John Waters has been in the media business since the 1970s. He has worked for numerous newspapers and magazines, including Vincent Browne's Magill. He is more than acquainted with defamation laws in Ireland. He dug his own hole here. Waters had the means to make his points against the Irish Times just as forcibly and without defaming Kitty Holland. He chose a different course. This court loss, and financial cost, will tame Waters worst urges to defame again, and hopefully help make him a better "journalist".

The law is crooked and it’s difficult for an honest person to get on. Enoch Burke is a prime example. He should be backed by the people of Ireland . I wish there was more like him. I feel sorry for John Watters. It seems that you can’t have an opinion in Ireland anymore.

@@johnpurcell7525 or avoid going to court in the first place and don’t say things in public that will defame someone. Then when your going to court do everything to settle it unless you are 100% sure of your case .

Instead of this discussion, people should be talking about the ridiculously high cost of legal fees in this country, which is bringing the legal profession into disrepute, and also the ridiculously high cost of injury awards. People in the latter case should be awarded enough to cover their medical expenses and no more. In this case there is no way that legal costs should have amounted to £150,000. Regardless of the rights and wrongs in this instance, it deters people who have a genuine grievance from taking any legal case for fear of losing and becoming bankrupt.

Couldn't agree more, these legal decisions are a matter of opinion sometimes you agree other times not but some one has to decide, fair enough. It is the extortionate cost of these things I find ridiculous.

Speaking of 'factual truth', didn't Kitty Holland fabricate a story about some migrant men staying in tents and she said they had been assaulted by some local Irish lads, but she had no evidence whatsoever and the local Gardai said they were not aware/informed of any assault? Her story went all over the MSM news. No arrests were made by the Gardai of any local lads. The whole story then just basically disappeared.🤔

Interesting about having your opinions based on facts. What is a fact ? A lot of newspaper reports based on opinions, rumors, gossip and lies are written everyday.

Kavanagh called her a liar professionally. He was brought before the courts and given an opportunity to defend himself. Someone who wants to state his version of "facts as he sees them" or "alternative facts" hasn't got a leg to stand on if they are basically lies because the truth doesn't suit them. What the f was a rambling 110 page letter supposed to do for his case? If you haven't got ANY evidence to support your allegations then you are the one who is going to be judged as the liar in any fair court of law. Unless you believe having a different opinion and voicing it publicly without any facts and slandering someone else should be viewed as legitimate? There are only facts. Alternative facts are just another way to say we don't like what you stand for so we'll just make up convenient lies to support our point of view. Kavanagh got exactly what he was asking for.

Remember he got €85.000 from RTE when he felt offended by something someone said. I can’t remember the exact details.. hopefully he invested it well and has more than enough to pay all costs involved.

According to the judge: "Opinion has to be based on fact". I have lots of opinions that are based on the facts as I see them. It seems mean spirited that Kitty Holland, the privileged daughter of the noted English journalist Mary Holland, should bankrupt someone of the courage and integrity of John Waters. A man born without privilege and who pulled himself up by his own means and merits. John Waters has described the Judiciary in Ireland as being appointed, not so much for their independence of mind, but because of their links to the political caste. It is sad and tragic.

Waters made a defamatory statement and couldn’t back it up with actual proof. Holland could, you really need to stop trying to play the victim because all you are is a mouth piece for hatred and lies that have no place in 21st century Ireland. Or do you want to end up like waters ? Made parting with your cold hard cash might teach you a lesson in humility and respect.

Let's quote the brother journalist of Kitty Holland in the Irish Times; the Monsignor himself, Finton O'Toole: He wrote: "A simple fact of this business is that journalists occasionally make mistakes. It is very easy for a passionate argument to cross the line that separates necessary polemic from unfair attack. Even when the writer is trying to be careful, an implication or allegation that ought not to be made can slip through the net of caution. This happens from time to time to every columnist" Agreed. No need to bankrupt somebody for something very few people heard or read and those that did, understood that it was simply part of a passionate argument that had "slipped through the net of caution"

Didn't three inquiries find that Savita died from sepsis which was not noticed until it was too late? Not from the lack of an abortion. Why let the truth get in the way of a good story though?

Opinions need to be very close to fact if you're going to publish them or upload them. Once upon a time, JW was a reasonable person. In recent years he just seems to have devolved.
