There was a lot of confusion generated when a journalist inside the courtroom made certain reports about how the statements of Adam Waldman would be treated. I attempt to explain how the reports are wrong and what was likely actually said in regards to the handling of Waldman's Statements.

AH is suing JD for defamation and loss of income because Adam Waldman made the allegations of her lying about the abuse on Twitter. They are trying to say Adam W said these things as a representative of JD therefore it was at JD's request. AH has not been able to prove that yet because they got nothing when they took Adam W's deposition. So now they are going to call JD to the stand and try to get him to say something that will support he told Adam W to make those statements on Twitter. They have 8 hours left to get their proof

In a nutshell. Amazon absorbs the Waltman and to be a spokesperson. The principal became the actions so long as implied authority expressively, To a failure. For example. Properly served. And that is very very critical …. Hope that helps.

To be fair I don't think she meant it as in "it means Amber Heard wins", just as "it's a good thing for Heard's case". I mean damn, even if they would decide that these are Depp's statements, Depp knew these statements to be true, so it's hard to find defamation here

Got it....that's what I figured. As a former juror on a month long case, I have a slight idea what some of them might be thinking now...and we DON'T think like lawyers and we do not interpret like a lawyer...I predict it will come down who they thought was lying...end of story. I think JD has a chance. I think Amber is screwed.

I want what's fair because if J.Depp was thrown away from any opportunity in the Pirates and Fantastic Beasts, I believe it is only fair that Ms.Heard is also removed from Aquaman. However, wishing that someone would lose their jobs, is kinda bad. However, it is her own action that caused this. So I believe it is fair, but I'm conflicted. I just want what's fair. So if J.Depp was removed, she should too. Equality and all that. After that, they can start their life, again. Moving on with what was said and published. I'm sure J.Depp can rise back from this, as there was a rumor that Robert Downey Jr. had reached out to J.Depp but as for A.Heard, I believe a lot of her role was reduced, but I want her to be completely removed. However, in the future movies, she might be able to go in. Just not Aquaman. Warner Brother DCs, do your part of the equation and equality, will you?

So the TLDR is the Court TV reporter knew what she was talking about, but she didn't say it correctly. I.e. she reported inaccurately, just as Nick said.

Don't know if she knew what she was talking about. I know that none of what she knew could be condensed in a Tweet with proper accuracy. She could only simplify it to the public in the way she did. To say it was "a win for Heard" is an oxymoron; it's not anything, more like dumbed down language for the cba TLDR pizza 'n' popcorn crowd who can only understand things in win/lose sporting termiology. The Waldman statements were always part of her case. It's whether a legal principle/agent foundation has been established for it to be part of these legal proceedings.

@@Helloitsme328 her time in the final cut of AM was reduced to 10 mins because of the lack of chemistry. AM2 is already in the can. The release date was Christmas 2022 and they pushed it to Spring 2023. AH and her whatevers can spin it anyway she wants. My guess is they are working on a new love interest for Aquaman 3

I don’t understand why everyone is giving her so much credit because she’s cute and dresses nice? I honestly don’t think that she’s been objective as everyone is believing. I’ve heard her reports a couple of times from Court TV and I wasn’t impressed at all. I think everyone has been involved on their own stuff that they really haven’t been paying attention to what she’s been doing outside of court. She reported some crazy crap and I was like, you were there in court and you’re still putting in your own narrative into it? This is why I listen to you and a few of the other people. I like people saying it like it is with the facts and evidence presented. I don’t want you going easy on either side because of gender. However, it’s clear Amber is a freakin liar and you guys aren’t afraid calling her out on her shIt.

I feel the same way. I got that feeling the day after AH fired her PR team and the reporter was sitting by the new PR guy, schmoozing. All reporting changed at that point. Even on different pro JD chats.🤔 Imo. I hate it when I can tell bias. We just want the facts, hurtful and all...

I don’t believe or understand how Adam Waldmans statements have been defamatory in any event, irrespective of if he was acting on instruction. He reported to the LAPD his concerns of perjury, which he would have only done because he believed perjury had been committed, nothing he said was knowingly to be untrue. The hashtags haven’t been proven to be attributed to his statement and the spike in negative hashtags toward AH occur 3 days prior to his statement, they coincide with the audio tapes, the public drawing their own conclusions.

The problem for AH is that she hasn't put anything on record to prove that Waldman made the statements for Depp. But if Waldman made the statements for Depp, then it doesn't matter what Waldman thought about their truthfulness - what matters is if Depp thought they were true, and Depp would know. As for the statements he made to the police, those are usually privileged against a defamation claim, and Heard isn't suing for those.

@@OS-yg9fr No, I guess I wasn't clear, I don't know what this Waldmann did that it's so necessary to drag him, Depp and possibly a reporter onto the stand. Amber Heard thinks it's defamatory and so her counter-claim, but I don't know what it is specifically that Waldmann did.

She needs to be picked on though. She's a journalist AND an attorney in Arkansas & Tennessee (according to her Twitter bio). For both reasons she should be better, or at least held to a higher standard, when making comments in her role as a journalist on Twitter. She could have used more of the thread option or couched her words in more uncertain terms (appears, might, etc). She could have been more accurate in her terms ("all the shit you just said" -Captain Hillard USMC, Independence Day). She was neither and she should be called out on her lack of accuracy and told to do better. We need all of our so called journalists to be better.

She could clarify / correct her reporting (it ultimately has no effect on the case). I just think she honestly misunderstood and likely doesn't have much court experience (many lawyers never go to court, or go when the firm considers them a senior / seasoned. She appears to be more a lawyer journalist than a practicing attorney.)

If he was going to hit her... That audio with the disgusting laughter, where, by the way he is clearly drinking wine (she wants to sip from his glass) and probably high on weed... He would have reacted, instead of just awkwardly trying to stay his ground (where she apparently had come chasing him to this house from the one he had left her at)... I'm so disgusted. Oh, and just a note he always calls her "baby", she is the one that calls him "babe". She clearly wrote that bullshit on that f-ing mirror.

At this stage in the trial we've seen so much bizarre stuff it wouldn't surprise me if the closing statement was "Sorry Your Honor, we've just noticed a typo in our filing; we meant to accuse Amber Heard of defacation...." Nice vid btw, it's not clear to me, but it's a hell of a lot clearer. XD

Mhmm, tbh theres always suspicion of favortism for AH when people say "its a win for Amber" kind of thing when that same person doesnt know legalities fully, also people tend to jump the gun on stuff now a days as well. I suppose it's the same as saying that AH's PR guy sitting next to Ms Painter and whispering in her ear in clear view of the camera has nothing to do with her tweeting the way she did on behalf of AH to try to change the social media narrative to favor AH as she fails hard in court. Is AH responsible for any defaming, misleading or inaccurate statements her PR guy is feeding Court TV's representative. Or is he acting on his own even though this is the very job he's paid to do.

The first analogy of the Amazon driver making Amazon liable is correct only on the precept that the driver was acting on behalf of Amazon at the time. If the driver used an Amazon van outside their instruction then the driver accepts sole responsibility.

Question for anyone that can or wants to answer. If JD is called back to the stand and questioned about his attorney and objections are continuously called for attorney/client privilege that could mislead the jurors to think he is hiding something. Would or should the jurors be told JD is protected by law and that shouldn’t be negatively looked upon? Maybe jury instructions? Just asking for a friend. Yup me, I am that friend, 😝. Damn it, I wanna know.

Thank you for explaining this. I think the judge has been very fair throughout this case and she has the patience of Jove. I think AH's case is weak because of lack of evidence. The thing that confuses me is why Court TV were in the courtroom on Friday when the public and jury were excluded. I am a Brit and our courts are different.

He can't say that though, without Depp waiving the privilege, and if Depp waives the privilege they can ask him about everything he and Depp talked about. That would not be a good thing.

@@neverlydarlin6315 going after Adam would be kind of Futile because at this point it would probably be too hard to prove that he is the primary source of it and the cause of her damages. Specially when his defense could point to the fact that most of her woes actually stem from this trial and thus end up protected as being part of a matter of public interest involving a public figure.

Rekieta was proven wrong because the Judge agreed that the jury can construe that the relationship between Depp and the lawyer is a principal and agent relationship.

Yes she has to prove that the statements form AW are false and were done on JDs behalf. I dont see that happening. And with the call of JD to the stand on Monday that could turn into dismissing the claim after she rests. And she will atleast 1 hour or more of her reamining and already low time. If they would have let that just sink they prpbably had 5 to 6 hours more time. But as AH wants it they have to go for that

That means AH's teams will have to recall Johnny Depp and question him on this. Otherwise, there's no link. So the rumors that AH will recall JD could be true. But this would eat up their entire 8 hours. They have nothing on counterclaim if they don't go for this. And it's likely all directed by AH. But they have so many other issues like mentioned in this video. The judge will have to find excuses on why to let the counterclaim proceed. It'll look like the biggest dodge ever.

Basically AH's team is screwed because of poor clock management. It's funny, since I'm an American football watcher and the parallels are unreal that essentially we're watching something like a spectator sport. AH's team spent a lot of time bringing up video depositions that either did nothing or made things WORSE for them, and now with that tomfoolery they only have that 8 hours to figure things out, while JD's team has 18. Their clock advantage means JD's team has the luxury of basically forcing AH's team to burn time and to bring in witnesses that cannot be crossed against.

@@Keirnoth I know right? Our local high school football had a dang good team. The coach controlled the clock. Won a lot of games that way. There are things that we know because we get to read about and see it that the jury may be clueless too. How many of them men jurors know color corrector goes on before foundation and a bruise kit or wheel is actually theater make up to create bruises that is applied on top. I am completely over this bimbo and hope the jury comes to the right decision.

I watched this last night when you were live, again just now, and watched Emily D Baker explain it to. I now understand it. And my conclusion is that Waldman and Depp won’t reveal the agent/client relationship. In other words, I don’t think Heard’s team will be able to prove it!

If i was in the Jury and you were explaining this, and having seen the evidence, I would definitely think that the Principal (regardless of his instruction to Waltman) thought at the time that what he was saying was true, that he was innocent and the accusations were based on a hoax...If they agree that he is telling the truth and she is lying... So as a layperson to me it all comes down to who I believe. If she had kept it simple I might have had my doubts (being a super fan of Depp's), but seeing the outrageous, vicious things she is saying on the stand, as well as how she has powered her career and image off of those accusations (Un Embassador and all those things, how many interviews and actions she has reitirated herself over and over, after the op.-ed, the fact she retwitted!!!!) I understand all the "nuances" of your wonderful explanation, but my opinion at the end of the day, that would be my conclusion.

So basically, Waldman could’ve been speaking on Depp’s behalf, and thus any statement Waldman makes is considered to be a statement Johnny Depp made him make. Adam Waldman doesn’t need to know if the statements Johnny is making him say are true or false, because they are not his statements, they’re Johnny’s, so if Johnny knows he’s lying, he’s responsible. Johnny has to have told Waldman to say these things for it to count, otherwise these are Waldman’s statements and Johnny can’t be held responsible.
