I think I will sue the family on emotional damage of slander and here say of my current football coach. The only money possibly owed would be the 500k signing bonus with attendance. That would probably be settled at a lower price point as well. The rest of the contract required him actually attending all four years.

UF found our Rashada camp lied about what he was receiving from Miami. Rashada claimed 9.2 M but in reality it was substantially less. UF found out and killed the offer. The offer was wrote that both parties could cancel the deal at anytime

@@FLA813BMO Some states have passed laws that allow schools to offer NIL, and more have bills working their way through the system now. NCAA can't do anything about a law. Also, the NCAA passed rules last month that allow schools to directly facilitate deals between players and organizations that will pay them. However, the schools in the states that have passed laws can literally pay the players themselves. There has been 5 states that have also passed laws that prohibit the NCAA from penalizing teams for paying players

NIL as a system is broken. None of these kids are worth seven figures in college. The portal is also a joke. There is zero accountability on the players being forced to man up to their decisions. First Tanager, sure that may have been just a mistake. Second and beyond? No. That's why contracts exist. Florida should drop the hammer on this as it can't be proven and also seek the plaintiff to pay all attorneys fees.

This is no different than anything else. These kids are worth no less than what recruiters and marketers are willing to pay them. Why would you presume that the claims cannot be proven? Are you inclined to believe that an alleged 8 figure NIL deal negotiation to secure a prized recruit would not at least involve some non-privileged communication between these defendants that would be subject to discovery? Surely there was also communication between the parties that can be asserted to establish a viable claim of detrimental reliance. This kid was represented by an agent. Who’s the attorney that filed this case? 🤔 This should prove to be a costly embarrassment to these defendants and, by extension, the entire UF football program.

The NCAA want this. They never wanted players to be payed. It's only allowed now because the Supreme Court said they have to. The NCAA is dragging there feet and not putting restrictions and limitations on things because the more they let this get out of control, the more they can act like "I told you so". If they weren't a bunch of egotistical dumbasses, this wouldn't be a problem

Agree. Free education, an apartment, food, and a chance to play for the pros should be enough. CFB will be dead 10 years from now. The only point I will relent on is that since a college sport takes up all of their time, perhaps a cost of living stipend equal to what a typical college student would make who is working a part-time job.

I'm just trying to give a little more context to the story as I’m a little surprised someone like Josh hasn’t read into this more before talking about it. The lawsuit states that Billy, Hugh, and the staffer all knowingly and together colluded to have Rashada sign and to lose out on his Miami deal. At the time, Florida didn’t have a QB commit in the recruiting class, so I believe that Billy and co wanted this kid on the team. Billy and co also forwarded $150K to Rashada to help him “get out” of his contract with Miami. Also, the contract Florida offered apparently had a clause where it could be terminated at any time. The whole situation is ludicrous and it’s shady how it came out at a time when Florida was picking up momentum in the transfer portal and recruiting. Kirby is definitely just wanting to cast a negative light on a rival, just like how he reported the incident with Mims. Kirby promotes a fast and furious culture and has had a staffer and player die because of it, but that was swept under the rug.

Literally every off-season he has a “why Miami” is so good/going to win big video and kisses up to Kirby too. He likes those free trips to SoFla and Athens. This is a contract law case. There wasn’t a written agreement between the player and the school so it’s his word against the school’s. It’s a “he said/she said”. Although an oral contract between two parties is enforceable, it is only enforceable when both sides agree on the deal points of the agreement and there is no dispute. Obviously, both sides of this case aren’t in agreement on the details. As such, this case won’t ever see the inside of a courtroom. So, why would the player file a lawsuit? Well, an attorney has convinced the family to file in hopes of getting a financial settlement by embarrassing the Coach, the school’s athletic association and negatively affecting recruiting. the attorney will take the case at no cost to the client for a % of the settlement ranging from 30-50%. So, this is why a lawsuit was filed, the truth be damned.

Your primer should have included the term *detrimental reliance* . Who is plaintiff’s counsel in this case? 🤔 What does this tell you about the likelihood of there being viable claims that can survive MTD(s) and summary judgment, and advance to discovery and trial, if necessary. The facts and the evidence were evaluated by trial lawyers experienced in this space. I expect these defendants will be unsuccessful in getting this case dismissed on the pleadings. It will be interesting to follow.

Thank you for the insight. If Rashada in fact has no substantive evidence to prove that Billy et al made those promises, why don't they just deny his allegations....just tell Rashada to pound sand? No financial settlement necessary. Maybe ending this bad publicity has some financial value, but not too much. The horse has already left the barn. In any case, it's another big fumble by Billy.

Jaden Rashada was represented by an agent before his national signing day. Rashada got Rusty Hardin to take this case. How likely is it that Rusty Hardin would have taken this case, on contingency, if there were no viable and provable claims? These defendants are likely not going to get out from under this without paying something and suffering reputational harm. Will it be court awarded damages, or a settlement? If anything, it’s likely the latter. I look forward to reading, or at least reading about, the responsive pleadings.

The game inside the game is overshadowing the game itself now. I’ll miss the classic days at UF with Lunkquist and it being about the sec grind games coming down to defense. Nothing was more exciting than those games being within a score late in the 4th standing on your feet the whole game losing your voice.

This is why we need collective bargaining and set price points. Starting QB at a Big 10 school? You get, say, 400 grand. Second-string OL at an ACC school? You get 50 grand. And eliminate these "collectives". If Big Jim's Trucks in Evanston wants to pay every starting Northwestern OL 100 grand and run an advertising campaign around the theme of "My trucks are as tough and reliable as these linemen," that's fine. If Carson Beck gets paid 10 grand to sign autographs for 4 hours, that's fine. If Miller Moss at USC gets a cut of the money from the jersey sales of his jersey, that's great. That's what NIL is FOR. But having these slimy "collectives" essentially buying players is crazy.

Fine with that. Money from signing autographs? Go for it! Money from jersey sales or video game appearances or making a speech to a company about how teamwork is important because it won you the national title last year and you're back to win another one this year? Absolutely! What I don't want is sleazy "collectives" paying millions of dollars for no actual work, just as a bribe to make sure they get a kid.

Rashada claims Napier never intended to pay him? C'mon, now. If you follow Florida, you know how highly people talk about Billy Napier's character. Boosters love him, players love him, administration, parents, fans, media, everyone loves Billy Napier. You hear things like, "He's so genuine, he is heartfelt, you can tell he really cares, he is such a great person, ect." Right? That's what we keep hearing about Napier. So, I just want to ask Rashada, "You're telling me _that_ guy, who everyone loves and says is genuine and honest, that guy colluded to dupe you out of money?" C'mon, now. You're talking about proving _intent._ That is hard enough on its own. But proving it about Napier, that he intended to do something like that? Yeah, good luck. Even if it is true; even if the intent was there to trick Rashada, there's _no way_ he's going to prove that! I think Josh is totally right. The confusion and fog of war got to some folks. If Napier promised Rashada $13m+, Napier truly thought he could get it because he couldn't see through the fog.

The issue is Rashada signed a contract NIL deal with John Ruiz, once a contract is signed no outside party can interfere with the execution of the contract it’s called tortious interference and is illegal and grounds for a lawsuit.

This is the best time for this story to come out. The general public does not care about an athlete not getting paid $13 million to play college football. The people that care, like us and HS recruits have time to pay attention right now. Secondly, this is the time when HS recruits make their OV’s to their prospective Universities. Florida does not want their HS recruits asking about this lawsuit!

Here's what happens next. A few teams with the wealthiest and most willing boosters (i.e. Phil Knight) buy the team they want leaving all the others unable to compete. No more wild games like the Kentucky upset of LSU in 2007. Boring, boring, boring so TV is pi$$ed that audience has drastically shrunk and tells the conferences no more lucrative TV contracts. Conferences rush to Congress who finally acts but not before chaos has ensued. Congress always waits too long to act.

If the players do start being paid by the universities and/or conferences the likelihood of schools suing student athletes who flee a commitment goes up. Rashada's lawsuit might backfire for the student athletes as well because those giving the NIL packages might sue fleeing college athletes

FYI, oral agreements are enforceable in court. But you hit the nail on the head, can you prove it. I'm thinking that their are probably text messages and emails to prove the agreement. If you do file a lawsuit you can expect a counterclaim.

I doubt Kirby gave the lawsuit “his blessing”. The Rashadas gave him a heads up and Kirby asked some questions and accepted it. Doubt he preferred it.

Saw this crap coming back in 2019/2020. Every one spent years trashing the NCAA about everything under the sun…and now all those same people are hoping the NCAA can swoop in and save the sport. NIL and the transfer portal need to stay but there needs to be control/over-site and standard rules in place to prevent this mess that is now CFB. Until there is control this mess we have been seeing the last three years will continue and probably get worse not better.

It is good to learn the NIL contracts can be attached to multi-year requirements. If so, the athletes should be held accountable. I would guess the Universities don't get involved, it would be the Collectives and agents, yes? If so, wouldn't it be the Collectives who sue both athletes & agents for breaking the contract, not the Universities?

A player’s agent is not going to be a party to an NIL contract. They don’t get sued for breach of contract.

There’s no way these nil deals don’t get to a place where they don’t get tied to actually staying time and actual game play. As a Florida fan, I would be okay if they move to settle outside of court. That can do more to help our brand than winning the lawsuit. I also wouldn’t recommend teams offering players money, 13mil, before they play a snap and get on campus to see how they impact the team…and their commitment to the whole process. Tell the guys you’ll get it to them along their seasons. But not beforehand. Also I’m not gonna say the guy isn’t talented. But, he has to establish yourself somewhere. He’s officially been at 3 schools already. You have to post at some point. And if you can ball all this stuff is irrelevant.

He really doesn’t evidence to prove much of anything. He needs enough evidence to show that laws MAY have been broken. Then he just needs to convince a jury the things he alleged happened more likely than not. You really don’t think they don’t have something that significantly backs up his case? The circumstantial evidence alone is bad for UF.

He should sue. He did right by not taking the word of the coach after a promise/guarantee was already broken. It affected his money and recruitment and he deserves compensation for essentially fruad

I doubt Kirby cares about this at all. But it is worth mentioning that he only beat Florida once while he was playing so Definitely no love for Florida. Florida had Spurrier and Meyer, the pendulum has swung, Georgia has Smart.

Marvin Harrison Jr. is being sued by Fanatics based on an NIL deal he signed with them while at Ohio State. Foolish people are thinking that NIL deals are going to benefit players specifically how players want to be paid or benefitted and there should never be any accountability taken by the players.

Wasn't Napier brought in to Florida to avoid headlines, elite recruiting & team discipline??? If I'm a Florida fan, I'd rather have Mullen than Napier. Everyone in CFB speak exceptionally high of his character but he just seems to be having the roughest go at it than ALL of the other coaches they fired (Muschamp, MacElwain, Mullen). All three of those coaches had a better start to their careers there @ Florida. What's MORE likely? Napier WILDY changes things around in year 3??? OR Things continue in the same trajectory of the last 2 years & they're sub .500 You can't do that at a program like Florida. It's not Kentucky or South Carolina. You're expected to be a top 8 program down there & it's NO WHERE close to that now.

been saying for a while I dont think it is fair to the college to give these kids an NIL deal for them just to walk away to the portal...IMO short of a complete rework of the system players should get 1 or the other... you can sign an NIL contract....OR you can portal jump....so if you sign an NIL contract you shouldn't be able to portal jump...

I'm guessing the 'blessing' was more along the lines of 'do what you gotta do, just be prepared to compete'. NIL as a system is broken. Not sure anyone with a greater than room temperature IQ would argue against that.

Nil is out of control and some of these teams are desperate to turn around their program. All it takes is an extremely desperate coach or program to way overpay for a QB and then the market is set and it screws over every college football program. Set a Max that can be paid and a minimum that can be paid so even the less important position at least gets something so nobody feels left out. That way with everyone getting something it doesn't cause jealousy in locker rooms. We really need limits set so all of the college football programs have a standard to go by before these amounts get even more out of control and it really destroys some of the college football programs we love.

No way ANY high school player is worth that much! This will turn the casual watcher off and will hurt viewership imho I’m sure not looking forward to college football after all of this it just reeks. No problem with kids getting paid but let them earn it first first maybe their junior and senior year they can make the bucks but earn it first

For a sport with so many rules how is it that college football became mired in a situation (NIL and Portal) with no over-arching rules and no effective governance? How? Money, that's how. As soon as we decided that a free college education (at a time when college education is becoming unaffordable for the non-athlete) with free room and board and with the other special advantages that college athletes enjoy (tutoring, mentoring, state of the art conditioning facilities, etc.) are insufficient reward for the college athlete, we started down the path of no return toward the NFL model and the end of amateur athletics.
