Darrell Brooks, the man accused (and now convicted) of driving his vehicle through a crowded parade in Waukesha, Wisconsin, went to trial a few weeks ago after being allowed to dismiss his attorneys and represent himself. What followed was one of the most explosive trials I have ever witnessed. Confusion, ignorance, arrogance and hostility ran rampant as Darrell Brooks kept throwing fits of rage. But what does his body language tell us? Join Spidey from @The Behavioral Arts and I as we look at some of our favorite moments from this disastrous trial!

I think his constantly raised eyebrows are a modified version of request for approval, which I’d call demand for approval. He raises his eyebrows and holds direct, aggressive eye contact, basically saying, “either nod or state your agreement with what I’m saying. This uncomfortable situation isn’t going to end until you do.” It’s dominant, aggressive behavior I’ve seen from domestic abusers.

Yes, my ex husband would do this, and so many other examples of aggressive body language displayed in that courtroom! The incident when he slammed his fist on the table and aggressively stared down the judge was highly triggering because it was *exactly* the type of behavior my ex would exhibit when attempting to intimidate me into compliance (slamming fist on table, punching walls close to my face, etc )

There was a truck driver in Colorado who actually had a mechanical error and his brakes stopped working. The poor man panicked, didn't think about the emergency exit ramps and drove down the highway avoiding cars while trying to regain control. There was tremendous damage, loss of life, and he was ultimately arrested. When the man came to trial, he was a wreck, and his lawyers said he was having night terrors over the blood on his hands. The poor man hates himself and is living under constant guilt over what truly was only partly his fault. This man, Darrel Brooks, has none of those hallmarks, and in fact many of the opposite. Good riddance to bad trash. *Update it was Colorado not Canada, and the prosecutors celebrated netting him a 110 year sentence. After much protesting, the sentence was commuted to 10 years.

There may be a reasonable application of concurrent sentences, but it seems to be being abused and applied WAY too much. There shouldn’t be two-for-one murders… especially with mandatory sentences for violent crimes.

Here’s my take on his “two sides to every story”. Based on his history of DV, It’s the concept that “I hit you because you did something to make me hit you.” So in his mind, it’s not his fault it’s Erika and her friends fault because they picked a fight with him. They made him do it and if they had not fought with him, none of this would have happened. So it’s their fault, not his. Crazy, I know, but that’s how they think.

She gave him countless opportunities to stop being disruptive, she reminded him before he decided to self represent that he’s going to be treated like an attorney and expected him to follow proper court procedures in terms of submitting things into evidence and filing motions, she gave him the necessary law books so that he can reference something yet I only saw him read a Bible. I think Rob was really close to getting it towards the end. In my experience with narcissists it's not so much that they don't recognize what they did was wrong, it's that they think they're always the less guilty party in all circumstances. Like they expect the situation to end with you both sitting in the back of a cop car and looking over at you to say "well look what you got us both into now." Darrell knows that the killing of all those people was a horrific event but in his mind the person everyone should be angry at is Erika because she drove him to do it. I want to be clear that's his thinking not mine but that's also what he projects onto other people. He thinks that is also the way a normal rational person would view the situation. He's not culpable for his actions because she made him mad. If you've ever known a narcissist one thing they love to do is bring arguments and conflicts into the public sphere because they know that regular people have an aversion to displaying their private affairs to other people. They see that shame as an admission by the other party that they're correct, which I suspect was another reason he was so giddy to get her on the stand. It was his chance to get control back. Both over her and the situation. To browbeat and abuse her so he, in his mind, could show everyone who the real culprit was and convince people that he was the least guilty party.

We all knew that he was guilty as sin, and would be convicted, but there was always a very REAL FEAR, that he would somehow get off on a technicality. Justice has been served. I literally cried when the verdict came in. Tears for the families who will never be the same again, for the physical and mental pain that those children and all of those people will endure for the remainder of their days. Totally with you. I live in the UK and work full time but had to watch this trial and yes, it was painful. I have never had any homicidal thoughts prior to this trial but boy did I wish this had been a death penalty case. He drove over people, accelerated over their bodies and other bodies were flung in the air. This was like the Mr Mercedes attack in the novel by Stephen King. He had minutes to just brake, stop and admit fault. But he has been a slippery, manipulative piece of shit and the families of the deceased will never truly know why they lost their loved ones. I think the nail in the coffin was when he said his conscience was clear because it showed he had ZERO remorse for his actions. This monster felt JUSTIFIED killing and injuring people because he was in a rage tantrum. I hope he gets shanked in prison.

I agree with you completely. I think the jury has the hardest job in determining the guilt of the person on trial. I thought for a little while that the prosecution was too bold in only charging 1st degree murder, because how can you prove intent? I was afraid the jury would see 1st degree as too much and not be able to convict, but they saw what we saw. They didn't have to see his disrespect to the judge and all of the interactions we did in order to know he didn't value the victims' lives. All he spoke about, all he cared about, was himself. My heart breaks for all of the families and people impacted by Brooks careless and selfish acts. There are young people who will deal with the debilitating effects of their injuries for the rest of their lives and Brooks could care less. The only good thing that comes of this is that no one will second guess Brooks deserving his punishment.

He knows from observation that most people are concerned about doing things which will leave them with an unquiet conscience. He knows that many people would find it hard to convict a criminal who they could empathize with to some extent (maybe stealing food because they were starving, or had a momentary madness after being provoked beyond endurance, etc). He doesn't realize at all that most people wouldn't want on their consciences setting free a ruthless evil-doer who would undoubtedly terrorize more innocent people given the opportunity.

Sociopaths avoid taking responsibility for their actions. Instead, they blame others for negative outcomes. DB has tried to upend normality by presenting himself as the victim. In the light of day, this misdirection became exposed as a total sham. The jury in his trial cut through the falsity and found him guilty as charged. Of course, his sentencing remains. I cannot say with certainty whether Brooks has narcissism, and I do not even want to even attempt a diagnosis. However, his behaviour mirrors that of my narcissist parent so much that watching the trial was hard on me - felt at times like I was back in time thirty years ago, watching my father's playbook cover to cover. As such, I do want to introduce one particular behaviour that I have not yet seen mentioned anywhere as a possible explanation for Brooks' outbursts: Narcissistic rage. This is when a narcissist is so infuriated by something (usually something that pierces his self-image of a perfect person), or when someone s/he considers their lesser has agency that the narcissist cannot overcome, i.e. when they feel powerless. And narcissistic rage is something where they completely lose all control - for outsiders sometimes at the drop of a hat. In such cases, the narcissist mind can go into a complete meltdown because they never developed any mental faculties to deal with this, and it does not even matter if it was something with ill intent. All that matters is that what the narcissist wanted, did not happen - something else did. I have seen a narcissist fly into a screaming rage complete with physical assault (that had a neighbour call the police) because someone had mowed their lawn for them as a nice surprise. Again: I am not giving a diagnosis - but from my experience, the behaviour Brooks displayed both during his road rage *and* in certain situations in court is completely consistent with narcissistic rage.

True narcissists are very intelligent, high IQ. This POS scored 80 something on the IQ test, nowhere near clever enough to be a real narcissist. IMO the POS that he is, is due to never being told no, never being held accountable for any bad actions, and his mother still defending him has encouraged this behaviour in him.

I was married (for a very short time) to a guy like this. They are incapable of empathy or even considering another persons point of view. In his mind, it was likely his ex’s fault for making him mad and the victims fault for not getting out of his way. I remember my ex crying when we were in mediation and saying that he just didn’t understand why I was leaving him. When I called him on it and told him he knew exactly why, he quit the act. When he had road rage, you could even talk to him. When he wanted to hit me, he would try to get me to hit him first. When I’d walk away, he’d lose it then pretend he didn’t remember what he did. Please don’t respond that you are sorry I had to go through this. I’m not. I got a wonderful daughter out of this who grew up to be my very best friend. @@LawNerdAmber if the conviction is overturned or reversed, the court of appeals will remand back to the trial court for a new trial. re: double jeopardy -- "Every defendant has the right to at least one appeal after conviction. If the conviction is reversed on appeal for insufficient evidence, it's treated as an acquittal and further prosecution is not permitted. However, a defendant may be re-prosecuted when the reversal is not based on lack of evidence." there is obviously no way in hell this case would be overturned due to lack of evidence, as the state had an overwhelming amount of it. so there's nothing to worry about in that regard. that said, i do agree that the judge and the prosecution were very by the book and cautious and made sure to keep a very detailed record. they were extra careful in an effort to avoid a mistrial or an appeal. even though double jeopardy would most likely not apply, he could be re-tried after a an appeal (if successful), and it's a lot of time, work, and taxpayer money to do all over again, not to mention risks retraumatizing the victims and the community. hope that makes sense. and just a disclaimer that i'm not a lawyer and this is just my best understanding of everything.

Dave’s Lemonade did a 3 hr documentary type video that really shed light on the WHY. I finally get why and what DB meant about us not knowing the full story. He was sitting in jail for 3 weeks before the parade tragedy on charges stemming from hitting Erika with his car. For 3 weeks he was calling her constantly (there were 100’s of calls) harassing her to tell detectives this was all a lie and to refuse to give them her medical records. He threatened her m telling her he was facing 60 years and would die in prison because of something she did (that’s how he thinks, SHE caused this). He finally made bail and the very next day he got her to tell her location and he went to confront her. So this incident was THREE WEEKS in the making, DB thinking his life was on the line all because of EP. The judge said she believed the intervention by Runkle & Kirby saved Erika’s life that day. DB spent 3 weeks “fighting for his life” and still couldn’t get Erika to recant. THAT is the rage they talked about. That’s why DB kept saying we didn’t understand the full story why he wa so fixated on Erika, in his mind this entire thing is her fault. He walked away from her got in his car that day understanding his life was over, she wasn’t going to recant he was getting those 60 years. And he drove like nothing mattered because his life as he saw it was over.
