Hi there. I am a US citizen since 2007. My I-130 for my son and his daughter was approved in 2004 and we were waiting for visas to become available. We received Welcome letters from the NVC about visas having become available just 4 months after the primary applicant- my son, died from a car accident. CIS revoked the case. I filed Section 204(l) and CIS did not reinstate the approval of I-130. Can I or my granddaughter file I-130 for her and consider the priority date of the previous, revoked I-130 case filed by me for my son and his daughter work for the new I-130 case?

I'm a US citizen. My wife and 1 daughter were in USA with me as immigrant visa and they have valid Green card and social card. But due to my mother were living outside USA and she were pluralized and nobody were there to look after her. So I sent back my wife and daughter in 2012 to my mother in Bangladesh. That's how they were overstayed. No my mother died and I want my wife and daughter to bring back to USA. Would you please advice me should I apply on I-130 for them or there is any other ways open to override overstay issue. By the way, I also have adopted a daughter who obtained Pay role visa in 2011 and entered USA with us. But while my wife went back to Bangladesh she also returned. That parole visa were valid only for 2 years. Would you please advise should I apply under I-130 for my adopted daughter.

Hey I have a question I hope I can explain it. I did my I-130 sent it to USCIS first update November after months went by I got a new update April 30 and a letter for what I have to do next I did all of it. Pictures together conversations with dates times and a letter how we met. And get the notary. Well here’s the question my wife had to write a letter and get the notary too and sign it like I did but the U.S and Philippines can’t get mail from each other because of the virus around the world yes she made a copy and emailed it to me with notary on it will the USCIS be ok with the copy of the letter also I print out from google about U.S and Philippines can’t get mail from each other. My due July 20 2020

Hi , I watched your video and the content was really helpful for the sponsorship of green card for my spouse. But i've a question, my wife lives in canada and she about to give birth to our child. we have finished to completed the i-130 form. it's ok to send the form without the child birth certificate and send it later? because it will take time to get it and we don't want to delay the process? what do you recommend? Also do we need to fill another form for our child? On the form i-130, question 61.a or 62.a. can we apply for the adjustment of status i-485, if when we send the i-130 while she is in Canada? If she comes as visitor, Can we adust the status and apply for the i-485? thanks in advance for your answer

Thanks for your question, Aris. It takes about 3 years for a green card to go through if you are married to a U.S. Citizen, assuming that you did everything right in the process. I always recommend attorney oversight, because mistakes can set you back substantially. My daughter is a US citizen (born in USA) on April 1st, 1999 and since January 2000 we all have been living in Egypt and we want to immigrate to the US ASAP. My daughter has a valid US passport and she wants to file I-130 petition for me, her mom, her 18 y/o sister and 12 y/o brother, so my questions are: - “The sponsoring ability issue”: as she is still a university student (pharmacy) and has no job yet but I have the financial ability (owning my international trading company in Egypt). - “Waiting queue”: I learned that we (as parents) might get a faster response than her siblings. I think the logical solution is to make her file I-130 for us (parents) and then if we get the green card, we can file our own I-130 for our other kids, but this solution has another problem: Our second daughter (now 18, born October 2001) might age out of 21 before we are able to file our own I-130, can her sister file I-130 for her so she can benefit from (cspa) then change the petitioner from the US sister to LPR parents ? What are your recommendations?

only within family, so no , you must become citizen (5 years) then petition parents to receive green card (6 months-1 year) , then have them petition for your brother/sister (up to 7 years) and then your sibling has to petition their daughter (your niece) (about 6 months or 7 years if unmarried/minor) , its possible but may take 20 years, if shes a young girl go for it

Generally, you can file an I-130 from outside the US. However, as the petitioner you must also file an affidavit of support. To be a sponsor on the affidavit of support you must be domiciled in the United States. This is usually the issue that results when filing from outside of the US. However "Domiciled" and "Residence" are two different terms and you should really discuss this with a qualified immigration attorney. Please feel free to give us a call at (630)324-6666.

I applied for my husband. I am a green card holder..Uscis received my case on 06 October 2017..And i got NOA1 on 11 october 2017 But I'm not getting NOA2...
