Duh. He is a criminal lawyer and does tasks that mainly deal with human emotions and life/death. The reason why conventional lawyers appear dull and condescending is that corporate lawyers deal with extremely mundane work which revolves around transactional work and due diligence etc. It is very boring

What a personality! I could listen to him go on and on. If he was my professor, I would hate to miss any of his lectures. He is articulate and gives clear and concise explanations. Interesting fact dogs cannot eat chocolates. They can die if they were to eat one. When he was doing the re-enactment with the dog i was abit worried if the dog would lunge forward and eat the chocolate lol. I guess he would be guilty of a murder charge on an animal hahahaha

Actually, dogs do not die until they eat a certain amount. I know of dogs that survived to old age after downing a small chunk of chocolate when the owner is not looking. But of course, dont be silly and feed dogs with it la.

I think it's really interesting with the self defense. Here in Germany we have the principle, that the victim doesn't need to accept a physical confrontation with an unclear ending. So the victim is allowed to use the most effective way to protect him- herself, even this means to shoot or stab the unarmed attacker, with the intention to kill. I wonder what would be the argument behind the self defense restriction in Singapore.

I am not a layer, but guess is to prevent people from plotting & using "self-defense" as a loophole to kill another and escape capital punishments... Imagine somebody wanting to kill a person not wanting to face capital offense. All he has to do is purposefully & continually verbally provoking the other until he/she couldn't take it & moved her barehand (likely to slap/punch). Then the provoker can just smash the victim's head with a brick causing death, and calls it "self-defense" (Example not be perfect, but hope you can get my point)... Also, guns & arms are illegal in Singapore & nobody carries them (except for police, or soldiers on official missions). And illegal guns & arms are extremely rare in Singapore too. Thus also can't use the excuse to say worried a layperson will shoot at you, thus you go on excessive self-defense.

Question: what if you are already convicted but there is new strong evidence that you did not commit the murder but you already spend time in prison on death row what would happen then?

Appeal first, process takes fucking long if you don't have money. If appeal succeeded you will be released. I'm not sure if you'll be paid for the time spent, in certain countries you are paid if you are wrongly convicted for serious crimes.

Get a good lawyer to turn in the new evidence and hope for the best (release), no compensation will be provided by the court in Singapore. However in US for example, it’s considered a miscarriage of justice and some sort of monetary compensation will be given

you can try to either, appeal to the court of appeal and wait for the results for years maybe? if success , then you’ll get a lighter sentence or maybe even no sentence? or either they’ll lighten your sentence or release you .

@@limwowo5902 False. U failed to account for the fact that u have been looking at an iceberg. Most of the sexual offences are not from NUS nor the rich, as a matter of fact they are from non-unis such as secondary school, ITEs and Polys to begin with. The difference? Their cases only receive "internal disciplinary action" while NUS cases are reported to the police and then the media makes it viral. Even for the poly ite cases that managed to get reported, all receive probation just like those from NUS. Let me remind you, the grp of 20+ perverts getting caught at once wasnt from NUS, the bulk of toilet perverts also werent from NUS, the 40 thousand perverts in SG Nasi Lemak telegram werent from NUS. Not to mention, an NUS case or a case by a rich person often gets amplified and will go viral because the media will constantly leverage on selling stories propagating skewed catchy narratives sheeps like you want to hear. In addition, the quality of the defence attorney's argument makes a difference. Seems like u learn nothing from this video and just bring along ur bias.

What is the best defence legally for me if I’m cornered in the toilet by a guy and I injured him badly? Should I record our conversation in the midst of the incident or call the police on loudspeaker? Assuming there’s no witness.

You can try to prove that you were acting in self defense by calling the police but I believe this may be difficult considering you are in a fearful situation and do not have the chance to pick up your phone to record/call without the guy knowing. However, please do note that recorded teleconversations may not be used as an official proof in court as voices can be tempered with and it’s difficult to prove to the court which voice belongs to who (even though it may seem obvious to you). Calling the police may be the best option considering there are no witnesses

As a Malaysian, I believe that some crimes deserve the death penalty for nothing else can be called justice served. At the same time i am opposed to it here in Malaysia because the system has many issues where the chances exist for one to be wrongly tried under capital laws snd ending up on death row. When we talk about the state forfeiting a life of a person, than the bare mininum requirement should be that the proof and evidence produced at a trial showed beyond a shadow of doubt that the accused is guilty. Interestingly, if one can recall the 80's and 90's, news reports on people convicted and sentenced to death usually carried the words " was sentenced to death after it was proven beyond reasonable doubt that.......". Sec 300 (d) - No dead body to proof that the person is actually dead, let alone proof that the person was murdered. Now no dead body to proof that a person is dead and not in hidding or chose to disappear for any rhyme or reason. Assuming is dead, but again no way to proof cause of death. Could be suicide, could be natural, could be accidental. So assumption on top of an assumption. And a person can still be convicted and sentenced to death on fundamentally what are assumptions and not solid evidence. This is an example why the anti death penalty proponents and their rguments cannot be denied. For there is no difference between an act of murder and the execution of a person guilty of murder otherwise.

see 6:52, defense 4! it explains self-defense as a possible exception to a murder charge. the balancing factor is whether the self-defense is believed to be disproportionate or not, or at least that’s what i understand from it 😅

You can think of it as a two stage analysis! To be acquitted you must either (1) show that the section 300 charge is not established or (2) show that you have a valid defence (e.g. self defence). It is two stages because having a valid defence doesn't mean you didnt commit the offence. For instance, as long as you intentionally hit the guy in the head, it is generally sufficient to show you have committed a section 300(c) offence. But you can escape conviction by showing that you only did so because you were in danger (self-defence). So technically the self-defence issue only comes in at the second stage. But of course in real life the facts are not as clear and you could argue there was no intention to hit the guy's head in the first place - if so you can escape conviction at the first stage.

Convicting the accused of murder without the murder weapon AND the recovery of body is a weak case. Many accused persons were wrongfully executed as a result in several countries.

I remember law student Sunny Ang who was convicted of murder of his girlfriend. Her body was never found but he was hanged in 1967. He was a classmate of my brother and have visited us a few times.

@@Iac12m I knew of a guy that hacked his girlfriend to death in Norway but he was a prick. He was so false that only women believed the lies he told.
