Using AI for an actor's likeness without the actor's consent is downright dehumanizing. They have no right to use technology for purposes that the actor doesn't or will ever believe in especially after death.

Let me just say this, from my own career negotiating things with other companies, clients and stakeholders: the way John played that talent who asked for a car is exactly how you're supposed to play it. I worked with a company years ago to draft a proposal for a government agency, and they came at us with something completely unreasonable late on the night before this thing was due. I just told them "okay, we're done here, we're not submitting anything tomorrow morning," and I hung up the phone. We got the thing done and submitted on time, after some more haggling, but my boss was so proud of me the next day. Never give in to a last minute surprise out of left field, always hang up the phone, walk away from the negotiating table and let everyone cool off.

exactly i think if they had brought this up months ago towards the beginning of negotiations it would be a different story but the fact that they are barely bringing it up now out of left field makes no sense unless they wanted it as leverage to say to the studios “if you drop the AI issue we can drop this 57¢ issue “

Might the real existential threat to actors from A.I not be the ability to "copy" them, but eventually, as the technology continues to advance, being able to generate an "actor" entirely by itself, without any real-life individual to base it on?

A restauranteur can't decide to not pay for the steak they serve just because they aren't turning a profit. It's not the ground beef supplier's problem. It is why businesses take out loans because they know they won't turn a profit at the start. Streamers are no different.

The only context I could see this digital image thing in is to have it on the backburner if a situation like Carrie Fisher or Chadwick Boseman happens. So if they wrote in the contract that these likenesses can be used a) only if the actor dies during an ongoing franchise or TV shows and b) only in the very next installment of the franchise to have 1 or 2 scenes to wrap up the storyline. After that, no more using it. I think that might be a compromise that people could get behind.

What is so hard to understand, SAG want a cut of the monthly subscription. That has always been the SAG position, it hasn't changed, the levy is just an options to do that while protecting the current streaming revenue that the AMPTP are unwilling to give up. Its the Spotify model.

My question would be, does 100% of the content on Netflix has SAG actors on it? Does the cut that SAG wants is of the total worldwide subscribers? Is it just from American subscribers? I'm going to guess that no, 100% of Netflix content does not include SAG actors. And that even if we are talking just American subscribers, not everyone is subscribed to watch movies or series with SAG actors. So not only do I think it is a wild ask, but also extremely unfair (if accepted) towards South Corean, Spanish, Mexican, Indian and so many other actors not getting anything.

Feels like a negotiation tactic from SAG, the aspect of revenue sharing in this way is never getting approved with these companies being publicly traded. The only comparison for it is in sports, but sports leagues aren't publicly traded this is never happening.

Here's the thing. some actors make millions and some actors have to wait tables for years. So.... why don't the millionaires make a little unemployment fund for all new actors. Studios should have to pay at least minimum wage, but that's it. Just like freelancers and contractors, if you aren't working, you don't get paid.

Studios should be allowed to use the digital imagery of actors as long as they get the consent from the actor and pays them adequately via residuals or royalties and or an upfront payment. Each time their likeness is used then they have to be compensated. Actors must agree with each use case of their likeness. Studios not being able to use actors likeness even if they get their consent is too restrictive, and studios being able to use actors likeness without consent and not paying them for each use case of their likeness with or without consent is exploitative. A more balanced approach is to give actors control over their own likeness, but also to allow studios to use their likeness with their consent and compensation. This would allow actors to benefit from the use of their likeness, while also protecting their rights. Actors being paid for their likeness would help to ensure that actors are compensated fairly for their work, even if they are not physically appearing in a production. Actors should have control over their likeness which would allow them to choose how their likeness is used and to prevent it from being used in a way that they are not comfortable with. It is key to ensure that actors are fully informed of their rights and that they are able to negotiate fair compensation for the use of their likeness. The benefits of this approach outweigh the risks.

john illustrators and visual artists in the industry have been dealing with the battle against AI for well over a year, studios and individuals using our stolen work in image generators and our names to be able to ape our styles. And we are not paid nearly as well as actors. it's really bad. our work was taken, even the copywritten client work without compensation, credit or consent.

Gotta say that's a smart idea with the subscriber tribute that way you could calculate the number of subscribers and be able to levy that in negotiations. It absolutely does not benefit the streamer/production company.

I'm guessing the levy is a counter to the residual issue. If the streamers supposedly can't give figures for how much the shows/movies are actually watched, then focus on the figure that they can give - subscriber count

We're to the point where there aren't going to be any summer movies next year. The summer blockbusters are the big earners for the studios and those are basically gone at this point. There's just no way to get something filmed and released in time. If the strike goes on into 2024, there won't be any holiday season movies either. We're looking at a very very bad year next year which is going to really hurt a lot of the studios financially. You'd think they'd be desperate to get a deal made.

Seriously, if I have my figures right, they want over 3.5% of Netflix's entire revenue, not based on any sort of content performance or viewership, just on every person that even has access to content. I'm sure it's more nuanced than that, but that sounds utterly insane.

It’s only sounds in insane if you look at it from a capitalist viewpoint. Which I do not. It is the work of the actors writers director and crew people that provide the content on these platforms that then people subscribe for so why shouldn’t these worker get a cut if the profit that their labor helps to generate. And I believe this is what should happen for all business.

@@ericsmith9547 You do also realize that streaming services like Netflix are truly global, there is a lot of Korean, Japanese, Indian, etc content that SAG has nothing to do with. Also, all the animated content isn't SAG, to ask for 3.5% of all revenue is pretty insane.

Yep. They'd also have to pay them extra for shows that don't feature SAG actors at all, which is more than half of all streaming content. The SAG *_was_* offered a viewership-based royalty and they turned it down and countered with this. It's like, no shit they didn't take that offer and won't talk to you any further. I would've got up and left as well, but not before promptly flipping them the bird.

Kris is 1 million percent correct. Suddenly no one knows what an opening negotiating offer is. I'd counter that IATSE "isn't stupid". Their decision to walk away was not their only option. It's a purely cosmetic tactic to get the press to very publicly focus on "this ridiculous proposal by Fran Drescher". Of course the press will run with it over the weekend, further weakening psychological support of SAG by the general public (who by the way, are already confused and fatigued by many of the inside terms, if not all of them). John is definitely pro corporate on this, which is not a crime in itself! But at the same time, this idea that "SAG and Fran aren't stupid" and that they are just being "ridiculous" and "asinine", shows a certain level of contempt for the average constituents comprising SAG. He does not have a poker face regarding that, no matter how many even handed disclaimers he states to the contrary. When he does this "I know all about negotiating" thing while simultaneously saying he doesn't know the details of whats going on (but he's still hearing things on the inside), it's really grating. Just be fully throated in saying you side with the streamers full stop. Yuck.

I suppose so, but then what if someone sells their likeness young and as time goes by a company decides to use their likeness in a piece of media they don't approve of. I'm very okay with the old way of doing things personally, I don't like what the studios are doing and I think it's predatory at best. my mind is in the same place as you though. I'm thinking that the actors themselves have the right to just not agree to the terms.

We open in a suburban neighborhood, where we meet the two main characters - best friends Ryan Reynolds and Ryan Gosling. The two are high school seniors with a penchant for mayhem and offbeat humor. They live for getting into trouble and pushing people’s buttons, and their latest challenge is the mysterious “Butt Sniffers” - a group of mysterious people who seem to be up to no good. After a series of misadventures, the two decide to investigate further and discover that the Butt Sniffers are actually aliens who are visiting earth in order to collect samples of Earth’s volatile flatulence - a valuable resource in intergalactic trade. Ryan and Ryan devise a plan to confront the Butt Sniffers and put an end to their butt-sniffing antics. After a few close encounters with different extraterrestrial lifeforms, they devise a plan to trap the aliens and return the stolen goods. The two friends, armed with their best wits and nerves of steel, battle the alien Butt Sniffers in an epic battle to save the day. Will they be able to save the day or will the Butt Sniffers prevail? Based on word of mouth rumors taken with a grain of salt the limit the amptp are willing to go to is Nov 2 so I don't see a deal being signed until then.

I love this show and think you guys are great. However, I do think that Kris is looking at the .57 cents per subscriber through both a somewhat biased and skewed lens. While Netflix may be the primary target of this issue, they are also the ONLY ONE of these streaming services that is currently profitable. To basically state, "Yeah, I know you guys aren't making any money. But we want a cut of what is coming in anyway" is ludicrous! The studios are already agreeing to a pay increase for actors. And now Sag wants the streamers to pony up for this too?!? You know if a business continues to not make money, eventually that business goes under. And you can't get ANY money from an entity that no longer exists! The only way this makes any sense to me is if it's a strategic move on the part of SAG. To say okay, you want the subscriber count payment to not be a thing...that's fine. We will drop that request, as long as you guys drop this whole AI nonsense. I'm afraid I agree with John. BOTH the AI position of the studios AND the subscriber count payment request by SAG are asinine. And this situation could very well drag out to at least the start of the holiday season as a result. In which case, EVERYBODY loses!

It's a number that can be negotiated way down over the course of another 5 weeks, big deal. The system of percentage points have worked for recording artists and record labels for decades; it doesnt change the ownership of IP; and it does show respect for the hard work of the people keeping these companies lights on. That's nice they're "already agreeing". They need to pony up a little more since they're already apparently willing to take major millions in losses canceling highly rated shows left and right. They can take it.

@yagga5262 With all due respect Yagga, negotiating the number down makes no sense to me personally. As I mentioned earlier, only Netflix is profitable and even that is a recent development. Not profitable means $0. And any amount negotiated, taken from $0, is still $0. Now don't get me wrong, I agree that the acting community should be making a better average wage for sure! But on the front end! No one should be trying to make additional profit off of something that has no profit at all! And while I understand your analogy of the music industry, that's actually an apples to oranges comparison. Every copy of a song or album purchased is an individual sale, even if it's sold digitally. Streaming services don't have that (Movies,Shows or even Music). It's a pay one price, get everything model. Now if that same video content is made available for indiviual purchase, then getting points on the back end makes perfect sense. But an agreement where actors can make more money off the back end of a project that no one is watching, from a service that is making no money is ridiculous. Just stick with negotiating more money initially up front! Both the streaming membership payment request from SAG and unregulated use of AI by the Studios all originate from the same point of origin! A mentality on the part of BOTH parties of "More for us REGARDLESS of the negative impact it will have on the rest of you." That's not negotiation...that's just GREED!

On every subscriber tho, while none of the streamers are making money currently except for Netflix. So they’re basically saying “you don’t make any money off of this but give me more money anyway while you lose more money”

But all platforms right now are raising their pricing. If they cannot make money in their current model they need to look at their budgets and their quality of programming. Actors haven't received a raised on residuals since the 80s? Exploiting their talent is not the way to go.

This is a leg in the door situation, once they give $.57, tomorrow SAG will ask for $1 and so on because the studios increased the subscription fees per subscriber. Maybe the studios are afraid of that.

What kris said about the studios should have countered Sags proposal about residuals instead of telling the trades makes no sense because both sides are using the public eye in their advantage the second the studios say something Sag dosent like they run to the public and the trades to cry about what they said the same way The studios go and cry to their own trades about what Sag is asking for both sides are trying to look like the good side and get the public opinion but i think both sides have their scum and both sides have their good stuff they should stop trying to get empathy and work something out even if you have to give but you end up gaining more in other aspects of the deal

Kriss also mentions that she could not pay her power bill but doesn’t clarify how many hours she worked. A one day gig obviously won’t pay your bills. We need those type of details to side with you. We can’t just say “she was paid this much and that’s not fair” when we don’t even know the job

The point is more that actors go into long term contracts with no idea how it will affect their career. Most people have a clear idea what they're getting from a job and they can quit whenever they want. That's not the case with actors.

The point is that actors rely on the work they do to get other projects. However actors have no say in how the final product turns out, where it ends up, or if they even show up in it. It all impacts any future opportunities they are able to get. And even how much money they will get paid down the line for it.

SAG needs new leadership. First, not starting negotiations until 2 weeks before the deadline, and now this? Their actors are out of work, they meed to be working for the actors and taking their personal greed off the table. Fran Drescher needs to go, and whomever elses idea this was, so everyone can get back to work.

All these talks just delays a projects to come out till later cause as long as they are striking they are limited to what they can do anytime now. projects are on hold unless can find ways around so many delays and movies are delayed for release unless already done and ready to be seen and are posted and aired anytime later.

i think i’m general the studios shouldn’t do any AI at all but residuals should be done and work in a new format of payment , if that’s a higher pay upfront in general across the board or have an option to take a less pay in order to get a small % of profit

I honestly wonder where was the outrage from SAG-AFTRA during the time when Rogue One came out, and did a 1:1 recreation of Grand Moff Tarkin, with the physical likeness of Peter Cushing being voiced by Stephen Stanton, or when Robert Downey Jr. and Robert De Niro got deaged in Civil War and The Irishman. Where were they when those movies came out? Ok, before anyone responds to me, yes, they had their respective actors and families consent, but if there had been a time to rebel against digital AI on actors, it was those times. I think with SAG-AFTRA, they have the right to being concerned, but whether they like it not, their likeness and voice will be forever associated with that character even after death. Christopher Reeve, even after death, is still and will forever be associated to Superman, similar case with Michael Keaton and Lynda Carter for Batman and Wonder Woman, who's likeness is still being used in official comics for the characters. Spider-Man will always be the first thing anyone will respond when it comes to Tobey Maguire, and what about Bryan Cranston's iconic look as Walter White? They've signed on to their likeness for their roles, they (the actors and families) are gonna have to carry with the responsibility on what the company does with it

Bringing AI was acceptable but but bringing this kind of stupid deals in the end makes them completely look BS. I've never been a fan of unions in the modern era. They had their place during the industrial revolution when factories were death traps, but today I think they're dated. I hate the idea of someone else speaking to my wants. The actors vote to authorize a strike, but have no mechanism to end it. It's basically out of their control at this point and left to the top. I assume Fran is just being difficult since she hasn't accomplished anything yet. The writers made huge progress, but Fran needs her bragging rights too. SAG leadership have egos just as big as the CEOs. This needs to end so non-union people can get back to work.

@@marcboss6 You miss the point. All 160k members of SAG getting paid a LA living wage is completely unrealistic. SAG will continue to hit a brick wall if they're trying to get high pay for ALL, at the end of the day these businesses need to make money to keep the lights on. Relevant actors will always get paid due to supply and demand, but this whole paying actors who do two 30 second commercials a year is unrealistic. To put another way, you squeeze your employer for every dime for the next 3 years, but in the next round of negotiations in 2026, you have less employers to pick from because some of them exited the business because they couldn't afford another $800M a year. If upcoming actors want a long career, they should consider not making this business impossible for corporations to keep the lights on.
