So what I got out of all this is that I need an "experienced" agent to help me purchase a property but I need a lawyer to help me understand the contract that I will be required to sign with the agent. This again is why Real Estate has become a train wreck.

The buyers broker agreement is pretty straightforward. I really don’t believe it’ll take a lawyer for you to figure it out.

Robyn please don’t take this personal but any buyer is crazy to sign any contract with a buyers agent. The wealth of information on the internet makes it so easy to determine fair price as well as finding inventory. Dealing directly with listing agents will be the wave of the future.

@@lauralampe1664 Me, too! I know a whole lot of stuff and know how to do a whole lot of stuff (I SHOULD, at my age!)...but I'm no Real Estate Expert. SELLING is another story as it's a way easier/less complicated process that may be doable by a Seller, but Buying, I need a agent and don't mind paying for a GOOD one. Only problem how I'm going to pay the fee. ;-) Two other things I don't do myself: Cutting my own hair and doing my own dental work! However, FIRST, finding a good agent may be like pulling teeth -- not an easy (and painless?) experience I'd guess. And that's not even considering how high his/her fee will be. -- BR

Not to be intentionally insulting, but real estate agents have been the most overpaid bunch of people in history. People with high school diplomas and a six week real estate course making six figures is absurd. And it is horribly unfair to people that have trained hard for essential work like teaching. Anyone who thinks a real estate agent ought to be making more, much less considerably more, than a teacher really needs medication. And it has gone on unchecked for far too long.

You are not insulting; you are just sharing your opinion. I respectfully disagree and think Hollywood and Professional athletes are grossly overpaid. What makes our country great is that someone with an HS Diploma can make six figures if they work hard. Profession is a choice. Some people are not motivated by money and select a profession because they love what they do. Thanks again for watching and sharing

@@Robyncavallaro I agree athletes and Hollywood stars are overpaid. But then I also don’t consider those real jobs so didn’t even include them in the grand scheme of things. They are another solar system situation for sure.

What do you think about 19 yo KZfaqrs/IG posters making 6 figures or a21 yo on Only Fans making $200K…many with only a HS diploma or less…?

@@DWilliam1 a bit off track aren’t we? Realtors have made excessive money off all of us for decades now, KZfaqr is making excessive money are far fewer and number and they aren’t taking money directly from my pocket. Are they taking money directly from yours?

Robyn, great information. I am an agent in California. These changes were initiated by attorneys in Missouri. The requirements will be implemented nationally in August. if a buyer doesn't sign, an agent cannot show property. It is a requirement, not a choice for a buyer's agent. The buyer's broker agreement is straightforward and Robyn explains it well. Thanks, Robyn!!

I am preparing to sell my condo up north and my commission to the buyer's agent = $0. A comp to my unit just sold in the building and the buyer's agent commission was 0.25%. Seller's agent received 3%. Final selling price was competitive for the market there. The buyer's agent commission is no longer the seller's responsibility. Seller's agent commission and buyer's agent commission are two now two completely unrelated transaction items.

The point of the lawsuit was to stop double dipping. If listing agents start charging interested buyers to look at at their listing and write up your contract, most likely there will be another lawsuit.

That was not the point of the lawsuit. It was to avoid agents from steering clients to homes based on commission and to make it clear to sellers that the "fee" is negotiable.

@@Robyncavallaro A listing agent has responsibilities in order to close a deal. If he or she charges the seller a commission as well as the buyer, I can easily see another lawsuit waiting to happen. You see it differently. For the sake of agents, I hope your viewpoint is correct. Wishing you the best of luck and continued success.

In Florida we can have both sides of the transaction as a "transaction agent". Moving forward a listing agent will charge a fee to the buyer to handle that side too in the event the seller is not offering compensation. In some states this is called Dual Agency and not allowed.

​@@RobyncavallaroForcing a fee onto a buyer to simply look at a home IMO is unethical. It is much different than a buyer voluntarily seeking out an agent to help navigate and negotiate during a home purchase.

I consider myself pretty savvy in financial matters, I am currently using Robyn to buy a house in TV, there are some differences in the buying procedures and I felt it important to have someone who had my back , so I am not sure of the impact that this may have in the future, but I think there will probably be some equilibrium with lower prices since lower commission for seller also, I highly recommend Robyn, she was extremely helpful to me.

Everyone needs to take a chill pill. This is the way it should be done in the first place. If I pay $2,000 up front for Services from a Broker and we end up closing a deal whereby the Broker was to receive a $25,000 Commission on the deal, then at Closing.....The Final Closing Statement would show a NET AMOUNT OWED to the Broker of $23,000. The payment up front is called Legal 'Consideration' and solidifies the RE Contract! If you do NOT find a deal, you paid $2,000 for services rendered! It is a Retainment Fee. PERIOD.

@@bjs1130 so many people don’t see it that way as our time is free, but it’s not free. We spend money to become a realtor. Broker fees, license fees, MLS fees, car wear and tear gas insurance so it cost a lot of money to be a realtor. They think that we have no expenses. Our time is worthless. You need an expert on your side when you want to purchase a home.

With all due respect, sellers to cannot include commissions in the sale price. Home prices are determined by the market.

@@michaellong2791 the sellers anticipate they are going to have to pay a commission/concession and they figure that into what they want for the home. I do a sellers net sheet so they understand how much they were going to net based on several different scenarios. So unfortunately, you are incorrect.

Hi Robyn, just for absolute clarity on a point you mentioned, if I hired you as my buyers realtor, and we don’t find a home I want to buy, do I still owe you a fee? Also, if I find a home through another broker (like TV ALS broker (I.e. new home), would I still owe you a fee? Thanks again.

If you enter into an agreement with me you would not owe me a fee if you purchase a home with Property of The Villages. Working with another MLS Realtor would violate the contract. Call me if you have additional questions.

that is such a loaded question. You are correct you do not need a MLS REALTOR® if you’re purchasing a new home. But there’s a reason some some of those homes are a lot less expensive than the homes and I would love to have a discussion with you at your convenience.

Realtors will negotiate their fee with the buyer. Remember the buyer will only pay if the SELLER does not offer compensation. Thanks for watching

If the Listing Agreement says 7% for commission, to be split equally with buyer’s agent, how does this particular scenario work, when I’ve signed a Buyer’s Agent Agreement that says I’ll pay 3% to the agent I’m working with? Does my Buyer’s Agent now receive both the 3.5% from the Seller AND the agreed 3% that I’m legally required to pay her? Has this come up yet in any of your closed transactions?

Bottom line you did not earn 6% to sell my house. No realtor did. 600K and you think just because you had my listing that you should get 36K to sell it even if you didn't ever show the place. Yea that happens. Flat fee that you and a seller come up with. It ain't gonna be 36K.

A $500k home with a customary 3% buyer's broker fee would cost the consumer $15k out of pocket. I'm a builder and have never seen a single RE agent worthy of that compensation. The industry has a real reputation issue that is only going to get worse with these campaigns. People do not NEED a buyer's broker. 💯 Optional

That is their choice and always has been. Who will write up the offer on a pre-owned home if they do not use an Realtor? The listing agent will do it for a fee too. Nothing is free.

I found the above instructions on how to write an offer in Florida. Looks like it takes about 5 minutes to fill out You and your colleagues think this is brain surgery. This is why RE agents get a bad name

You could, but remember, the agent works for the seller, not the buyer. They don’t have your best interest at heart. If they did, you could simply ask them “what’s the lowest your client will accept?” Guaranteed they will not tell you that number.

I’m almost 60 and have bought and sold multiple homes and the seller is always responsibly for paying the fees. I think I’ll keep doing my business in South Carolina. Florida is nuts.

Any form PA will have a combination of choices to select from and blank spaces to fill in, in addition to an area where additional conditions can be stated. It’s my understanding that this process is a negotiation between Sellers and Buyers, and that No one is “Responsible “ for any component of the terms during the negotiation; the terms that are malleable are all negotiable-it’s the misinformed or under-informed clients who just go along with whatever their Agent tells them is “how it’s always been done “. Over time, the Norm has become that Sellers pay the entire RE commission to their listing Broker, who then shares that, usually Equally, with the Buyer’s Broker. These Brokers then share their halves (or whatever agreed-upon split) with their agents who procured the sale. In Florida and Indiana, and likely in all other states, no commission can be Set in stone; that would be considered price fixing and is illegal, and most every term of any deal is negotiable between Seller and Buyer, including who pays whatever % of any commissions. 6% has Long-been the Usual commission in Indiana. However, I wonder if regular (non investor type) Sellers even know to ask if that listing commission can be negotiated. It Can. Doing your due diligence in any transaction is paramount. Understand what you’re agreeing to before you sign any legally binding contract. Ask questions, not to be a jerk or argumentative, but to glean a clear understanding. Want to make your offer stand out to the Sellers, if you’re one of several buyers vying for a property? Offer to pay a % of the contracted commission, or offer to pay the Seller’s property taxes or the title insurance. Get creative with the end goal of being the buyer who gets to the closing table.
