The plaintiff and her business partner run an IT business where they set up Internet and security software for companies. They argue the defendant stopped paying the fees, so they’re suing for the balance owed. The defendant says he paid the plaintiffs in full and stopped the subscription, but they charged him anyway. He doesn’t think he owes them anything.

@@HOTTATATTAT I've heard her say that so many times I finally tried it. I don't know what kind of toilet paper she uses but it's impossible on Scott's. Besides that, if you can't afford a pencil and paper , how the hell can you afford toilet paper. I 👎every time she says that.

$700 bucks a month for support for a few computers at a construction company. You could hire a kid to do set you up for $50. Their data isn't government secrets. These people are laughing at companies that are computer illiterate. I bet they have a lot of older people as clients.

No, we have a large company and pay more than this for our monthly computer support. They are available to us day and night. They also send someone out anytime if we are having issues with any of our computers or our phone system.

I feel JM had this one wrong. What she has ruled on is the premise that if we don't hear from you we will renew the contract. They said please let us know if you want to continue. If they had not heard from him then somebody should have called and asked him to verify if he wanted to continue. Now they continued the contract anyway without hearing from him at all. So they enforced an automatic renewal. I don't know if those are legal. Sometimes she really gets it wrong and disappoints me.

Judge Milian annoyed me with this one. As someone whose been an IT person as well as working in different sizes of corporations for 20 years, it’s common to sell a small company who doesn’t have an internal IT person a package of support so they have someone to reach out to for computer and networking issues. There is far more to it than “turning it on and off” . This is common practice in the industry and it’s how small IT companies survive. And I can attest that those small IT shops are not “scams”

What Judge Milian was trying to acknowledge is the "do it yourself" approach. And she's not wrong. If small individuals could do it themselves, why can't other small businesses? Granted, small businesses may not want to take up so much responsibility, therefore, they go out and hire an IT company. I don't see how she was wrong. One may say, "Oh, she's trying to target the small IT companies and put them out of business." That's a fair claim. But the fact of her statement is true. I mean $700 a month for support subscription is pricy for a small company and not a company with a lot of employees, and if a company finds another IT that charges less, any business owner would try to jump and save money during today's timeperiod.

Absolutely correct, Brandon! I worked for a small business who hired a company for IT support. It might be months that we did not need to contact them. But when we needed them their service was critical, particularly if it was right before a project deadline or a conference. Some of the things they did I could do but didn’t always have the time for it. Other things I didn’t have the knowledge to do. Also, our IT support was available by email or phone anytime we needed them and, if we needed them to come to the business, they made it a priority and usually came the same day we called. Judge doesn’t seem to have much knowledge of what IT companies do or their value.

@@ryanb6093 I get it in theory . But it’s an approach that isn’t feasible for a company that reaches a certain size . Her thinking was a tad simplistic concerning this. Most small business owners who get to the size of having a small network with more than 5 devices will not have time for a do it yourself approach . It just came of like she was implying they were attempting to scam him or something

If she would shut up and listen maybe she would get a clear view of what’s going on. Our company has IT support and it’s invaluable… there’s more to IT than plugging or unplugging a connection.

Exactly! Anyone who had ever worked at a call center, bank or corporate building should absolutely understand. There are companies who’s computers and phones can’t go down even for a moment. That’s what makes the service so important.

Exactly. I love Judge Milian but she really had no idea what she was talking about here. Once a business reaches a certain size, even a tiny lapse in server uptime can mean an enormous loss of revenue. It's not at all comparable to being someone at home whose internet might go out for an hour so you have to find some other way to entertain yourself.

I was thinking the exact same thing. I work with businesses (private healthcare) and they all have onsite IT or pay a hefty rate each month for IT support. They would lose hundreds of thousands of dollars if their if backups aren't performed, their network goes does, or is hacked.

We pay thousands per month for ours so that's really not unheard of. Its not just making sure the internet works. Theres a lot to maintaining a network. Although, I do think they should provided more than 1 hour of support.

You would if your computer issue prevents you from being able to work.... I don't even work in IT but it's clear that a lot of people don't realize what goes into making sure a business runs smoothly. Even in a restaurant if your network goes down you cannot accept credit card payments which is 95% of how people pay what do you expect to do then N just say oh screw it screw it I'll give all these people free food instead of paying $700 a month to make sure my Internet works🤦🏻‍♀️

Its for a business so there are more security measures that a business will need. For personal service, 700 is a lot but for a business that's about right. Did he need these advance features probably not. This includes office 365 so since that's a subscription per user, that can get very expensive quickly

JM $700 is cheap because to pay an IT person to be on staff is $700 & ⬆️ a week. Now if she would shut up n let him explain she would learn something

Not saying that the Defendant was correct but that phrasing "Please let us know if you want to continue" was a horrible way to verify services. I would say if you want to cancel we need it in writing otherwise your contract will be terminated on such and such date.

You obviously don't run a business that requires your system to be maintained...a small business that runs 5-10k worth of revenue per week could be destroyed if their systems failed for even a couple days...$700 a month is cheap considering how much a business could lose in just a week...these people pay upwards of 25-to 50k a year for the software they use to keep these business online...

I feel like the email was not worded the best, but what they were essentially saying is "You have an outstanding bill and if you do not pay it, THEN we would cancel our service" He paid the bill which made it seem like he wanted to continue with the service. He should not have paid. As the other person said, the payment was communication whether he realised it or not.

The payment was NOT communication to continue services. He still owed and had to pay that money whether he wanted to continue services or not. It clearly states "Please let us know if you would like to continue with our service, otherwise on October 31st we will remove all other support software: monitoring, backups, virus/malware/ransomware protection." Did he contact them to let them know he'd like to continue services? No. He did not. So "otherwise" they should have shut off the service. Just as stated in the letter. It would be different if he paid ahead of time. That would be saying he would like to continue services.

You know, the letter/email is definitely ambiguous @ 10:01 ~, and if you read the four bulleted points in context, especially w/ Bullet #3 being so explicit about the conditions under which the service would be discontinued on October 16, it would be reasonable to conclude that paying for July and August would constitute renewal of service into October and beyond. Although it makes very little business sense, that would be the conclusion I’d draw, just by reading those four bulleted points.

Plaintiff at the end made it VERY clear that the defendant will no doubt be "cancelled" on that "very small island" where everyone knows everyone else. Threatening? Yeah, I'd say so.

24 hour monitoring is basically doing nothing . Most IT support is absolute bs . Its like buying a warranty for a year for a brand new car .

I guess it depends on how reliable you need your server uptime to be. This seems like a small business with a small potential clientele based on the word of the plaintiff, so I would imagine that very rare lapses in uptime are not going to affect business in a tangible way and that 24 hour monitoring is useless, as you say.

I think it was a fair verdict, the email probably wasn't worded properly, but its essentially saying that if he did not pay the outstanding bill, THEN they would cancel the service, but he paid the bill so it's obvious they took it as him wanting to continue with the service.

I love Judge Milian but I think she grilled the IT company a little too hard about what they do and why they do it. I can do my hair myself but do I go see a hairdresser every once in a while? It would be weird for people to tell me I'm crazy to pay someone to do my hair when I can do it myself but I'm paying for the CONVENIENCE of not having to do it myself.

His relationship was terminated after 3 months of non-payment and he knows it’s. Their letter was clear about their lack of payment for the past 3 month and in addition, they specifically asked for a phone call IF they wanted to continue service. They are new to the Island; I hope no one uses their service since they cannot pay their bills. Regardless of whether their IT service was useless. It’s always useless when it’s going smooth but the moment something happens, they want the service. But wait…you’re 3 months past due, Sir. 🤣🤣

Best question and answer session! Did those who confess to committing multiple instances of fraud on people's court but have not been punished get reported? Like the guy from the other day who rented the owners house to multiple people and took multiple deposits even though he was being evicted? Or does the owner have to press charges and the people he took money from?

I’m a computer person, and I can tell you the plaintiffs are experts at saying bs in the nonservice they are supposedly providing. It’s like a person who wants to hire a security guard ; and then gets billed for on call bs , because the security guard could perhaps be called to work. The plaintiffs are eloquent in speech in making it look like they are doing something, when actually not doing anything. The judge naively fell for that bs , and awarded them, though she was smart to inquire what actually they did, and got a bs response from 2 partners. The way to avoid computer security problems is to verify and make sure emails, msgs, and inquiries are actually from whom they state. Also need strong laws to punish these deceptionists .

At the end of the day, he knew what he was supposed to pay each month and he decided to go with them. When he found that they were not doing anything then all he had to do was cancel. He did not so now he has to pay for not giving them notice.

It’s for a business and it’s worth it. My job uses a virtual IT service and I call them sometimes multiple times a week. It comes in handy if your job has a lot of computers.

Everybody thinks that IT support is simple, it is not, when it all goes smoothly, it's because IT are on the little problems all the time and when there is a big problem they are there to sort it out. If IT was so simple, no company would ever need to hire a whole IT department. Servers and backup servers and making sure no malware is infecting the system is hard work. Antivirus software is software created AFTER a virus has been detected, and new viruses are being created all the time, so unless you keep your antivirus software up to date, you will not be detecting the recent malware, and this company perpetually watches over all your data to make sure it is secure from hackers and backed up successfully etc..

JM wrong again. Lawyers get their clients out of contracts all the time over a misused coma. Same with some laws. Just look at our second amendment and all the politicians arguing "what it really means" based on that one coma!

Hasn't anybody heard of insurance? That's exactly what this is, IE. Paying a fee to ensure that if something goes wrong your covered. In business it's important to be more thorough with your arrangements and confirm if an arrangement is altered.

In this case the judge has no clue what it takes to keep a business system running smoothly....she really thinks these programs are $15...these services are thousands of dollars per year...these are not buy once and done services...

WHY is the Judge questioning the services provided by the Plaintiffs?! This is not the issue- the issue is non-payment on a renewal service. STOP trying to screw the Plaintiffs business over!

I feel like if he didn't pay July and August, then they would have cancelled the service. But by him paying it, it seems like he still wanted the service.

People bagging the IT Company because of their charges. How do you know what services he is getting done, they mentioned Office which is more expensive for businesses than individuals, ransomware software, backup monitoring and recovery (which probably includes backing up locally as well as to their servers or a data centre) and possibly a lot more than was mentioned. His new company for all we know is possibly just giving him a Home Office pack and a free Virus program. Maybe the construction company should look at employing their own IT Person, I would just hope he is better at paying his workers than his bills.

If you know where Jesus is, tell him that he can come over any time for a visit and I'll listen to what he has to say. If you can't find him, then how do you expect me or anyone else to do so? 8 understand how he interpreted the email, if you don't call, then you no longer want the services and we will end our services on 10/31. Yes, he could of called and confirned, he DIDN'T want their services any longer yet paid them what was outstanding. $700+ is alir I'd $$$ a month for what they do, yet like insurance, you pay through the nose, but it's only good when you have a problem. I also think the company could call him and say, we didn't hear from you, did you want to continue or not? They were both passive aggressive towards one another IMO.

Sitting here at my IT desk watching this bs she's pulling. IT support/security are like cops. You wouldn't say "hey you're not arresting people, why am i paying for your services?" That's why its PREVENTATIVE Judge!! People who don't understand IT when things are working: "WHAT AM I PAYING YOU FOR?"" People who don't understand IT when things are NOT working "WHAT AM I PAYING YOU FOR??" Gross.

I don't know, I see both sides. Maybe the email could have been worded better, but what it was essentially saying is, if you don't pay your outstanding bill, THEN we would cancel our services. But by him paying, it seems like he still wanted the service. So maybe he should not have paid.
