The plaintiff says he sold a sewing machine to the defendant, who complained to eBay and got a refund. He says she has his machine and won’t return it, so he’s suing for his money back. The defendant says she’s still waiting for the plaintiff to send her a shipping label. She denies any wrongdoing.

the sad part is that he offered a 100 dollar return before the repair and in the end the repair ended up being almost $100 if she just took the money from the beginning this would have been resolved months ago

@@splendid4453 Possibly but if she cared enough to go to the trouble of getting it repaired, she really wanted that machine, so him sending a label may not have resulted in her shipping the machine back to him. It really appears she wanted her cake and to eat it too!

I don’t think the plaintifs mom knew how foul her son was in his correspondence with the defendant. 😳 I howled when she said she didn’t want to get back on camera 😂😂😂 & I completely understand why the defendant allowed this to go to court.. the plaintif was extremely disrespectful in his responses. I would have done the same thing out of principle. Especially since eBay ruled in her favor 🤷🏾‍♀️ Sellers… the customer ISN’T always right, however customer service goes a long way.

Ehhh Ebay almost *always* rules in the favor of the buyer, that doesn't mean she was right. They want to keep people happy who spend money on ebay because there are always more sellers. It sucks as a seller because it means people can scam easily.

It's so cute how they still r crazy about each other.. Like u can c it in her eyes that she thinks he is cute and the same for him.. It's just the way they talk and look at each other u can just tell they enjoy being around each other... And good for them.. I would love to wake up in the morning and think well I achieved what I wanted in my work life and I am happy financially and I raised my kids and got them moving in the right direction so now I can enjoy this part of my life comfortably with the one person on the planet I want to spend my life with.. She's lucky!!

I actually don't understand why he had to pay for the repair. He posted the error message but didn't say that, that would necessarily fix it. She bought it knowing something was wrong. Normally person-to-person sales are considered as-is unless the seller states otherwise.

Yeah but not on platforms like eBay and Amazon where the buyer can request a refund. She was within her right to request a refund but he offered to offset the repair to not lose out on the sale. On a p2p platform like offer up or next door, she would’ve been out of luck.

He couldn't supply proof that he included that in the listing. That's why she asked for a screenshot because the listing as it was at that time on Ebay didn't show that info.

You know what ? Doing the right thing, shouldn't be beholden on someone else, irrospective of their churlishness. You bought an item, you sorted out the problem, right thing to do was to deduct the repair costs, and pay for it. Hope they both learnt a lesson.

I don’t think neither one was trying to scam. I think the plaintiff was young and hot headed with his momma in his ear. The older woman knew she had the advantage and she pretty much was teaching him a lesson, I think. In a way she should have took the refund from the beginning but I understand why she didn’t. I believe he better stick with selling things that he knows works and he actually has knowledge about.

Never, ever sell or buy on eBay. My daughter was cheated so badly on a phone years ago. She was in the military at the time, and was unable to go after the creep that knew the phone was obviously damaged. On the other hand, I agree with the young man getting most of his money back; there are a lot of shady buyers out there, too. Not sure why this woman thought she should basically get a free embroidery machine. That’s dishonest.

Ebay doesn't always rule in the buyer's favor. I sold a used phone in good condition which was packed to prevent damage. The buyer sent me a picture of a phone that looked like it was run over buy a car and dragged down the street. He offered to keep it if I gave him $30 off. I said NO WAY. He filed a complaint and lost because I had records of his offering to keep the mangled phone and asked Ebay who would want this mangled phone? He was a scammer.

Shipping is paid for based on the individual seller's policy. If his policy was buyer pay return shipping, she would have to pay the return shipping. This is so silly. She should have read through the seller's return policy prior to purchasing from him. When items are used it's the buyer's job to do their own due diligence. That's the risk you take buying used items.

@@riversongtiny2025 The way you're talking about risk makes no sense because it has nothing with the item being used. 🤣 Regardless of the seller's return policy, if they sell you a broken item, eBay's terms of service says you can return it. Otherwise, anyone call make a business out of selling broken items without recourse. Which is why eBay said he had to pay for the return shipping. A seller's Return Policy only applies to cases of a customer changing their mind or just simply wanting to return the item for whatever reason. Just because an item is used, doesn't mean you take the risk of it being broken. If it's broken, the buyer must say that. They can't sell broken items and then tell customers too bad, you bought it used.

I think they try to pretend like they don't each other to ask questions. It weird cause they ask have you ever done this but than they talk about a time that happen.

Its awkward because they are asking the question of a third party. My husband and I have been married 35+ years, not many things we do not know about each other, but if he were to read me a question from you for example, I am actually addressing you in my answer not him, he's just the one asking the question on your behalf, she knew he worked at the factory, it is a bit of an awkward set up.

Maybe I'm wrong but the case was decided morally and not legally. They both agreed to abide by the rules of eBay and she did just that. She followed protocol and followed up with eBay and he was stubborn and still didn't abide by the rules. The add didn't say SOLD AS IS! ... The young man was lucky to be in front of a judge who sides with morals in her ruling.

Yes you’re wrong. You cannot agree to pay for an item and when something goes wrong get your money AND the item. If her money was returned the item should have been returned. If you buy a used item it’s “as is” regardless of whether the ad says it or not. Good

@@BriannaTshelle not sure about that... Example Wayfair. If items are damaged or whatever the case may be. They say keep the item or donate the material and still refund. The young man should have followed protocol. His lack of knowledge and or stubbornness should have cost him the 700 and he just learned a hard lesson.

@@montee8817 I don't agree with I'm getting court costs as he should have had that as a lesson that he should read the fine print, but used items are sold as-is. She should have returned what was ruled.

@@domiasmoth maybe bc this is a family court show. Normal judges in position especially if the plaintiff is a older adult they would have told them to read the fine print next time. I really think it's because he's 18 he won...it's not like she's scamming she followed up with him and eBay and both knew what needed to happen. The judge should have told him to follow the rules it should been. buyer and seller beware lol

As far as ebay is concerned it's done and handled. The court's decide their own legal aspects. If you can prove damage/loss, the court can't force ebay to make a decision but they can make their own decision. The reality is the policy doesn't protect you although it sounds like that, it only protects ebay. Look at Amazon reviews and you'll see the same thing, they address the issue with a quick fix and then they are done, whether the issue is actually resolved or not.

I don’t think she’s a thief by refusing to accept his $100 before knowing the repair cost. Once you accept a settlement you can’t sue again even if it cost thousands to repair. He was rude and unprofessional and need to learn customer service. Of course like JM said she should’ve returned it minus the repair cost.

Why are so many people letting the plaintiff off the hook for his excuse of "I never said that getting that part would make it work". His posting heavily implied it. He's the scammer here even if we assume he didn't do it intentionally. And I can't with his smug answer when Doug asked if he learned anything.

Cause people like her play games !!! That’s why he got nasty. I understand him. People always tryna get over. Sellers deal with it all the time, but when the potential scamming buyer has a grab onto something, that really ticks you off. Like holding your belongings and getting a full refund back for example

Seller was the real scammer, selling crap that doesn’t work and not declaring it as broken or parts only. Alternatively he should have invested time and money into it. We have all been scammed and it’s by people like him.
