7. DISMISSED AT THE END OF STATE”S CASE. Prosecution failed to put evidence in front of the jury that there was a lawful curfew in place (appears to be an oversight by prosecution) Defense moved to dismiss, judge agreed. Fail to Comply with Order of Local Government - Emergency Management Activity (citation, carries no penalty) - everyone present was breaking the 7pm curfew issued by the sheriff.
Possible Sentence: Max: Life in Prison Without Parole (WI does not have the DP)
JURY CHOSEN IN ONE DAY. 20 jurors have been selected in WI v. Kyle Rittenhouse. 9 men and 11 women. (8 are alternates)
Rittenhouse shot and killed Joseph Rosenbaum, 26, and Anthony Huber, 26, and injured Gaige Grosskreutz, 27. Prosecutors say that Rittenhouse, then 17 and from Illinois, was a vigilante looking for a fight. He, like other right-wingers, went to Kenosha, Wisconsin ostensibly to protect property. This happened as protests over police shooting local man Jacob Blake turned violent. Rittenhouse’s attorneys assert he was acting in self-defense. This case became a cause célèbre among conservatives.
Prosecutors have struggled in court, failing to introduce evidence of prior aggressive behavior. This included evidence showing him attacking a woman who was in an altercation with his sister. The other is that he was closely linked to the violent, far-right Proud Boys organization.
Kenosha County Judge Bruce Schroeder said an appellate court would reverse him if he allowed these in trial. The evidence was too prejudicial, he said. He left it up in the air whether he would allow footage showing someone identified as Rittenhouse discussing a Black man exiting a CVS pharmacy. Rittenhouse believed the man was shoplifting.

He was trying to get a mistrial to try him again because he saw his star witness got demolished on the stand. That case blew up for binger so he was literally trying to get a mistrial to try him again. If it was up to binger Kyle would be in prison for life.

Defense seems to learn what the word objection means and use it. When the prosecutor was lying shaking his head no isn't going to cut it. Object, point out the prosecutor is lying. Impeach the prosecutor's credibility as much as possible.

I'm beginning to be a big supporter of courtroom video proceedings being made public. The educational value for law students, and active atorneys seems to be well worth it, and I would think that it could help in cases of mistrial and appeal.

Prosecutors have been operating under the understanding that the people don’t have rights and it’s rare to get a judge to slap them down. But this judge has yet to slap them down by throwing the whole case out the window. Prosecutors know how to game the system and take the warning from the judge but still inserted the ideas he pull off during the cross in this case. This kid shoulda sat on the side lines and let it play out without having to take the standing. Sadly, when you are young, you wanna be truthful and for coming, it’s youths greatests down fall. Wanting to be honest and truthful. He seems like a good kid but easily misguided and maybe a bit slow at the time. He life will never be the same.

His star witness admitted to being the aggressor and his case was shot from there. He Knew this and was trying to get the mistrial so he could try the case again without that witness. The Judge recognized this and refused to allow it to happen.

If ANYONE IS CONFUSED I got you. Propensity Evidence is when you show a person's character or actions in past events is the real reason they did the current crime they are in court for. That basically means they are saying to the court "hey he's lying that he shot people in self defense. He really did it because he's itching to shoot someone, because if you look at what he did in this situation before, that's what he's been dying to do" The judge is saying "hey man i don't think this makes sense and that situation isn't similar enough to this current case to say that ... so you can't bring that argument in court to a jury because it's invalid " The guy brought it to court anyway without asking permission for it

The prosecutors point is a dead end. He says Kyle didn't have a gun and wished he could shoot shoplifters. Well, Kyle DID have a gun this time, and DIDN'T shot anyone committing property crimes. He only shot people trying to aggressively assault him. So this whole argument of his is a dead end. There's a difference between saying and doing. This prosecutor was trying to question the defendant on the basis of what the prosecutor BELIEVES about the defendant's ideology and belief system -- even when he was silent. The bottom line was that he was using his questions on the defendant's silence as a means to influence the jury toward a negative opinion of the defendant over his right of silences. This is so unbelievably ridiculous for any individual with a license to practice law to do that I'm surprised that he wasn't thrown out of the courtroom and disbarred over this.

Without commenting on guilt or innocence, I am encouraged that the Judge in this matter is protecting the concept of innocent until proven guilty. It should be the State's burden and it should be hard. That is the whole idea behind our justice system.

Kyle as a minor was the kind of citizen we should all aspire to be and as a non American myself I thought he embodied the American spirit in a really profound way, he was providing a public service in the way of firefighting (and I believe he had a medical kit to provide first aid) and carried on him the same means of protection that the police had in the exact same situation. He was set upon by a mob for trying to help the community and defended himself with the only means he had available. Your bill of rights is a beautiful thing, the way your citizens have a more direct say in their governance is brilliant and it’s only the people trying to subvert those things that make your country look bad. You yanks should be bloody proud of your traditions because they empower the everyman in a way nowhere else on earth does

Yeah. I don't really know if what he did was illegal assault or self defense, it's so confusing. But this prosecutor SUCKED, and that's probably one of the reasons why Kyle got acquitted. This whole thing looks like a complete political rabbit hole, but I'm just gonna take the not guilty and roll with it and assume he's not guilty.

The prosecutor has made so many mistakes, they would love a mistrial so they could have a do-over. Notice the defense said 'with predjudice' meaning they cannot retry him on the same offences.

It would have been a massive win politically and would've allowed every corrupt court to make similar rulings in cases of obvious self-defense. They still do, but this would have made it entirely acceptable and given it popular support. The eventual outcome would be such a significant rise in criminality and destitution that every corrupt governmental body in the country would be able to bleed their taxpayers completely dry and then flee when the lights finally stopped working South Africa style. It's still happening, just significantly slower because they haven't gained the full go ahead to ruin everything yet. Imagine a United States where everywhere looks and feels like the downtown streets of LA but with more power shortages and probably no water at all and you've got the near future.
