The recently passed PACT Act provides a plethora of new Veterans disability benefits for service members who were exposed to toxic chemicals and contaminants during their service. These benefits include Veterans who were exposed to contaminated water at Camp Lejeune, Veterans who were exposed to toxic burn pits in the Gulf War and post 9/11, and Veterans who were exposed to Agent Orange in Vietnam.

I had applied for unemployment in 2014 as bronchitis COPD. rinitis made my ability to talk clearly very difficult. Although I was 100% VA disabled the TDIU had not been approved. Now comes the PACT ACT. I WAS awarded TDIU and back pay of nine years plus the medical designation SMC housebound. I told the VA that I worked with caustic acid and other chemicals.

Thank you very much for this information. I served from 1986-2017 and served in Iraq twice. Over the past two years I have been diagnosed with prostate cancer so it looks like this PACT act might be applicable. I’ll send you an email about it and another couple of questions.

My hubby was a door gunner in Vietnam and at age of 72 has prostate cancer. He has now received 100% for that cancer. You should too. Also, since he is also a stroke victim needing full time care, the VA is paying me to care for him since I am no longer in the work force.

Good info! I denied for Sinusitis and Rhinitis a week ago and also was denied back in 2016 same conditions. Deployed in Iraq in 2003 and was discharged from service in 2005, had sinus surgery twice 2006&2009. Reentered service 2009. Deployed again in 2010. At MEPS gave a clearance letter of sinus issue from my Dr.. On denial letter they said it prior service conditions!! Should I do a supplemental claim as part of Pact Act or higher level review?

Presumptive conditions all have time limits. So for example Diabetes is a presumption service connected condition under Gulf War Syndrome but it must present within 12 months of separation. That’s what VA told me anyway

Very informative. My husband has been diagnosed with Parkinson’s with Dementia (about 6 years ago), and has been in a state veterans nursing home for the past four and one half years. I have paid for him to be cared for at this facility every month. Am I entitled to any spousal compensation even though he has not physically lived with me during this time? I did care for him for almost 50 years (excluding when he was in Udorn, Thailand in 1972, 73, & 74). We are still married, and as I said, I pay his nursing home bills.

So sorry to hear. If your husband served in Vietnam, parkinsons is a presumptive condition and you don't have to prove nexus. If not you may be able to qualify for VA Aid & Attendance.

What about exposer to the chemicals on submarines, such as amine solution and prolonged exposer to dsiesel fuel and fumes for exteneded pereiods of time?

I’ve researched the time periods involved for agent Orange presumptive conditions but cannot find any time limits for claiming such. I currently have not been diagnosed with any presumptive condition (other than hypertension for which I was rated at zero percent) but I am borderline type 2 diabetic and am experiencing several “Parkinson’s Like Symptoms” (for which my claim was denied after a phone call screening examination through a PACT ACT physician). Could this denial be, at least in part, due to the length of time since exposure?

I served at Ft McClellan, Al during 1987. According to reports that came out was that Ft. McClellan was saturated with all kinds of toxins since decades ago. Unfortunately, I have medical issues that where caused by the contamination that was already there but the department of defense, department of the army, department of the VA. Theses departments will not recognize the fact that soldiers are being affected severely by the contamination of theses toxins that we were exposed with, to include radiation because we were receiving training in NBC. The question is what can be done about this situation. Or did we get short end of the stick. Is it only for camp lelung...just for the Marines... what the soldiers. How can soldiers be forgotten. Its just shameful what they are going to the army's soldiers sacrifice.

I am a Ft. McClellan, Alabama soldier too! I lost both of my breasts to breast cancer. There is no history of breast cancer in my family. My VA disability application was denied several years ago. What about the PACT ACT for us who served on this toxic Army base? Why do the Marines get taken care of from Camp Lejeune toxic exposure & soldiers like us from Ft. McClellan are denied? Does anyone want to answer this?

My husband served in the Gulf War of 1990 operation desert shield desert storm . After he exited the military in 19 96, he died from Bladder Cancer in 2008. Although Metastatic Bladder cancer isn't on the list will his type of cancer be considered presumptive?

Just found out from my vso today that my husband's Urethral cancer (reproductive cancer) is presumptive. Because I applied for DIC in the past and got denied, I didn't have to do much, he filed a supplemental claim and all I had to do was present my husband dd 214, his death certificate, a letter from the va asking me to apply. After that I signed and now im waiting to be approved for my PACT ACT claim.

Can you explain when already drawing DIC, if a spouse should file PACT claim. What benefit would a widowed spouse gain by filing claim on PACT ACT?

I also draw DIC and wonder the same. My husband of 48 years passed away 12 years ago yesterday. He was 100% disabled from Agent Orange exposure in Vietnam during two tours. His death certificate names the cancer that disabled him. I’m alone with failing health. I had to give up driving 3 years ago. I don’t know if filing a PACT claim would benefit me in the time I may have left.

Hi there very thorough video but as a surviving spouse I am going to take this one step further. My spouse was denied benefits for breathing problems in 2009 when he retired. He died a couple of months ago of COPD. In 2004 at his pre deployment they gave him a medical condition of Copd, yup, and 9 days later they deployed him to Iraq, they just told him "use an inhaler" (on paper), I filed for DIC in July, still waiting (submitted personal statement, DBQ, VA medical records, pulmonary tests) everything I knew they would want. Now my question is since COPD is presumptive, can I claim retroactive pay for the denial from 2009? If so, will they take care of it with the DIC claim, or would I have to submit a supplemental claim 0995. Would I just write PACT ACT on the claim, since they got all the evidence from the DIC claim? if I would need to do that(SC) should I wait til I get a decision from the DIC? Everywhere I turn no one can give me a definitive answer. Are you the one that can? Thanks muuuchhh for any help. Sorry that was more than one question, oophs

Can't tell you much, but VA owe you DIC PLUS compensate you from 2009 to present for COPD. PLEASE stress that they owe you back pay for your spouses denial of COPD diagnosis plus back pay for DIC from year he passed. VA HAD no right to send your spouse back into a war with a COPD diagnosis. Please pursue your claim!!! Good luck!

I would think if you made a claim in 2009 they would have to honor that date but I'm not an expert at all. So sorry for your loss and thank you and your husband both of your service. It's too bad he didn't get approved for his claim that the time

I don't think the PACT Act covers civilian contractors that would be a workers' compensation issue

Spouse of Agent Orange veteran Korea and Viet nan. Has had Prostate cancer,skin rashes, fungus under toe and finger nails, heart problems and Severe Dementia. He passed October 6, 2022 with on going claims for upgrade back to 100% after down grade to 80%. Claim has ongoing for fourteen (14) months. Have paperwork stating paper ; they the “VA MAKE A MISTAKE “ in the decision in denying his house bound status. This mistake was over a year ago, settlement in back payment has not been reached. Clearly the VA sat “ON THEIR HANDS “ to out live the 89 year old veteran in paying his benefits. VA WAS INFORMED OF HIS DECLINE MEDICAL CONDITION, for the last ten( 10). The family paid for six months 24 hour nursing care and memory loss care before his passing. His claims and file is now “CLOSE” as per VA. ALL NEW CLAIM mush be file anew by the spouse for review by VA if any back payments are due!? This review could or may, out live 88 year old spouse, which now in assisted living.

My marine husband die 💯 service agent orange. I care for him at home mult surgeries .he died 7years ago. 💜 purple ..Vietnam. I get dic. Can I file for housebound.? Had 2 spinal surgeries .and I care for him with my disability..I needed help at home. VA gave me award ( no funds ) just to go to school. Am 77. Can I applied for housebound.? And keep my dic ,,? Too. Thank you

I served as a DA Civilian in Iraq from 2005-2006 and our US CORPS OF ENGINEER facility was 500 yards from LSA Anaconda/Balad AB! As a 70% disabled veteran, does the PACT Act cover my toxin exposure as a DA Civilian?

My late husband had a presumptive condition but I'm having difficulty proving that he was exposed to radiation. They've denied if so far and I'm in my final appeal. Please say a prayer for me I lost him in 2011 after only being married for 13 years. He was young only 51 long life ahead of me and it would really help if I won my DIC claim. I'm in Michigan too 😊

@@davidsonlawoffices thank you for your response! I didn't personally know any of them because we met a little later in life after he left the army. But I did go through social media looking for the names of people that I found in his records that were in his company he's supervised but I never heard back from any of them. So I don't know whether I had the wrong people or whether they just didn't have anything to say that would be helpful. I'm still hopeful so all I can do right now is wait and pray

My fathers death ( who I was dependent on ) died from confirmed agent Orange exposure - cancer of larynx . I have spins bifida and nurological associated disorders and reproductive disruptions and blood disorders . As a child of a Vietnam vet , can I get help from the pact act ?😅

My husband died in 1995 from lymphoma but he never served outside of the states he was 28 when he passed 2 years after returning from service we had a child and she was born with an infection around her heart and been battling mental health every since she was 5 seeing things that wasn’t there my husband also had undiagnosed PTSD so we believe that all of things are service connected I want to know can I file a claim as well as my daughter

So sorry for your loss and I beleive everything is somehow connected. That being said There are, unfortunately, no programs that I am aware of to help your daughter. However, VA Aid&Attendance may be available to you if your late husband served in a qualifying war time period. Check with your local VSO

I have been trying to get compensation for my husband who has been deceased for 11 years and said that he was exposed to mustard gas. He died of lung cancer he was in Korean world War 2. Va says they cannot find any evidence and has turned me down several times. Is there any chance of help

Let me tell you something funny My husband was wounded in Vietnam and got a purple heart and PTSD and they only gave me ten percent. Oh he was in agent orange and toxic water at camp lejeune and only lived nine months after he found out that he had cancer and for nine months he recivire a hundred percent

I received survival benefits from Va ,,I turn 60 and now receive my husband social security survivor benefits,,But told couldn’t draw botI got letter back in Dec saying I could apply for DIC ,,And I talked to a V O S guy on phone my husband was navy man He was vet era,,He was on navy boat ,,But believed he never serve over seas ,,And he died hypertension and he was 60 percent rated ,,I believe was for he’s knee ,,But said he had hazard material on ship,, He had neuropathy and gout and always had to go to foot doctor ..A week before he died. He was in hospital for his heart ,,And he died hypertension,,He had list medical issues he was 50 in 2008 ,,Loss don’t no what do ,,or to even file DIC

My husband was one that got all the gulf war shots and two of the six experimentsl in ft. leanardwoods. He was 100%>. Whatever they did ...messed me up too. Cant prove it, cant even claim disability. Over 100 allergies. He died eight years ago. I died with him. Last two and a half years...i live in isolation in the country so i dint die. Stopped going to the doctors because they started acting like the VA did. The VA admitted killing my husband. They oversee everything even on civilian doctors. As long as i stay away from people, chemicals, and meds....i live but i dont. The Gov./ VA destroyed our lives. I get DIC, how i survive.

Good day. I am legally married to an American citizen with disability pension from SSA. Were married for almost four and a half years in the Philippines. We live here in the Philippines.
