An overseas nurse from Ghana who relocated to the uk in 2017, applied for Indefinite Leave to Remain and was denied. The reason for the denial was scary. So I had to phone uk home office for clarification and this is what they said….

I feel the home office is not very considerate in their dealings sometimes seeing as most of their rules are so confusing and not straightforward, I have noticed in UK mostly when you make enquiries you will be sent links that further confuses you showing that the person you are asking isn't even sure of the answer to give you. Hi Nanelle - my wife is a Thai National living here in the UK on a spouse s visa on the 5 year route before applying for ILR - her 2 nd application was submitted at the UKVI centre in Birmingham on the 22 nd March 2022 and up til now my wife has had no decision made in fact we have heard nothing - we got our MP involved who has tried to get an update but still no answer ? I have tried ringing the Home Office but only get that run a round pressing button routine - I have also sent to the Home office a complaint 2 weeks ago via their complaints system on their web site - nothing back yet - how you have managed to actually talk with Home Office advisors intrigues me in that I wondered if you might help myself and my wife ? - this situation has been so frustrating as its virtually put a hold on our lives - I am retired and so is my wife I am 72 and my wife is 67 - We were married in the UK in April 2019 - your advice would be very much appreciated - thank you ----- Graham and Patty

Yes bank partners is considered a second employer. Overtime shifts with your main employer doesn't count

Council tax discounts and exemptions are not ‘public funds’ for immigration purposes, and therefore can be accessed by a person with no recourse to public funds if they meet the qualifying criteria.

When you're deny ILR, you'll be given an option to appeal based upon the reason. If you breached your agreement such as working above the stipulated hours, there is possibility for you to appeal this and you're likely to win. But if you're refuse on age, fraud etc you'll not be given the opportunity to appeal in any way and you're at risk of loosing your stay in the UK. My advice to the victim is to carefully look at the decision to see if there is an option to appeal?

I don't understand why people apply for visa after studies knowing very well they breached the law? It's simple, go to another European country to work then apply for visa from out if u prefer UK. People should just be smart and stop blaming home office.its not ur country, they can just denie u just coz they can. For someone that receives salary that isn’t been taxed, no NI fee deducted or pay slip provided but they still pay into his bank account, do you think it can affect the ILR or there’s a way they can know. You know you’ll submit your bank statement right ? So how do you explain regular untaxed payments ? I think that’s even worse. But you should speak with an immigration advisor.

Why don’t you guys just register as “a business” or “private consultants/sole contractor” and get your money and pay taxes??? I don’t mean to judge but dependant or not, you’re working and getting money in a country (you came to because our own country has spoilt) and you’re refusing to do the right thing!! It is this same attitude and fraud that destroyed our country and you’ve brought that same thing here! The country is good because people do the right thing but noooooooooo not you people. Going through the comments and there are lots of fraudulent people!! Why can’t we do the right thing? We destroyed our countries with this same behaviour, we’ve come here but still want to cut corners. I pray they catch all of you. Me if I know any of you, I will personally report.

Wait, just to clarify, if you are working in the NHS you can work for more than 20hours?

The bank in nhs is considered a second employer so no you cannot

If your agency or Care home isn’t giving you shifts can you do the 39hrs and extra 20hrs wit the second employer who is ready to give you more shifts?

Do you mean doing 39hrs with the second employer? I don’t think it’s right. From what I know, your sponsor must give you the 39 hours then you can do the extra 20 hours with the second employer.
