A Michigan family filed a lawsuit against the Hawaii's Tourism Authority, and other visitor groups, because they don't warn tourists about potential dangers of snorkeling soon after flying.

There are too many factors pointing at the man making his own decision to go snorkeling based on his own personal experience (been to Hawaii several times, experienced snorkeler). If the lawyer and the wife want to bring up health and wellbeing, then the tourism authority could bring into consideration the man's health and physical condition as factors in his own death. It's gonna get ugly, and the wife may not want to go there.

My thought exactly!! I was totally thinking his weight probably was main cause! And I’m overweight too 😂 but I’d never ever want my family to sue anyone because I choose to do whatever for my enjoyment. I hope she loses this suit but I’m sure she won’t. They will settle and then they will make ridiculous rules and regulations.

There is no studies to prove this. As a matter of fact snorkeling strengthens your lung capacity. You can tell in the picture he’s overweight and that can increase the likelihood of developing pulmonary embolism. He also most likely suffers high blood pressure which can cause pulmonary hypertension in high altitudes. It can happen to anyone whether they are snorkeling or not. The attorney is not a medical professional and should not be giving advice . I’m a Nurse Practitioner and a snorkeler.

If this is the case, then the state should hand out mandatory waivers along with the plant/animal declaration which must be signed when flying into the state. Or require proof of $1,000,000 insurance before getting on the plane.

How ridiculous is this lawsuit! When you travel anywhere in the world you as an adult should take it upon yourself what you can or shouldn’t do once arriving at your destination. Making the case that the state of Hawaii is responsible is just pure greed. You went to Hawaii many many times before never had an issue yet the last time you did something wrong happened. It’s unfortunate that this gentleman passed, but we All need to be aware of what we can or can’t do. Do you realize the totality of problems that can happen after a long hall flight. Can you imagine everyone getting the same attitude as this person the multitude of law suits would be astronomical. Again it’s unfortunate, but Everyone takes risk in any extra curricular activity we may do after a long haul flight or in every day life however that doesn’t give us the right to sue a state and airline or a hotel.

If he's an experienced traveler, coming to Hawaii multiple times, snorkling on past occasions and even local snorklers have experienced it, then air travel/pressure can't be the major factor if the local snorkeler's experienced it. Snorkeling has been around for a long time, but if age or snorkel designs or other factors come into play, then it blames HVB as knowing about the risk shouldn't be restricted to only Hawaii. How many other locations across the nation and worldwide are experiencing the same condition. I've heard in the past about snorkeler's and death, but it was uncertain if improper usage of the equipment or design might have been factors. If the rental shop have equipment that was a problem, wouldn't that be a manufacturer/design flaw? If the lawyer have adequate proof wouldn't that be a manufacturer issue and not one of the HVB? In my young days, I snorkeled at the bay, but I wouldn't be continuously in the water with my head down for long periods of time. How long was the person snorkeling nonstop?

I snorkel pretty often and now I’m wondering if we can quantify how much resistance different snorkel types produce then why don’t we test each type and get rid of the bad designs. I know I’ve gone through about a dozen different snorkels to find one I can breathe through and not have problems.

Absolutely ridiculous! People don't take responsibility for their own ignorant actions. Know your limitations. Look at the state of your own health. If he was such an experienced snorkeler, how did he not know about the risks ("any and all" of them)? Frivolous claims, people looking for a pay out. I HIGHLY doubt these people would not have snorkeled if they were told not to. Kind of like telling someone to wear a mask 😷, you know they won't do it.

More people who want to pass accountability onto others without taking responsibility themselves. So do we file lawsuits against other municipalities, states, countries for not making everyone who enters their jurisdiction abundantly aware of laws pertaining to operating a motor vehicle? Yes, different areas have different laws on different things and ignorance of those laws is not grounds to a “free pass” from violating those laws. And how can one prove without a doubt that this particular individual would have heeded the advice or warnings of R.O.P.E. had such warnings been provided? I’ve been to the islands several times and I watch dumb tourists continuously ignore various warnings posted as well as violate the laws regarding leaving alone certain wildlife (sea turtles in particular). Generally speaking, humans think they can do whatever they wish without consequences or accountability. I don’t think the situation in this video is any different. Not to mention the individual was clearly not physically fit and likely had other underlying medical issues.

Does their attorney even hear himself? He said the person was an avid snorkler & swimmer who has been to Hawaii before - half dozen times. It should be the person responsibility to know their flight itinerary, jet lag & to know the activities they choose to partake in while on vacation not the hotel or tourism industry.

First of all - saying our waters here are safe is your first mistake. Second, I’m wondering if he was wearing one of those death masks with full face mask and snorkel built in. I feel like ppl always die when they use those. Also, one of the major contributing factors to this can also be ones personal health and BMI. The lawyer didn’t see that as a factor also?

Born and raised in Hawaii of Hawaiian ancestors, I can say that this family is correct. I’ve had family and friends die after or during snorkeling. Some blacked out and drowned, others from blood clot . When I took a scuba class they warn us of not going scuba or snorkeling if You recently traveled on a plane or even went to a mountain of high elevation. I didn’t know that and most people still don’t… The snorkel renters should be educated, and Hawaii tourism should give leaflets and warning on planes as well as put signs on beaches. Condolences to this family. This can and does happen to anybody! Including seasoned water people from Hawaii.

Don’t the visitors have a responsibility do their due diligence before doing any activity? We are not your doctors and know your personal health conditions and since they snorkeled here MANY times before, they should have known by the time this tragedy happened. Yes so we post signs like “stay away from mother monk seals with new pups” and we ALL know the signs keep EVERYONE away from them because no one ever gets hurt or bitten on the shoulder and face because they decide to swim close to a mother and pup, anyway, right? the lawyer is milking its cow...no punt intended...she is being taken advantage of...its not like this was his first time to Hawaii. Not his first time snorkeling if he knew better to go with a Buddy. So many possibilities to what caused his death. As for posting warning signs or informing visitors, they rarely take notice cause they are on "vacation" and somehow...most of them leave their brains at home. I've seen locals express what not to do here and visitors just ignore them. Most visitors are here for a week. Tell them they have to wait 3-4 days before snorkeling? pfff...just like no one waits soon after it has rained...

Out of shape, not enough rest, hungover, medicated probably, altitude change and stress was more than likely the cause. You can ScubaDive after a flight, so why wouldn't you be able to snorkel. What the attorney mentioned was a very uneducated statement regarding snorkeling.

There’s a time for everything. He died doing something he enjoyed in a place he enjoyed being. Do you need a warning for every choice you make in life? He could have looked up on the internet snorkeling safety, do’s and don’ts whatever. Maybe he did and he didn’t heed the warnings. Take responsibility for your own actions.

There are plenty of public service announcements that should be made. Snorkeling, waves and tides, wildlife(animals and plants and coral), sunscreen, tipping hospitality workers, trash management, etc. Currently, there seems to be none of this happening. Educating our guests would go a long way in relationships between tourists and residents and would benefit our lands, waters, and our people.

HAWAII should put into law. For the first 72 hours, DON'T LEAVE YOUR HOTEL ROOMS. Instead READ THE DANGERS of snorkeling, the DANGERS of hiking. If you are FAT & OLD, Don't hike. You might die.

😮😢 look at the stark difference in deaths with snorkeling between locals and visitors! 😮 wow . Yes, we’ve needed plane psa videos on route here for this and other safety heads-up, and helpful tips. Many of us have said this for years. I’m so sorry for the losses.

Flights prior to snorkeling have an impact is something I’ve alllllways figured and worried about for visitors. I as a resident feel I should wait awhile. Hawaii is not good with its communications and is bare minimum on important safety matters. It’s just something we contend with and unfortunately we see several examples of accidents that possibly could have been evaded had there been adequate safety measures followed or shared. Visitors have lots to prep for, they don’t know all the ins and outs and if we’re taking their money and renting equipment, etc, or hosting visitors, promoting activities, let’s be very aloha about sharing the tips and encouraging them to be informed prior, and offer them the information with heads up and safety warnings, tips, etc. The long flight is an opportunity to do this, the airport, the hotel check in, the shuttle buses, the snorkel locations, and last stop, the lifeguard shacks or signage info posted in beach restrooms etc. Just some ideas. It’s always sad when we lose someone. Prayer for the family and friends of the lost man. Today especially, we all need to be careful with heart and lung health post cv, and long cv, spike viral proteins and and mRNAs. Just facts. But this has been an issue for a long time, many years, and so as we experience higher deaths in the country with these issues as well. Sad to see this. Basic snorkeling lessons for some, some prep and considerations, ensuring not going too far out accidentally because you’re wearing fins, or areas that lose control to get back….and then struggle with cameras underwater, picture taking, video taping, avoiding rocks, coral reef, etc….its something I’m still a novice learning myself. So, I pray we can have a safety video serious, and aloha series, etc ok flights as at least one easy, helpful option.

Some of the statements are decent but people don't always pay attention or read the warnings on equipment usage, whether snorkels, driver's manuals or emergency procedures on aircraft. Same might be for rental mopeds and such or hiking. Even if in the case of rental snorkel equipment, they might have signed a release on the equipment, would they have read it and/or passed it on to others? We'll see what happens to the case. I keep thinking of the Big Island recent incident of the visitor driving to see sunrise and ended up driving the vehicle into off the edge of the drop. Should the HVB have been responsible about warning people not to drive offroad by the water on Hawaii county?

Hawaii is a terrible place to go....whether it's for vacation or permanently. They hate outsiders and they are very eager to let you know how much they don't appreciate you coming there. So take your money and go somewhere where the locals will appreciate your visit and your money. Try Fiji. The people are intelligent and friendly. And they don't hate visitors most importantly!

I think this is a joke, someone who is looking to make a buck. I’m sorry this man passed away but take responsibility for your own actions. It’s also the number one cause of death because it’s it most done tourist activity, it’s affordable so more people do it so of course those numbers will be higher. The lawyer should be ashamed of himself for his taking / filing this case…bottom feeder.
