ridiculous arguments from Merck. it is not illegal taking since it is a negotiation. if Merck does not want to sell the gov cannot force it to buy it. and since Merck can sell the same drugs to other countries much cheaper they can give a discount also to the US

Except that the vast majority of R&D is paid for by our tax dollars, NOT private drug companies.

Most if not all other countries in the world negotiate and regulate prices. But in America its all about screwing the customers. And in reality most R&D is done at Universities with a lot of Govt / Tax Payer grants, which are then handed to big pharma to make billions.

people in the comments are misinformed. The law basically says that the government will send a price to the company, they have no choice but to accept it, and if they don't they will be taxed daily on all revenue of that substance starting at 186% going all the way to 1900 %. On top of that, the law bars them from disclosing the negotiation, and actually mandates them to say publicly that it was fair. These are clear violations of the First Amendment, and the takings Clause of the Constitution
