Bax 60 they’re not using the test to get convictions. They use the test to decide what to do in that moment. Most of the time, they aren’t admissible. If a cop wants you to take one, take it or you’ll probably get arrested regardless. They don’t need the breathalyzer or the field sobriety test to arrest you for dui.

@Jack Bruckner I don't think it's littering when the cops are telling you to do it. If you watch other videos where the subjects are smoking cigarettes, the cops are always telling them to put out the cig and throw them on the ground.

Every DUI I ever processed with very few exceptions: “I had two beers” “a deer jumped out” “you can call my friend” “I can just walk” “I have knee and back issues” “you’re ruining my life.” The exceptions which I respected: “Well, you got me. Let’s roll to jail” “I’m drunk and not doing your stupid tests”

I haven't had a drink since January of 1989. In 2015 a local police officer stopped me and said I had a taillight out. I didn't. He then asked me how much I'd had to drink. I said I had nothing but water. He then asked me to take a field sobriety test. I refused and told him lets just do the breathalyzer He called for backup. Trooper shows up and asks me why I'm not cooperating. I told him why the officer stopped me. He checked my taillights and found nothing wrong. He then let me do the field breathalyzer and found id had nothing to drink. He then looked at the local police officer and said Maybe you should be the one taking the sobriety test. The trooper then sent me on my way

Tim Mebruer Big respect your your sobriety good sir. I just wanted to share my little story: it was about 30 degrees out and the highway patrol that administered my field sobriety test had mercy on the fact that my legs were quivering and shaking from the temperature. I aced every part, but stumbled slightly when doing the step and turn. Highway patrol said I should have a friend come pick me up, but I’m otherwise coherent. so I hop back in my car, the highway patrol leaves and then the county cop who had pulled me slaps me in cuffs for reckless driving 😂 the biggest twist is while I’m cuffed in the back they’re driving 93 in a 45 towards the jail. “Reckless driving” lol

I was arrested for a DWI. Although it destroyed my future in any worthy professional setting, I was honest with officers. I was forthcoming and regretful and what I have to suffer with now is nothing compared to what someone else could have suffered if it weren't for the brave men and women that helped get me off of that path.

Fun fact: Even if you’ve had surgeries, hip replacement, knee replacement, etc, and have a hard time standing steady, cops can still tell if you’re drunk.

I mean no matter how sober I am I couldn’t pass those test. I try to stand on one foot and fall almost immediately I try to do the heal to toe walking and can’t keep my balance. I’ve tried flat out sober and couldn’t. I did better after a couple drinks when I tried it (I never drive after drinking and don’t drive right now anyway) then I did sober.

If it’s obvious that you’ve been drinking, 2 beers would probably be the limit where if you’re still fully coherent and pass the breathalyzer that they might let you go. 3 is too much and 1 would be an obvious lie, just my speculation. And telling them you drank beer sounds like you’re being honest and might get you more leniency

Nah, not always. I got pulled over after fishing, cop smelled it on my breath. I told him yes I had four beers but haven't had any in two hours so that I could sober up before driving. He had a long conversation with me then told me he absolutely believed me, and that I didn't appear to be intoxicated in any way. Didn't even pull me out of the vehicle. No ticket. So it does happen.

You're so very... Very lucky! As a recent past functioning alcoholic it's the worst. I still struggle time to time. I don't drink and drive anymore and opt for my electric skateboard which 95% of adults over 25 would die on even sober (goes 30+ mph). It's my get around town mobile after a few. I've fallen enough to know it hurts and be careful. Alcohol is the worst.... I'm working on it... Got about a month no booze and been mountain biking/ spearfishing more and more due to no hangovers.
