The smell of weed is probable cause to search a vehicle in Louisiana. However, the smell of weed is no longer probable cause to search a residence in Louisiana. Beginning August 1, 2022, new laws went into effect that now more clearly control probable cause searches in Louisiana.

This is going to become an issue due to the fact that in this state your vehicle is considered an extension of your home. Also, the law says it’s illegal to smoke while the vehicle is in use or on the right of way to a public highway. Who’s to say someone that has a medical card prefers not to smoke in their home due to their children or elderly parents so they go sit in their vehicle and smoke. Or that they may have smoked in the vehicle on private property or a private road.
