How it will proceed: the appeal will be denied (they rarely reverse themselves) and the Supreme Court will deny. End of the story. The whole appeals process should take like three to four years.

About the only case of which I have read the appellate ruling, where the appeals court readily overturned a verdict was one where during the trial not even the tiniest piece of evidence was introduced that the jury could find a key element of the crime. This was a case where if I remember correctly specific knowledge of the exact nature of the contraband (narcotics) in a locked briefcase was a necessary element in “willingly & knowingly.” The evidence certainly proved beyond a reasonable doubt the accused knew or should have known contraband was involved. But as I recall knowledge that it was narcotics with the corresponding prison times (as opposed to counterfeit baseball trading cards, forged checks) was never introduced.

Yes the market recovered for FTX. But for customers facing a large unexpected bill or, say, had planned to pay a dependent’s college tuition lack of access is devastating. $2000 next year is not helpful when one needs $1000 tomorrow. CZ is probably doing all possible to mitigate a sentence. With no mandatory minimum the judge can depart downwards below the guideline minimum based upon the facts of the case. Acceptance of responsibility is one factor. I suppose victim impact statements could be a factor - perhaps “a major inconvenience” versus “devastating life altering effects on my family and me” in the hypothetical about FTX above. Deterring future conduct is another factor in sentencing. In CZ’s case it could work in reverse. For financial crimes where some of the harm can be mitigated by timely restitution such making good is desired. CZ is facing time in prison, years of supervised release, bars against engaging in commerce in the USA and, as a Canadian & UAE national, a bar against admissibility into the USA (not that it matters …). Of course, CZ might be “allowed” to stay for a number of years though not by choice.

The issue of justice seems to be of little significance in US Federal law enforcement. Sam will end up being treated very differently from his co-conspirators. CZ is being prosecuted for KYC and equally bogus changes, when, as you indicated, the worst thing he did was posting that he was taking his money out of FTX.
