It’s easier said than done. UI should be available to all workers regardless, this will eliminate or reduce asshole bosses for sure.

I'm a server and had been putting up with harassment and abuse from my boss for 2 months because I stood up for myself. 3 weeks ago I had enough and walked out in the middle of my shift. Thank you for your advice. I'm going to take the steps you've suggested

You never ever ever "resign" under any circumstance. When you resign ( no matter how you classify it or put verbiage around it " makes you ineligible for unemployment benefits, relocation, company severance package, etc. No way! Just come to work and do nothing... let them fire you. In this day and age, companies will never ever say anything about you except name, dates of employment, job title, salary. If your boss hates you, he will say something negative anyway under the table. Fire me baby!

that's the point. whenever you boss is trying to make you quit either by asking you to quit, telling you to quit, suggesting you to quit, pressuring you to quit by making you miserable and hoping you walk off the job (especially if you are not a probationary employee), they have one goal in mind and that is to deny your post termination rights. bosses do this because there is no cause to dismiss you and whenever you are dismissed without cause, they have to provide a severance package to you so they make it a mission to get you to resign to avoid providing you unemployment payouts/benefits

Too Real For These Fake People it depends on what job you do and what position you have. I'm a part-time employee, so that's not available for me. Also, getting fired is not a good thing at all! Because if you apply for a new job and they call your old job for reference, one of the things they will ask is if you are "rehireable" or not. "Rehireable" means that you left on good conditions, whereas "non-rehireable" means that you were fired. That is not a good look, and no company wants to hire someone that was fired.

no. when you are given severance by your employer, that means you have been terminated without cause (aka no fault of your own) which means there's no shame in it. it's only when you have been terminated with cause (misconduct) where there is shame in it. also, your previous employer claiming cause for dismissal does not mean that his action were appropriate. some employer claim cause for dismissal to avoid their obligations of providing unemployment payouts/benefits/claims and the boss is liable to be sued for wrongful dismissal. for the whole "Eligible for Rehire" concept, even people who quit are not eligible for rehire. the people who usually are eligible for rehire are people who experiences a disruption of earnings due to reduction of force (aka layoff)

This isn't exactly correct. If an employer makes your workplace so intolerable that it forces you to resign, I have seen multiple unemployment cases that were favorable to the employee. For example, if an employer suddenly reduces your hours to 2 hours a day and you have to drive 1 hour a day to work, this creates a hardship for the employee, and in most courts is considered a "de facto" termination. You can still ALWAYS file for unemployment if regardless if you resign or not. Always do your best at work, and do not give them a reason to claim job performance as a reason for your termination.

Have you noticed the phenomenal increase in the use of employment agencies by established firms and the staff turnover it produces , middle managers are left alone as long as there are increasing returns and no liability for there actions.

I just quit my job because of my boss. He wanted me to fix cars at jiffy lube speed and perfection like I'm somehow David Blaine and snap my fingers... Snap, cars done!!! Problem is , most of the cars I dealt with were wrecked and rebuilt by those nish nish russian asshats we've all come to problems with, and hammered to shit fleet trucks from the 80's and 90's. But I'm supposed to go faster than a master tech I. A dealership. I couldn't even get a car off the ground without him running around the corner and asking what I've found and why it's not half done even though I just got handed the keys two minutes ago... Nothing's ever fast enough, good enough and no one is actually working till everyone is literally sweating and panting from the forced pace, at which point he adds more work. He wants warp speed and just keeps pushing for more no matter what you do. And when you meet his desired pace, he pushes for more. I said fuck it I have a job linked up, I quit at the end of the day. When the last car is done, so am I. He responded with and i quote, " pack up your tools and get the fuck out of the shop right now, You're done. Thanks for ruining my hunting trip that starts Friday. ( it was Wednesday) Now I have four cars to fix and I'm out several hundred dollars. Have fun working at the part changers dealership you jerk." Proof that you can't fix stupid and douches are everywhere.... Oh and by the way, that would be the boss at whalen tire in Spokane valley Washington. Trent and Hough st. Dudes name is dave ellis.

Thank you for the video. I took FMLA (after HR told me to) and I also have ADA but when I returned, my manager put me on probation. Won’t let me use PTO for time to see my dr. No matter what I do, I end up getting written up. They’re making it so miserable for me. They cranked my workload way down so I was doing no work when I returned from FMLA then after a few months they cranked my load up to an impossible level. They invested a lot in my training, I’m good at my job, I don’t understand why they’re clearly trying to get me to quit. :(

I have done this too many times to count anymore. The housing crisis hit at the height of my career and then I became a target and then I was an undesired demographic so no applications were ever acknowledged, or too much experience so I wouldn't stay blah blah blah No one should be allowed to use a position to mistreat someone at a job that's slavery

The question STILL remains, can one get Unemployment if they voluntarily or involuntarily resigned? My reasons are because of mainly stress of my job which add to my health issues and no child care bc I am asked to return to work instead of staying remote...

Hi retire in n.j after 25 yrs in Department of corrections,,l voluntary retire reason is was very stressful it 1hr to get to work and 2hr to get home,,and receive several charges for being late ,correction have a no tolerance for being, l was brought on late charges and was fine 6,000 for being late in a course 6mos,4 time doing that time,l would get caught up in traffic, accidents,,so when my 25 came up l voluntarily retire, and l apply for unemployment benefits until l fine a closer in s.jersey area ,and was denied benefits, what can l do ? I will be in a appeal, any advice

I am very confused about the last situation. I was working in a toxic environment and had been emotionally manipulated enough... this one nurse has played all cans of games "for my own good" and "wished to protect me from myself"- her words. She came into a room and yelled my name multiple times over a pregnant woman being cleared of clots and coming off the table where I was keeping her calm and on the table. The nurse was doing nothing but rolling her eyes and this women was quite upset and the doctors where struggling to stop the bleeding. I was told it was urgent and only I could do it, the charge Melinda said no now, only you can do it, embarrassed, I ripped my had away from the patient and walk out to a giggle, an ummmm and, oh yeah, set up that room, I can't I'm too busy, walked back to the front desk and started the "whispers". I was emotionally done- I had a work place accident 3 weeks earlier and still getting workmen's comp for a concussion and neck sprain, I am belittle ever time I come to work by someone and she love to threaten write-ups and tell me all the time I am less than while making fun of my ADHD. I was done. Did the room, told her I was leaving because she was in charge and I would not be under abuse today, and then talked to the managers, she told them I had disobeyed her and causing work place safety issue because I would not do what she said about the room- I was creating a volatile work place- and by the time I had gotten my mangagement they had all wrote in something- "a lot of people have turned you in" you have to leave. I said are you firing me, she said I don't know, I said then why do I have to leave, because you have created a volatile work place. Note: I was angry, and but I never threatened her- she over 300lbs and an inch taller than me, I am 125 lbs on a good day quite upset, I am a nonviolent person, I can't even kill bugs in my house. And she twice as big as me... so physically, how scared could she be, but we all have fears, which is why I left I had delt with much from there for years, I leave or I would have because suicidal. I was depressed from a concussion and chronic neck pain due to injury at work, I was taking up to 1600 IB a day to regulate and on "light duty" but never given it, and if I said no to anything, "write up", there is no way not to be at work for my job to be "light duty." Many have also, but Melinda most often and harrassed other nurses to write me up too so she wasn't the only one. She, herself have been written up by both patients and staff and never gets in trouble because she is friends with the big boss. She is not the only bully but she pressed to hard too many times- I had to leave or lose my mind. Then the managers said, I had to leave, I asked again if I was to be fired, the replied " i don't know" again, then I asked how do I resign, I can not take this abuse any longer- she said send in an email to you manager. So, I went home and asked "I would like to know how to resign properly, I need out, I cannot take it any longer". Reply, resignation excepted no further need for your services, now two week notice necessary. I replied with ok, I was asking, but ok, so when does my insurance and workman's comp run out, she replied "day of termination, that 's today"... I replied, termination or resignation, very confused. No response, even after repeated inquires, nothing. I called workmen's comp no response and I stopped going just encase they would have made me pay, and no insurance was not true I have it until next month, because I got prescription filled and thats what they side it read. My prescription without insurance isn $276 with coupon, so after this month. Ideas, wisdom, just suck it up and move on, get a lawyer? Help. its quite a mess in the details, but do I have a case?
