hiding behind a parts list.

This is true. However, the reason they called him out for repair was not to fix the brakes, but to fix other suspension issues. If they claimed he did brake maintenance, and he did not and he has proof, then the case can be dismissed based on false pretenses. If the brakes failed due to his work they wouldve known before the accident because there would be some nasty grinding noises going on
