It came up during the second day of deliberations on Nov. 24, 2021.
Arbery was shot and killed on Feb. 23, 2020. Cellphone video leaked to the public shows two armed white men in a truck approaching the 25-year-old Black man as he runs down the road. One of the men, later identified as Travis McMichael, and Arbery struggle over McMichael's shotgun before Arbery is shot and collapses.
Travis McMichael, his father Gregory McMichael and William "Roddy" Bryan, who recorded the video, are all charged with murder in Arbery's death.

This is a quality Judge. He’s clear, concise and his attentiveness is evident for all to see. The way he observes the jury after watching the initial, first re-showing of the footage, is of a diligent watcher.

This Honourable Judge is one of the better Judges I ever saw to preside over a high profile murder case that's shrouded in controversy from all perspectives. So far he has done an impeccable job to remain impartial. Well done Sir and may you continue to Serve well.

The jurys decision was redemption for the city of Brunswick .....which many people thought may have been a microcosm of the racist mindset of these three morons .....but a jury that was 99 percent white proved there are good people in the community that prevented them from being stereotyped.

YES! That's my observation...there was a few seconds pause which exposed the will to make sure that he was dead. I can't imagine the sorrow of his parents listening to, and revisiting the execution of their child in that video. The most frightening is, these monsters will proclaim to be Evangelicals, and pro-lifers. 🤔✌

This judge, this empathetic human being showed the compassion, hurt, and pain that he felt after watching that young man gunned down. There are still decent people that exist in this world.

Yes, I can see his compassionate demeanor too. I feel he's done well by the family, courtroom and humanity. I appreciate his efforts, I watched another version of this taping from another coverage and they actually showed the video. It is horribly sad the way Mr Arbery was challenged, shot and murdered here... how he staggered and suffered to the ground mins before he died. 💔😥 REST IN PEACE AHMAUD and Justice to the Family 💞

This judge is the perfect example of what every judge should be like. Is fair to everyone, even when they’re spewing complete BS, doesn’t let the BS get out of control, keeps order in the court, and has the proceedings moving along.

Me too! I was all in the television like “Don’t let them overstep the boundaries in your courtroom!”, “Tell-‘em Judge!”! It was one point where the Judge got irritated at the Defense over questioning, and he (the Judge) basically had to let him (the defense) know whom was boss in the courtroom! It put a big smile on my face! One reason why I am pushing toward becoming a Prosecutor! I want to work for a Judge like this one right here! He stayed fair, and wouldn’t let anything go off of the books when it came to the law!

Keep in mind the defendants never said they threatened aa w the gun, They were simply out that doesn't mean a threat. That same disgusting attorney kevin gough actually objected to what the jury wanted to go over and the judge told him “mr gough I’m going to let the jury have what it’s requesting”. He was never trapped in any corner. He turned around, went back, and charged them in anger. There is no other logical reason for him to turn around and go jogging right back to them.

This shouldn't be a hard case! GUILTY! My husband use to Jog all the time. On Sundays we would drive to New house construction sites. We have gone inside of homes that were under construction just to see what new models looked like! We never had a problem period!

They're angling for bullshit self defense. He shot that boy as soon as he turned towards him. He didn't get a chance to grab the gun before the trigger was pulled. This is all BS to begin with because had Travis not closed the distance when Ahmaud went around the car to avoid him, Ahmaud would have never made the decision to fight for his life. Travis provoked that confrontation by going to the front of the truck after Ahmaud went around it.

No way Travis shot without the gun being hit away by Aubrey, if he had shot him square in the chest without him holding the barrel that blast would have pushed him back. Aubrey had every right to defend himself, grab the gun, push it away so he did not get killed, he was in fear for his life and he has reason to be. McMichaels were the aggressors, period.

There’s a video of police encountering Ahmaud in a park at the age of 25. He clearly is much older than the photo with the hat. It's not a hard decision. The old, repealed citizens' arrest law was clear as to what situations it could be applied in and Arbery being chased down by them on nothing but their suspicions based purely on their own racist beliefs do not meet the requirements for a citizens' arrest. Arbery had the right to engage in self defense, which he attempted to do by trying to take the shotgun away from Travis McMichaels. McMichaels engaged in the act of premeditated murder with malice based on the race of his victim at that point.

I totally agree..the "attack" by Aubrey was the act of fight or flight!..the man was fighting for his life..he didn't want to get shot in the back as he ran past..thats why he went for the gun. I'm sure he was tired after being chased by pick up trucks for 5 or 10 mins after jogging. You can clearly see that the house was just a pit stop while he caught his breath on the jog. I mean really though he goes out to commit a burglary with no tools or no bag to put your stolen shit in?🤷..what was he gonna do , run home with a chop saw or tackle box on his shoulders.???...And to talk about the dead man's toe nails...just pathetic..smh

Indeed. Dunikowski stated the law, defense objected saying she was misstating. When Judge gave jury instructions on citizens arrest, he reiterated Dunikowski's representation of the law EXACTLY as she did.

How can you say that? He didn't; allow the jury to hear that Arbery was on felony probation, about his severe mental problems or that he wasn't jogging he was running as fast as he could to get away from them because he didn't want to go to back to jail.

Before the jury is brought in, the Judge looked exhausted: he removed his glasses, rubbed his eyes for that tiny moment. As the jurors enter, his face changes: the once tired, turned-down mouth becomes a pleasant smile along with a twinkle in his eye. That's excellence, that's WISDOM. The jurors feel welcomed and perhaps their tired spirits lifted seeing his Honor's looking at them so warmly.

It’s a lot different when you’re a juror on a criminal case. It’s not as simple as it seems watching it from your phone/tv. There’s so many laws that come into play and you want to be sure you’re going by law and not my persuasion or emotion.

@@jamesmiller3098 Guessing someone didn't hear the Audio of the 3 shots, all MULTIPLE seconds apart which disproves self defense or any reaching of a gun. When you fear for your life, shots go quick.. It dont take 10 seconds to Send 3 rounds down range UNLESS you are deliberately, calculating your shots which ofc also means.. He had time to spread those shots, so he was not in danger.. At all. So Either he killed him in cold, calculated blood or they shot him twice more as he lay dead.

Even though I'm relieved that Kyle Rittenhouse got acquitted of the charges I will speak on this trial that's made headlines. The Ahmaud Arbery case in Georgia. Everybody has seen the video. I'm a man that relies solely on facts of a situation, whether it's right or wrong. In this case I believe that the two men that chased Ahmaud down and shot him deserve to be found guilty and should face life in prison. They had no right to take lawful actions in their own hands and chase this guy down with a shotgun only because they had a "suspicion" he burglarized a house that was still in construction. Regardless of his criminal history he did not deserve to be shot down in the streets like he was. They did not witness ANY crime take place. If I was in Ahmaud's shoes and had two random dudes chase me down and get out with me violently with a shotgun I would immediately fear that they are trying to rob or kill me. I believe Ahmaud fought the guy to try and save his own life and unfortunately he was shot down in the street. And it's a shame how the initial police department handled this case before the State of Georgia took over the investigation. I saw the body cam footage and Ahmaud was still alive bleeding in the road and not one person, the guy who shot him, the father or police try to revive him when they arrived on scene. Travis, the shooter, wasn't even properly detained while their investigation was going on after he admitted he shot somebody. As a police officer, whether you think they're right or wrong, if anybody kills somebody you immediately detain them until the investigation is over with. If the video hadn't went viral these guys would still be walking freely. Hopefully these guys will face the consequences and learn they should have just called the police and let them do their job and not take actions in their own hands! If they actually witnessed him commit a violent felony it would be a different story and I believe the prosecution of this case is gonna bring that to the jury.

They initiated contact with the young man, they had the guns chasing him, they wasn't the police and he actually tried to avoid them. They are responsible for his death. I hope that the only problem is trying to figure out which count of murder to come back with.

Judge Walmsley has been one of the most passionate judges he's what all judges should be, even when he's upset he did have to excuse himself from the courtroom after repmend the defense attorneys. They have to make sure they don't screw this up. It's why instructions are soo lengthy and specific. They don't want to make a mistake that could lead to a conviction being overturned on appeal. Very specific requirements must be met before you can convict somebody of violating a law especially when you get into the different degrees of such a significant felony like murder. It's not just a simple vote of guilty/not guilty. It's not worth rushing it because of the potential risk it can have on the verdict down the road.

@@isiscoran9045 Yeah. In retrospect, I'm guessing they were considering whether to charge Greg McMichael with Felony Homicide. The jury request seemed to focus on Greg, and only 3 of the jurors were observed to be paying the most attention to the video and the 9-1-1 call.

I'll share the video because I am able to get away with this crime since the cops do not understand the laws they are paid to uphold or because we know them but devalue human life that is not white or we have personal relationship with them or a combination of the the three. PD gets wiff the video sparked outrage an now are required to do their job. Now, the so proud video that captured the events that we've recorded is used against us. The jury has already seen the video but now we don't want them to see it again. I think I got the Coles notes correct regarding the video. I hope they got a BOGO deal for these lawyers. Also as the PD sits quietly trying to not squeeze a much as a fart out to not bring attention to the level of corruption they commit. And everyone associated to this case should be fired and civilly sued for trying to cover this murder up.

The judge is trying his very best to restrain his visceral reaction to the murder. Second viewing of the killing we should all pay attention to his eyes... the involuntary twitches and where he has decided to fix his gaze!

As we are judged by our equals and every process must be as public as can be. Transparancy is so needed for an inpartial trial. Certainly in one with this impact.

Gregory McMichael's 911 call. *Operator* "911, what's the address of your emergency?" *G. McMichael* "Ugh, I'm out here at Satilla Shores, there's a black male running down the street..." This says a lot about G.M's mindset, all 3 defendants pretty much incriminated themselves.

Its only concerning if you think that everyone is racist and is fine with black people getting killed. I'm "white" and I'm not fine with it. Even though I think they didnt want to kill him I think this was felony murder because they had no right to citizens arrest him.

God bless this judge and his family. A humble and patience human being. He is patiently waiting to speak his mind. No one reasons for delay. But the jury have to do their job.

The judge clearly was bothered by watching the video himself. Glad that there are still some decent people in this world. Just hearing the sound of the shotgun going off just makes my heart hurt! This was so devastating to listen too! Also I just wanted to add when the camera was on the dad he showed no signs of remorse for his and his sons actions!

They are ensuring that the conviction doesn't have a clear path to being overturned on appeal. This is not just a simple "guilty" or "not guilty" decision. They don't want to screw this up and I don't blame them because neither would I. That's why jury instructions are discussed at length and under very specific confines.

He should. He started the whole chain of events. It all began with him. What's worse is he was former law enforcement. He should have known better. I think they should look at any case he was involved in when he was employed.

It's interesting to speculate why they asked to see these particular pieces of evidence, but there's already one thing we know almost for sure - it won't be Not Guilty verdicts across the board.

I’m not sure what the verdict will be but I appreciate this resolve and thoughtfulness of this Judge. I don’t know what’s in his heart but he’s displayed an impartial temperament throughout the trial.
