Lawyer for Jordan Neely's family reacts to manslaughter charge against Daniel Penny

Daniel Penny, who was seen on video placing Jordan Neely in a fatal chokehold on a New York City subway car, surrendered to police and was charged with second degree manslaughter. A lawyer for Neely's family said he had hoped for a higher charge against Penny. Greg Donaldson, an associate professor at John Jay College of Criminal Justice, joins CBS News to discuss the case.

You're being very extreme. He was right in helping but his tactics and reasoning was wrong. Jordan never attacked anyone. The Daniel dude just used very unreasonable force.

Now that Neely is deceased the family gets a lawyer....but is anyone asking WHERE WAS THE FAMILY WHEN THEIR FAMILY MEMBER NEEDED HELP??? Nobody gave a damn then, did anyone try to get Neely help? It was absolutely clear and obvious that Neely was a danger to others and himself. But now that there's the opportunity for an eventual civil lawsuit (ie. MONEY to be made) then here comes the family crying about how their family member was taken from them, etc etc.....but did any of them take him into their home? Did they feed and clothe him? Did they try to get him some medical help? Where I come from, and NO I am not wealthy, quite the opposite, we do everything within our power to help family, or friends for that matter, and that includes getting law enforcement and mental health professionals involved if that person is a danger to others and/or themselves. ESPECIALLY if that's the case, because if you don't get involved when you're supposed to get involved, this is just one of a number of inevitable and dire results. Stop blaming others that are forced to defend themselves and YOU take responsibility for the tragic outcome. And don't say there are no resources for those of US who are low income, because I'm here to tell you that's an outright lie. If you ask, seek, persevere, you WILL get help. Nothing in life is easy, you have to actually put in the work. You have to CARE, TAKE RESPONSIBILITY and STOP BLAMING everyone else for your condition.

He aged out of foster care and was homeless. Where was this family then? They are hoping for a handout, but did nothing to help him while he was alive. They failed him and so did NYC!

Jordan Neely had over 40 previous arrests. He was on the top fifty police list for problem homeless people. He was a threat to himself and others. Yet, he was still roaming the subways and assaulting passengers. Daniel Penny just raised over $800,000 in one day for his legal defense. The problem is not Daniel Penny. The problem is Adam Bragg. Why was Neely still on the street? The law states that a person who is a threat to public safety can be institutionalized against his will. Bragg has to go.

Don't blame the Hero Marine! Now, when people are in need of assistance, some honest people will walk away from those needing help if attacked. People with a good heart cannot risk becoming a Good Samaritan in a F____ked up Liberal, Communist, Marxist City like what our NYC has become. People will rightfully think twice before getting involved and assisting people that can't defend themselves...since they have TOO much to lose by getting involved. Neely was schizophrenic and a loose cannon with a rap sheet of over 40 arrests...some were VERY Violent and he should not have been allowed to roam the subway and the streets with drug addiction and mental illness. The fault for Neely's demise lies at the feet of the NYS Governor for not re-opening Long-Term State Psychiatric Institutions for the Criminally Insane. If Neely had been Locked Down, Medicated, and under the care of a qualified psychiatric staff...he would be where he belongs and alive today. Neely was an Accident waiting to happen...like a stray dog with rabbis in a schoolyard, he would eventually be put down.

All the people that homeless attacked, including the child and grandmother, should be in court testifying on the behalf of this man! And the family, of the homeless man are a disgrace, now they show they care. Where were you when he was hungry? Needed a bed to sleep? A doctor for his mental health? This marine is innocent.

Now Neely's family is speaking out about his death. I wish they would speak out when Neely was alive, homeless, hungry and begging to people in the Subway and on the street. If they would try to resolve Neely's issue when he was alive and put him in rehabilitation, Neely could still breathing in this beautiful world. But the family was QUITE and NOT outspoken like NOW. Probably there is a possibility of financial benefit from Neely's death. That's why so many Neely's LOVED ONES are showing up right now. I will request any financial settlement takes place in future regarding this matter, the NYC should take necessary steps to establish a Foundation under Neely's name which may help to improve the lives of unfortunate homeless people just like Neely. If the money goes to so called NOW's LOVED ONES, if will definitely be misused by them.

As sad as this tragedy, i ride public trans often and often am a victim( not physically) of drunken, profane, loud, intrusive andcthreatening people and it gets very very and you feel trapped and angry. old😭. The victim was a habitue of the subway and nothingng was done, officially to help him ot remove him from these behaviors that he was known to do. A chokehold was nit the right response but i understand the anger you feel being forced to endure threatening behavior while trying to mind your own business. I saw a guy leave his phone on a ledge on the bus ladt week and said" you left your phone". He then subjected me to a dtream of insults and profanity ehile walking back to pick up his phone. Sick of these bullies, because thats what they are 👿👿😈

There was literally two other people holding down his hands and feet. He also put Jordan in the recovery position and he was still breathing after he let go. Passengers thanked him too…. He didn’t just sit there and squeeze the life out of him. This man took three people to hold him down. But the two black dudes didn’t get charged

Probably not, but the guy he killed had 40 previous arrests and many of them were assault. Bet you didn’t know three people held Jordan down but they only want to charge the white guy….. they don’t even tell you he was breathing when the emt showed up. This veteran is probably a really good guy who wants to protect innocent. Jordan liked to hurt innocent people, as shown by his record.

Actually either charges way more than enough considering that he was defending every person on that train that cannot defend themselves that he was arrested 42 other times all the arrests were for violent crimes one was for a seven-year-old girls attempted kidnapping and I really doubt it was going to be for ransom. And you have several people stating that before the mentally Disturbed person who's going to start his attack of as many people as he could to try and get whatever he was said he felt he deserved which we money, rape or whatever else he thought he was entitled to heard him screaming this is it I don't care if I get arrested or killed I'm going to get what I want it wasn't just one person or one white person that hurted it was black people on the train Hispanic people on the train and white people on the train

Calling 911 is a great idea. That had already been done. Contacting the conductor is a great idea, so that transit will meet the train in the next station. On a local train line like the F train, that next station is approximately 5 minutes away. Moving to an adjoining subway car is a great idea, and notice that some video shows an almost empty subway car, so most of Penny's fellow passengers had already taken that approach. So who was Penny defending? Please remember that yelling and assault are not the same thing. If he had allowed professionals handle this situation, this could have gone better for everyone. I would not feel comfortable riding a subway with a guy like Penny. I suspect that most of the people defending Penny don't know what a subway is and do not live in NYC. I don't feel comfortable with people who feel like it's their job to jump someone from behind and apply a chokehold, when moving to another car and calling 911 is what actually works.

I don't understand why people are treating him like he's some low life criminal, the bum he put in a chokehold was, and yet they are acting like he was a saint, like he was minding his own business politely asking people for food. That never happened though but these psychopaths want you to think that. That bum threatened to hurt people and he would have if Daniel didn't intervene. He's a hero and should get a medal. That bum got what he deserved. The world is a better place without him.

Agreed! More needs to be done to help the homeless and mentally ill in this country. Sometimes, things happen and it should cause us to look at the deeper issues in our society. "Abdication" is spot on, imo. Great, thoughtful and compassionate comments made here by Donaldson!!! Bravo, Sir!!! 🙏

The only reason I agree with the charges is because of the law, if you charge too high and lose, you don't get a second bite of the apple, so although to some the charges aren't high enough, you give yourselves a better chance at a conviction.

Well the video shows he put him in the recovery position after he calmed down and he was still breathing and people were thanking him…. He didn’t just choke him till he died

The DA got the charges right. How tragic were these set of circumstances. It was Mr. Neely who provoked, instigated those physical defensive actions against him. It was not, however, Daniel Perry's right to cut off his airflow, to constrict his breathing pathways...you cannot choke a man to death for acting bizarre. Now, a jury of his peers must decide his fate.

This mutt was an accident waiting to happen! Neely had no respect for human life and should have been put away in a Psychiatric institution. The Political, Judicial, and worthless Soros "bought and paid for" Marxist/Communist DAs of NYC failed Neely. It would have been more fitting if one of our Violent Brothers of Color had expedited dispatching this worthless menace to society, before the Marine encountered this degenerate and was unfortunately placed in this situation.

He was a criminal who assaulted multiple people along the years. Being less fortunate does not justify any crime. The DA is responsible for this much crime, instead of pushing certain agendas, he could have spent his time fixing problems for his own people but he's not. If anything, Daniel did a favor to the DA by taking one criminal more from the streets
