It is illegal to charge more than the MRP. Generally the hotels, airlines etc sell items specifically packaged for them.

I think last time you visited hotel in 2017 only. Just to enhance your knowledge now restaurants, cinema halls & hotels has increased MRP price water bottles & cold drinks. Not the Rs.20 printed price anymore. So they charge you as per MRP only which is printed by the manufacturer only for them. And if in case you visit hotel next in 2022 please check.

Can you please let us know, how much more they can charge ? I means in percentage like 5%, 10% more than the MRP

Its not that they can change above MRP. But there is something called Dual MRP for same product

MRP means Maximum Retail Price. Being served in restaurants means its not a retail transaction. So concept of MRP does not apply there at all.

I own a spare part shop , and after getting work done , customers are asking " why are you charging more then MRP" its not legal . And i just take the part out put it in there hand and say " thik hai mrp jitny paisy hi dedo or isko khud laga lena " 😂

It's just corporate lobbying tbh , a hotel puts more effort than a person living in village transporting materials from 50km every week and has to sell for MRP. but 5* who buy in bulk even have ties with manufacturers can charge any amount.

Agar customer log mrp mrp karke mazaa bhi lutna chahte hai, toh ye fir shop keeper ke sath injustice huyi. Customers bhi koi innocent log nahi hote, bahut chaalu hote hai aur aise aise paitre khelte hai owner ko kanjusi se kam paisa dene ke liye ki koi sochega bhi nahi. Hum log totally one-sided hoke customers ke justice ki hi baat karte hai. Ek baar koi business karke dekhiye, aur sath me baariki se customers ke naatak ko observe kijiye daily, aapko chidh aur ghin bhi aane lagegi customers se.... sab nahi magar 40-70% customers (depending on locality area, city) kamine, kanjus, fukkad, thug, aur jhik-jhik karne wale hote hai jo rights ke naam par hadd paar karte hai (aur inme government servants, corporate workers, private sectors wale customers bhi included hai). Uski property ke pros wo aapko free me kyu share karne de? Owner ko bhi pata hai ki ye drunkards ko baithke khaane/pine mere yaha ki chair mil rahi hai. Nahi dena extra toh ghar me ja ya sadak kinaare kha. Toh isliye, luxury ambience ko sirf apne nazar se hi mat dekho. Sirf 5 star me hi luxury nahi hoti. Various logo ke aukaat ke hisaab se uske liye alag alag luxury ho sakti hai. Jise jo chiz ki sakht need hai, woh chiz us wakt use provide kar do, toh uske liye wahi luxury hai. Property kaisi bhi ho, aap us property pe rukke maze le rhe ho, apni needs puri kar rhe ho, toh extra paise dene hoge. Do naav pe paav rakhke kaam nhi chalega.

Service aur luxary use kar rahe hai to price service ya luxary charges hone chahiye. MRP ki cheej to MRP pe hi milna chahiye. Thats what MRP mean. That means the puc that is charged as ₹ 50 and billed as ₹ 35 for bikes is justifiable because they give the same reason of the infrastructure that they put in on roads and petrol pumps. I feel its a very good way of building a society that justifies black marketing and unfair trade on basis of the infrastructure a seller builds. Infrastructure has yo ne a part of the business and not a burden to the value of the product. What about those who after gst has been implemented now charge gst on the menu price as whole and not the difference amount of the proceed of the product ie, gst on the profit margin and not the whole product. This is how the hotels and others institutions take advantage of the given situations and unawareness of people. This reaches a time when you make them aware they say take it or leave, that is the way it is. What is the use of printing "mrp" when you do not abide by it on the name of sellers infrastructure. What about those who take away and do not use the ambience. Will they be given discounts for the same.

But what if it is take away. Still they are charging same in that case we are not using there ambience, services and all.

In most of the tourist places also , most retailers charge 5 or 10 rs extra on every necessary products. Is that also legal ? Especially everywhere in karnataka tourist places also shops on highways.

Actually the 5 Star Hotels don't serve the cold drink in Packaged bottle. They serve it in their own Glasses and if they have bottles then their MRPs are on higher side.

In foreign every item that is from thirdy party companies and used in hotels is customised with no mrp on it but in india nothing like that instead they change mrp for hotels just like 500 ml pepsi in dominos is 60 rs. Mrp specialy made for them only .

The SC order of December 12 allows dual pricing only for “institutional consumer” i.e hotels which source their bottled water directly from bottling companies. Not applicable for those hotels who buy from third parties disturbutors. A label of 'Not for Retail' should be mentioned on the product, or else the hotel owners can be fined.

But recently Hon' SC said that they can't charge extra, the extra service charges are already included in food prices

Yes.you are right.but they cannot put GST on that. They can take 100 instead of Rs.20 but they are putting GST on it.that is illegal.

Fun Fact - When i visited Australia, i was really surprised to see that choclates, milk, maggi, cheese etc nothing had MRP on them, every store was charging on thier own rate for same product, just like how we get veggies and fruits here in Market. That's when i realised that this is something we have in India and maximum number of countries don't have MRP..

Some restaurants simply just dont give u a pet bottle and serve cold drink in glasses so that they can charge Rs.100 for Rs.20 cold drink. I will say that if they want to serve cold drink in glass and charge for that, atleast they should have a fountain to serve fresh cold drinks like Mcdonald's. Just opening aa 250ml bottle and serving it in glass with 2-3 ice cubes is not justified.

But my question is if the extra cost included in the price of the bottle is for services we use than why they charge us service tax extra??? they should keep any one.
