The problem is it is one of the most vague Fed laws out there, making it ripe for abuse, which is what is going on. The statute lends itself to multiple meaning readings. Keep in mind the court doesn't actively seek out having these things in front of them. When they do, they're generally going to be extremely thorough, and I think taking a generally skeptical view of the federal government vis-a-vis law enforcement is far preferable for a constitutional representative federated republic, as opposed to deference, which has been a problem.

Also, if you read his statement given in private in front of members of the J6 select committee members, he admits that he did step inside the Capitol.

And why wouldn’t it be reasonable to conclude this? If the intention to obstruct the proceedings is evident, why in principle would it be different. ? Just because the degree/means (fire alarm vs violent insurrection) is different, doesn’t mean the principle is different. This is why different sentences are given for different circumstances under a given statute.

The only problem with these lawyers lines of thinking is that we the people are the creators of government. We have ALL political power to change government in any way we want and at any time we want. We also have the right to inform and instruct the government of the law. The law also states that elections are to be by the people. Any election where the federal government has provided funds or is run by a foreign power (out of state companies, election machines, are foreign under the law) is illegal and unconstitutional as they are not run by the people according to the law. So when the people are seeking remedy and desire to enter Congress to ensure the will of the people is done. The "obstruction" that was done was the obstruction of the people's rights. Government has no "right" to anything, government only has the powers expressly written in the Constitution to act for the benefit of the people. What happened on J6, the denial of the people's rights, the denial of the Congress to slow down hear the people hear and investigate the evidence before moving to a vote, the people denied entry into their government chambers, the people that were assaulted and murdered on J6... These were the crimes that occurred on J6. Any person that damaged the people's property is also liable, many of these people were never charged with crimes, as the people suspect they were the government damaging and destroying the people's property. Read and know your State and Federal Constitutions!

The problem with the prosecution's argument is that right from the get-go the crowd was not only let into the Capitol they were encouraged by many (who we already know) and by the Capitol police so in fact there was no breech and then things became rowdy with a few unruly citizens. So, with that many people at the Capital why didn't the C-Police get onto their megaphones in the first place and say "Keep back" instead of letting them in in such a vigorous way? So, in fact Amy Comey Barrett brought up a very good point about that very same thing.

The justices need to use the example of Justin Jones and Justin Pearson in Tennessee as an example here. How would their in-chamber protesters be considered under the breadth of this argument? Intent was there, leadership was directing protestors, official proceedings were most definitely impeded. Would those protestors be prosecuted as presented?

For every charge against Trump, there appears to be evidence of intent. In many cases, Trump himself provided that evidence.... but that is what trials are for... he can explain to the courts and the American people why it is only the appearance of intent. I will note that he has not spent many BTUs trying to argue that he didn't do the things he has been accused of or even trying to convince us that he didn't intend to do them. He seems to have his entire defensive strategy wrapped around the axel of immunity... To quote Richard Nixon, "It's not a crime if the President does it."

Advocacy is often not fully truthful, advances the arguments of the client. Does Prelogar actually believe that Congress intended to criminalize protests that intend to disrupt congressional hearings, etc? Here, like the polished advocate that she is, she unhesitatingly asserts that, certainly, Congress had just this in mind when it passed SarbOx in response to the destruction of documents by Arthur Andersen in the Enron case.
