This is a free to be released no bail required... the only state ( IL) in the country that is starting this no bail system.

From what they said here, it was a tether for home confinement. Not even being able to leave for work. If he stays at home, he cant do the kind of stuff he is accused of, and if he leaves his home, he gets picked up and tossed back in jail. I believe he is a danger and should be locked up but Magistrate Fink's decision wasn't necessarily a bad one when everything is considered.

Judge Simpson is honestly the best there is. He's super highly intelligent, very street sharp, has a huge heart, knows BS when he hears it, and not the judge you think you're gonna get over on. He's extremely popular on KZfaq law channels for all those reasons He wins judge of the millennium! 🏆🏅

I love him too but did you see a few years back he got in trouble for dating his student/clerk who he tried getting her out of a DUI? The whole story is on KZfaq. I was quite shocked to see that from him. Thankfully for us, he was allowed to keep his job.

Home invasions are my worse nightmare, seriously. It's 3am your under the blankets sound asleep and incredibly vulnerable, what happens next is the stuff of nightmares. Happens almost daily in America and penalties should be among the harshest. Instant fan and subscriber

Seriously?! The defendant is charged with home invasions and sexual assault during one of the home invasions and the defense attorney is s asking for the defendant be allowed to go out and work which involves going INTO people's homes? Bruh 🤦‍♀️

To be totally fair to the attorney, their job is to make the best case they can for their client. When there isnt a case, they still have to try. That usually ends up with the attorney looking either incompetent or accepting of terrible behavior.

It’s easy to hate on defense attorneys for say, asking to let someone dangerous go, but the reality is they have to or they aren’t doing their job. Like you said, zealously advocate for your client and he did. But I also like that once the Judge indicated it wasn’t even close to happening he withdrew the request immediately. He toe’d the line of advocation and court respect quite well.

He could have been a good boy on the Bond just to eventually get his restrictions lessend... So, let him stay exactly in the same conditions.. I would have been surprised if the Judge put him in custody now. I would be interested into why the Judge allowed the initial bond as it seems likely that a person like that would not follow all the rules... If he does follow all bond requirements then the Judge was right... I would guess by sheer luck as the odds were against it. However, I do believe that a persons rights to a resonable bond that shall not be excessive is not followed when it comes to non violent criminals that have bail set where it is impossible for that person to ever come up with the amount of money.. If a person has a house and can put it up against his release.. this would lower flight risk.. but when you see a $500K cash bail for someone that is not violent but has no way to get $500K.. that is excessive bail.

So before the prosecutor even said what his crimes were, my first thought was "he's a house cleaner and on a tether. Did he get arrested for burglary? B3cause if not, NO WAY should he get to go back to that job. " And then she pops out "multiple home invasions." Edit: i paused it at "multiple home invasions" and hadn't gotten to the sexual assault yet... I had some laughing emojis that are now gone.

Thank you Simply Gracious Rose Maria! I feel as if I’m welcome to sit there with you and little Ezekiel who’s napping, to watch compelling court cases unfold. Teaching moments happen often, and I love when you pause to bring affirmation or clarification when unspecific laws are referenced. Also, I agree…Judge Simpson is a fave! His focus seems undistracted in trying to uncover as much of the whole truth as possible in relevant matters. The value and respect he shows for each individual is evident and so inspirational. I love how his well timed sense of humor can break the tension normally arising in court. Judge Simpson’s judgments seem to show fairly measured out portions of justice and mercy where each is called for and I believe it can inspire righteous behavior. Oh dear…Im opinionated and talk too much as usual, but I just wanted to thank you again for sharing. Be deeply blessed!❤

Always love when a defence attourney or a defendant makes a request for something, then the prosecutor brings up the heavy guns they had against the defendant, but were holding back until necessary. Defence attourney should already know it could be used, as they'd have the info from discovery, but take a risk, get smacked down hard.

What a humongous risk it was, releasing that man from custody. Thankfully he didn't reoffend, so, perhaps surprisingly, that risk worked out... But yeah, I totally agree with Simpson J.

Uh, I know defense attorneys are meant to zealously advocate for their clients, but Mr. Gatti is asking for the defendant to be allowed into other people's homes for work? When he invaded people's homes, hurt people, and burglarized them? In the great words of Judge Simpson "That's a no."

You should check out Judge Maraval in Michigan. He is amazing. His cllerk can be rude and sassy to him, but he tries to really work with defendants but also stands firm to his orders.

Magistrate Fink often pulls shit like that. She gives habitual and/or violent offenders, ridiculously low bonds, allows the defendants and witnesses etc. in her court to walk all over her and on multiple all but explicitly shit talked judge Simpson. She’d say things like “I would lower the bond if I could, but judge Simpson won’t let me.” She’s beyond problematic and it endangers the community and demeans and undermines judge Simpson I wish judge Simpson could/would have put him behind bars, but I’m glad he didn’t let the creep off house arrest

This guy needs to have more restrictions if at all possible and Judge Simpson needs to arrange a way to stay on this case.His lawyer better think seriously about what this guy is accused of.He only wants to get off of home confinement so that he can assault more people and burglarize some more homes.

Right call. Dude shouldn’t have got bond… but he did. And he did everything he was supposed to. At that point you can’t just lock him up absent him doing something. That said, the nature of his job and the nature of the charges means no way in hell is that going to be allowed. I’m also kinda shocked that nobody spent more time on the fact that he was technically asking to cross state lines, right? (Unless I misheard it was MI to OH)

If this is a bond issue we must remain cognesent that these are only accusations and he has yet to be convicted. He must be presumed innocent until proven beyond a reasonable doubt. As a lawyer myself I find it dangerous to adjudicate defendants guilty without full knowledge of the case and evidence that may or may not exonerate the defendant.

That would be a horrible system! The process is long & we’d have violent criminals racking up more victims in the mean time.

In Illinois, this person would be released without bail or tether... We have a great State... The law starts Jan 1 and it is nicknamed "THE PURGE"

I am not a fan of Magistrate Fink’s. I’ve seen too many of these videos where she is way too lenient on the accused. She acts like she wants to be their friend rather than protect the public.

Is Atty Gatti laying on a couch? Also I agree Judge Fink should have made it harder for him to get out, but at least the tether meant if he left his house he got thrown back in. Judge Simpson definetly was not impressed by the charges though, he kept a straight face, but you could tell he was not going to let the guy off easy in any respect.

I don’t blame the prosecutor keep his butt in prison when you break into someone’s house and then he sexually abusing the person he broke into he should never get off of house arrest he needs to stay at home his charges are horrific and horrible he’s not safe on the streets he might end up killing someone
