This analysis is and on itself biased. The reasonable apprehension of bias standard is subjective and not objective, therefore, the third person analogy is incorrect. The correct standard is you check whether the complaint’s bias allegation is reasonable.

@@ntsikeleloedwardvena82 besides that analyst need to neutral they must suggest that in their analysis who must do what....for example if they say IEC is well within their rights of taking someone matter on judicial review to the constitutional court whereas the law says an electoral court decision is final it cannot be appealed out....analyst should first read the law....and comment....take also an example on this case of Zuma application for concourt judges to recuse themselves....when they comment they must say Zuma stands a slim chance to succeed but they must first read the law and found out if concourt was within the legal framework when they sentence Zuma if they were not in terms of section 47 i stand to be corrected it says everyone under the constitution of this country must be given a fair chance in terms of the law....to have their matter argued before the court with all legal processes followed.....in a nutshell if analyst wish to put his point of view forward he must first read the law and comment because he might say the court was right bur only to find that the court itself errored

Zuma was sentenced for contempt of court- he refused to appear at the commission despite being ordered to do so. Secondly, a judge's recusal due to conflict has nothing to do with the fact that he/she may have ruled againt you. You do not get to demand a judge recuse themself because you as the complainant feels that the judge is biased against you- thats not how the law works. Otherwise anyone who has a judgement against them could simply demand the judge recuse themself. Goodness, the insanity of Zuma cultists...

A judge sits on thousands of cases in his / her lifetime. When the same criminal appear on different crimes before the judge, why must the judge recuse himself? No! The criminal must rehabilitate himself or get more severe punishment!

I can't tell you to read If you're so embedded in media propaganda cos that what it is. If you read the struggle of President JG Zuma, and obstacles he faced to deny him to move through the ranks of the ANC structures despite the constitution allowing him, and all the sabotage of his administration, and the pursuit of him after his term, should give you enough motivation to seek for the truth. But for now the focus is on the biasness of some Judges in constitutional court against him, n if you have some level of understanding of the law, you'll know he have reasonable grounds. Whether they accept it or not is neither here nor there.

Clearly the issues are different and the test is different, here it’s about the interpretation of Section 47(1)(e) and not about the appeal of his conviction or sentence… if it was about an appeal, his argument would hold water. The test to determine a correct interpretation of a section in the constitution is different to a test to determine an appeal hence perceived bias does not arise when the issue on the former is being dealt with. Very interesting because Justice Unterhalter was criticised for arguing during the Jsc interview that he doesn’t believe that you need to recuse yourself in a matter that you formed part of the bench as long as a different test is to be applied in that Court.

Adv. MPOFU is definitely a disgrace. He knows that decision by the Electoral Court was irrational as there is no ground of law to allow ZUMA to be a MP. Good analysis. Now the Concourt has to look at the Sect. 47 of Constitution's prohibition. The Electoral Court has no right to decide the sentence of Concourt for ZUMA's contempt of Court had no permission to appeal.

A disqualification under this paragraph ends five years after the sentence has been completed.

Ther is no urgency here since IEC is askin for clarity not appealing the judgement of the electoral court.. even if the ConCourt defines differently from the Electoral court...the IEC should first appeal the judgement to the supreme Court of appeal then to ConCourt. 😢. 😮 Remission implies reducing the period of the sentence without changing its character. The 15 months imprisonment remains Mr Zuma's sentence. Remission doesn't change that.

@cebova2873 OK. He was sentenced to 15 months imprisonment without an option of a fine. Meaning he was supposed to be in prison for 15 months, which, when calculated according to the rules of the Dept of Correctional Services, would still be less time. Now, let's go to remission: There, the character of his sentence doesn't change. It's 15 months imprisonment to be served. There came the State President or whoever has authority, and that person reduced the number of months he had to serve by allowing him to serve only three months and did so out of mercy and the authority s/he carries. He had to serve that 3 months without the 15 months having been changed at all. For instance, if you owe me R5000.00 and see that you have difficulty in paying it. I might decide on my own to ask you to pay back R2000.00, and I will release you. You pay it. That doesn't change the fact that you owe me R5000.o. But I have forgiven/ released you from paying the whole amount out of sympathy. You will never pay me the rest. I so wish this is clear.
