What they are doing, the superior officer, is denying the detaining officer's errors in public and not giving the detainee further info to log legal complaints. What i hope happened is the detaining officer in the was counseled by his superior officer of the why he was wrong.

You never know. There have been settlements over more than 75k for false detainments, depending on the area. There was a guy filming outside of the police station in Pueblo CO and he got a hefty sum. Then there was a guy (I think this was in Missouri, and I believe it was covered on Audit the Audit) who was at a gas station and he was recording the police from across the street. One cop drove over claiming the guy's red light blinking on his cel phone (which did not exist) was interference, and detained the man while demanding ID and the cop made several threats. This also wound up being a big payday. It's also worth noting that many settlements are $X amount PLUS reasonable attorney's fees, which are paid separately.

​@az21bob666 false, RAS requires factual basis to detain someone. The only info the officer had was a call about a presumed teenager, no facts. The officer had every right to initiate a consensual interaction, but had no factual basis for detainment.

I agree that there is much wrong about this interaction, but if the law states that you have to be over 21 to open carry and you saw a 4 ft tall person who looked like they were 8 years old, carrying a .45 1911 in a holster over their shoulder, you don't think this copy would be able to "judge the law" based on how old the person looks?

You need specific facts that would lead an offer to reasonably believe that he is under age. As SCOTUS has ruled, a hunch isn't good enough. Then there is 38.02 on top of it, as he brought up in the video. The officer broke the law.

@@markhoath2961 The articulation requires SPECIFIC FACTS as grounds for that reasonable suspicion (See Terry V Ohio) and that's entirely the problem here. What SPECIFIC FACTS does the officer have (meaning not guessing) that would reasonably lead him to believe that he had, was currently, or was about to commit a crime? You can't just say, "Well, I think he looks underage because..." as he has the appearance of being an adult (and it turned out that he was.) If he was carrying a school backpack and wearing a letterman jacket of the local high school - those would be specific facts that would indicate he was still in high school (for example.) If he was barely 5 feet tall and looked like he had barely entered puberty, that would also be something. But none of what I brought up applied to him here. Since the officer lacks the SPECIFIC FACTS that are required by SCOTUS, all the officer can do is articulate his hunch, and as I already established, SCOTUS has ruled that a hunch isn't good enough.

@@lisadishner8730 Regarding providing ID...not really. In any state, there must be RAS before you're required to provide ID. Traffic stops are the only things that are kinda different. And I say kinda because they must still have a valid reason to stop you in the first place, which is essentially the RAS.

Why is it that when you know what the constitution says and you know your rights and use them, cops always ask "Are you a lawyer?" Or "Are you a sovereign citizen?" Why do you have to be a lawyer to know and use the rights that you have that are laid out for you to read in the constitution? If you dont use your rights you lose them

The cop is absolutely right. He has the right to request ID from anyone that he comes into contact with. What he does not have the right to do, is DEMAND ID. And he certainly does not have the right to torture you with handcuffs until ID is presented. Especially with no reasonable suspicion of a crime being committed.

He had a reasonable suspicion that Mr xavier was under 21. Which made the detainment legal. But it became illegal once the supervisor confirmed he was over 21.

Cops must understand that people do not have to prove their innocence to oinkers AND it is incumbent on the barnyard crew to prove guilt. People have zero obligation to assist cops in their investigstion of the person even if they are guilty.

Sadly, police do not have to know the laws? IF they did need to know, they'd be taught during their 6 months of training but they aren't taught much of anything except basic rules of the force. Besides, cops lie all the time on their police reports which is not legal but they get away with it. Adding/stacking on extra charges & letting the Courts sort it out is an act that requires the police to LIE on a legal document = that is Filing a False Report and/or Perjury. Why are they never charged w/ this crime? Don't they adhere to the same laws as we do? Apparently not but the Prosecutor/DA's are the ones dropping the ball. Make em' pay for lying against the innocent. They ruin lives & violate their Oath to the Constitution! GGrrrooowwlll

This county sent me to prison in 2005. I was 17, first time ever arrested, and they gave me 10 years. 10 years later, both the judges involved in my case were withholding evidence as a DA, and sentencing issues. Judge Carnes was sending people, who didn’t deserve it, to a rehab that he was partial owner of

It's kind of scary that the officer thought he had the right to enforce his own revision of the law on the fly. His entire argument was essentially: "The legislature hasnt revised the law to reflect open carry yet, but im enforcing it that way anyway."

The way I read 411.205 is that LTC holders must present ID when asked but there is nothing about providing ID for non LTC holders.

I can tell you straight up. These suckers did not get any call about a teenager roaming the neighborhood. These thugs were just roaming the streets in order to find somebody to fuck up their lives. Hence, they ran into this young man who by intent and purpose was minding his own business. Assuming that because of his looks, they thought that he was a teenager, so they decided that here is a target to fuck with.

I applaud this officer in that he didnt get triggered. He believed in what he was doing and repeatedly tried to explain what he believed WITHOUT losing his temper. That is a rare thing. I wish all officers were that way! He should be applauded and held up as an example.

I get tired of people saying that the cops don’t know that they can’t demand ID minus an arrest! They know what they’re doing but don’t care. There’s no accountability for their actions. But they hope you don’t know the law! And it’s sadly true!

There are a few liberal Officers in Texas who are very unhappy that the open carry law was passed. They can be seen all over the state doing just what is seen here.

1:40 "I have every right as a law enforcement officer to request ID from anybody" Rights are god-given and inalienable...... Mr. Police officer, you may have "authority" to enforce law.... But it is in no way a "right".

Even when arrested you dont have to give "ID" just name, DOB, and address. Of course if its a traffic stop you have to produce a DL when required by law.

In Iowa, even if lawfully arrested a man is not obligated to provide any sort of identification whatsoever; this is an alienable right that all men share; and no statute with standing can compel a man to act as witness against him self.

Criminalization of the exercise of a constitutional protected right by the cops who went to a private academy shows a total dysfunctional academic system which does not properly train its cadets to act professional and respectful. They teach deceit, and mis represents their authority which leaves the cadet unable to handle an encounter without acting as a tyrant!

I.D. addiction. "You look younger than 21." Some people are like that. The last time I had to show I.D. to get into a bar, I was 42 years old. Guess what I looked like at 21 years old! In the end, the cop learned nothing.

I've educated myself on every job I've ever had. Why wouldn't a law enforcement officer educate themselves on the laws they enforce? It doesn't make sense. I don't have the proper disposition to be an officer myself, but neither do most officers.

When are cops going to learn that just because they got a call doesn't mean that they can violate citizens. Had this cop stopped me when I was 30, this cop would have illegal stopped me. At 30, I still did not look like I was 21.

In the U.S. you are guilty until proven guilty. And this also shows how there's no such thing as a "good" cop! The second senior officer sat and watched this man's rights get violated. Did nothing to correct the situation. Following up everything with copsplaining..
