They arrested him because even though he was parked you cannot legally have your car on which he did. If the car was off and keys were not in the ignition then it would be a different story but because he was passed out with the car running, he is technically operating a vehicle while under the influence. Same thing happened in an episode a couple years ago with some stoners and the cop actually explained it then. Don't think the dude would of understood it if they explained it to him this time.

is it because he refused the breath test? which you can not use the reading in court but you can use the fact that it tested positive for alcohol but since he did not blow no evidence. plus by the time they get the search warrant for blood draw the alcohol would mostly be out of his system?

Buddy cops will charge you with a DUI if you are near your car and have the keys. I knew a guy who went to sleep UNDER his truck cause he was wasted, and was woken by a cop saying he’s getting a DUI because he’s drunk and has the ability to drive (keys in pocket).

I once had to do a field sobriety test when I don;t eeven drink at all. My dog who was a puppy back then jumped in my lap while I was making a turn in my truck onto a highway at night and there wasn't even a soul around in miles, until the cop pulls out of a side road just as I'm turning onto the highway and flashes his light on me. The cops made me walk the line, did the pencil test on ma and a breath anilizer test on me AFTER he admitted to NOT smelling any alcohol on me. I still get a ticket after passing all tests with flying colors I might add too. That's one thing of what I can't stand about these young cops who haven't been on the force very long. They're mostly all trained to be waaay to suspicious these days. Any slight anything and you have to be humilated with tests like this. And no alcohol was detected in my system at all. Total zeros on the breath test.
