Matt, Thank you for the advice, I gave my deposition, told the truth. I listened to each question, paused answer just the question. The opposing attorney was so mean that I began to cry and I fell apart but I told the truth.

While a case can't be won in a deposition, it can definitely be lost. These are great tips for someone who is being deposed in a personal injury case.

I was struck in my company car by a subway train at a blind crossing were the warning lights were not working. I could not see the train coming until I was actually on the tracks in my company vehicle. It has been 10 years and one month since the accident and now they are getting around to a deposition by phone because of the China virus.After the first four years, I would remind my attorney every year that another year has passed what is the progress in the case. Not until I actually contacted the CEO office of the company i worked for & recently retired from after just under 39 years , and asked his office to light a fire under the legal department, did I hear from my own attorney. He was quite unhappy and said I would harm the case, and that i should not have done that,but, Surprisingly,now it is finally proceeding..I actually got a form from the attorney generals office of the state I live in which I have not filled out yet, but it is to take action against my attorney for his lack of action as the 10th anniversary of the accident approached..I do not wish to do so but 10 years. I am not a young man, I am now retired, and many of the witnesses I’m sure have expired, they were seniors at the time over 10 years ago.. in my work I used a digital pocket audio recorder to take notes from each stop and enter that info into the laptop in my co car..i used that recorder in my shirt pocket at most stops to keep my hands free to carry tools to each stop in my work.. After my company vehicle stopped spinning after the impact with the train, within 10 seconds I instinctively hit the record button and let it run as the witnesses approached to see if I was OK. I was stunned but conscious.Will I be asked to play that recording at the telephone/camera deposition from my home? I sent my attorney a transcript of every word of the approximately 20 minute recording.When I first went to my attorneys office after the accident, I played the recording for him. He listened intently to every word. When the recording was finished, he sat back in his chair and said, put that in a safe, that is gold.. Will I be asked to play the recording at the phone/camera deposition? Will I be able to point out at the deposition that the port authority/owners of the subway train, have added on additional damage to their subway car that would be physically impossible to have been done by my company car because the damage is down the side of the train.. The only contact my company vehicle had with the train was with that front coupler. Also, they state in their documents that the accident happened at a completely different intersection. I pointed this out to my attorney several times and he seems unconcerned with those two facts..I don’t have very high confidence in my attorney, I actually think I could do a better job in the quart room then he is doing. He seems pre-occupied, unconcerned. Also, I don’t know if this is admissible, but I actually have video i captured while working once i was able to return to duty months later,of those warning lights not working at that intersection and other intersections that I collected over the years while covering my work area that I happened upon.. also, I have recorded television news reports of accidents at the very intersection with other vehicles. i sent those videos on a flash drive to my attorney.. Are those other accidents at that intersection admissible? Are they related to my case at all?It shows a history of safety light failures and accidents at the same intersection. I was contacted by my attorneys assistant asking if I would be available to do a video/telephone deposition next month. That’s why I am researching videos on What to expect.

They like to pin people down especially when they are guessing or estimating. This rarely works out well for the witness.

Does the defendant's lawyer have the right to ask me the same question but worded differently? How do I handle this. I have my workers compensation deposition next month and I want to prepare as much as possible. What kind of personal questions are they allowed to ask? How personal are they allowed to get?

I suggest an answer such as "Like I said before...." when they ask the same question over and over. As far as personal questions, they can go pretty far. It all depends on the facts of your case and the types of damages you are claiming. Please talk with your lawyer concerning the areas that the insurance defense lawyer may want to delve into.

interesting and informative clarifies everything that is obvious to judicial interaction and daily life relationships less within reason is always best moderationis a key to life drink moderately eat moderately talk moderately yes no answers or limit yourself to what you have to say let others control the higher percentage of the conversation and higher number of the people will be happy to know you and consider you a favourable person to talk to and probably because you have not put your foot in your mouth

It may be a problem, it depends on how long ago, and what type of crime. If it is a crime of theft, or moral turpitude, then, it may be a problem. Talk to your attorney and let them advise you on this important question. Good luck. Matt

Hi. I have a mediation coming up ! On a auto accident. .was rear ended while stoped at red light! 3.5 years old case ! Sustained herniated disc in 3 location one being more serious in the neck! Benn through few epidural ! Among 7 different doctors including Neuro surgeon ! Terrified to go through surgery as it poses high risk ! My question is , is surgery a requirement in order to have a fair value settlement for my injuries ? OR what if I like to postpone the surgery till I'm 100% ready mentally to go under the knife! Would this Postponement hurt the value of my case ? Is surgury a condition to get a fair settlement? Lastly. what ballpark of a value am i looking at before the surgery having those imjuries mentioned above plus TMJ. By hitting my head , Knee. Elbow. Tnx

Hi Bobby, there are many variables in figuring out the fair value for every injury claim. The big 3 are Liability, Injuries and Collectability. In your situation the liability is high, or very clear, which gives your case a higher value. Second, your Injuries are serious injuries, and no, you don't have to have a surgery to increase your damages. Third is the Collectability. If we assume the collectability is unlimited, then I would assign a value of more than a million dollars. The decision to get a surgery or not to get surgery is a personal one. However, here are some factors to consider. If you do get surgery, it will increase the value of your case, because you have undergone a significant operation caused by this crash. Also, if you get surgery and any complication arises, then the at fault person is responsible for any adverse problems you might encounter. They have to pay for any damages caused by the surgery. If you choose not to get the surgery, then the value of your case will probably be a little lower. And if you settle your case, and then get the surgery, and have a bad outcome from the surgery, you can't go back and seek those damages because you settled your case, and signed a full release.
