We have same law in Great Lakes. Does not cause conflict. Can not set up a camp site but can walk your dog, fish. Anchor your boat. Michigan

Looks so cold. But same as the ocean concept in Hawaii and no one owning the waterline .

You have a great view, but there are precautions that have to be taken if you live next to a river. Care must be taken where you put your home. Freshly caught fish is a bonus, though. Cheers!

Check out Libby. Same day-to-day scenery but no where near as expensive as Kalispell/Whitefish. Downside, it's 90 miles from airport/major hospitals. Pop: maybe 3-4,000?

@Linda Neavil This is good to know. I’m single and over 60. I’ve been dreaming of moving to Montana. Visited last summer and want to head back to scout out places to live. It’s a bit daunting, but, why not? Glad you’re happy there!

Great info! Own land on the Swain River always wondered about the access. I camp on it on and off since 1978 never stopped people from walking through Hmmm. As things are changing .

@livinginmontana. So I’m just curious, what happens when those people camped above the high water mark get injured on your property? Do they sue you and your insurance policy? If so I don’t know how it would be even possible to get insurance. Hopefully you then sue Montana. The government should never have the right to force you to allow strangers on your private property. This has to be a constitutional violation. But I do agree that all access to the high water mark should be public.

I lived near rivers , it not the euphoria as you might think is. Floods are real and cold always almost all year.

Are there any types of water features that are not public? Like a two foot wide brook, or run off into a lake that is fully on private property, or a man made irrigation ditch?

A person cannot cross private property to access the water so a pond/lake surrounded by private property is off limits unless a river runs through it and access is gained to the river at a public site (bridge, etc.) and then the person travels down the river below high water mark to lake.

Can you clarify the “camping” aspect again ? I looked for the link that you suggested to the law, but could not find it. If one can camp above the high water mark, yet out of view of the properties residence (?), then why have a low water or high water mark ? If I am understanding you correctly (and in my opinion), on a class 1 river the water marks are useless ??

Understood on the "pins" at the high & low water marks, but can a person(s) actually come onto your property (i.e., beach a boat, raft, tube, etc., and enter your property)...?

No, only to the high water mark of the river.

I think it may be mean high water mark, or average. Some spring runoff floods, etc do not constitute high water mark

Maybe not. Some back-woods places aren't as expensive as you'd think. And you get to make of it what you want. :)

I'd love to live in the country somewhere away from people but at my age, and with my health conditions, I need to remain close to a major hospital. Ya know what they say about those "Golden Years".... there's nothing "golden" about them.

With a creek (Crick) which is never deep enough for a boat, I assume that others can walk through up to the high water mark. My question: Can they hunt from that spot...shooting inside or outside of the watermark? OR is it like driving through private property (orange markings), in that visitors cannot shoot in this area, at all?

So the public can access the river from the river correct? Not pull up in your driveway and walk through your property to the water? And now the way most people are they will trash it. Hiking through the Bob> The floaters leave trash and I mean non biodegradable trash. So as the land owner I guess I'll be down in the morning and watch you cleanup and move on, or perform a citizens arrest for litter and call the sheriff. I admire the intent but ethical sportsmen are a dying breed.
