The regulation provides the rule, but for additional guidance, see AIM 6−4−1: Two-way Radio Communications Failure. That section notes, "Whether two-way communications failure constitutes an emergency depends on the circumstances, and in any event, it is a determination made by the pilot. 14 CFR Section 91.3(b) authorizes a pilot to deviate from any rule in Subparts A and B to the extent required to meet an emergency." If you have a communications failure, it's important to assess what caused the problem. Is it a simple failure of a radio? A fault in the wiring behind the panel that could lead to a more serious issue? Perhaps you didn't notice an alternator failure and you're losing electrical power. You also need to think about where you are and where your clearance, per the rules, is taking you, such as over mountains or into crowded Class B airspace.
