** Tips to Win Your VA Disability Claim for Tinnitus **
How to Establish Service Connection Secondary to Tinnitus
In accordance with 38 CFR § 3.310 disabilities that are proximately due to, or aggravated by, service-connected disease or injury, a current disability condition, which is proximately due to or the result of a service-connected disease or injury shall be service connected.
Service connection on a secondary basis requires a showing of causation.
A showing of causation requires that the secondary disability claim be shown to be “proximately due to” or “aggravated by” another service-connected disability.
There are three evidentiary elements that must be satisfied for secondary conditions to Tinnitus to prove service connection under the law:
- A medical diagnosis of the secondary disability condition you’re attempting to link to Tinnitus AND
- A current service-connected primary disability (e.g., your current VA Tinnitus rating) AND
- Medical nexus evidence establishing a connection between the service-connected Tinnitus and the current disability you’re trying to connect (e.g., Migraines, Anxiety, Depression, Somatic Symptom Disorder, Sleep Apnea)
1. The first part can be satisfied with any existing medical evidence in service treatment records, VA medical records, or any private medical records.
2. The second part can be satisfied with a veteran’s existing service-connected disability rated at 0 percent or higher, which in this case, is Tinnitus.
3. The third part, and often the missing link needed to establish secondary service connection, can be satisfied with a credible medical nexus letter (Independent Medical Opinion) from a qualified medical provider.

Hi Darrell, I was a communication operator using Track 27 B line of sight. The RT's would hum all the time. Along with the radios we also had to switch generators, 400 cycle type and they had a strong wine both at start-up and when running. By the way, I served with 1st LAAMB on 327 and Monkey Mountain outside of DaNang in 1967 & 1968. I was given hearing aids after a hearing test that showed I did have hearing loss and told that they "COULD" lessen or even get rid of the ringing in my ears, but all they did was make it louder and I finally trashed them. I will be scheduling a privet hearing test in a few weeks and then I will file another claim. PS., my Tinnitus has gotten louder and softer over the years. It seems to get louder when I get stressed. A good friend began to question me about some of the things that I remember from those years and I had to walk away because of the loud noise in my head!

There is also a connection for chicken pox and tinnitus if you were in service when you contracted it. Chicken pox is more severe for adults and affects the ears and muscles. I was diagnosed for it and await my medical records.

I was an AF Combat Arms instructor for majority of my 12 yr career, my afsc falls under 3p0X1 as moderate chance but my shred identifier is B. This means I was on the ranges with heavy weapons, explosives and small arms daily, in addition I was a Raven (for 6yrs) which in simple terms I was a military air marshal working along side load masters and operating in combat zones. Its been 15yrs since i got out and have over the past 4 yrs been dealing with the buzzing in my ears and just started to get help and a diagnoses from the VA. question can I connect it to service?

Along with my Service-connected Tinnitus I was also diagnosed with Severe migraines and Hyperacusis as directly related to my Tinnitus . I will be filing secondary claims for each as I have Nexus letters for both as well. Any advise for me ? Also on the VA form where it asks how to decriibe that your Migraines are connected to my Tinnitus. What should I write? Thank you ,.

Semper Fidelis... My MOS was 7212 (Stinger Gunner). I fired missiles from the shoulder and mobile, using the Avenger. The Avenger also had a .50 cal mounted. After MCT is where I first started experiencing ringing and popping. El Paso was my first experience with severe enough headaches to go to sick call. I got a hearing exam next week for Tinnitus and hearing. Going for service connected and will be filing secondary for migraines, if approved for Tinnitus. How do the new 2022 proposed changes affect new claims? Thanks in advance

I was a 491x1 in the Air Force from 1989 to 1999. When I seperated, I just wanted to get out and didn't claim anything. Part of my outprocessing involved turning my medical records in to the personnell office. I still have a copy of my outprocessing checklist. However, since 1999, certain service related conditions have flared up and no VA entity has a copy of my medical records. I've made several official requests over the years, to the designated records agencies for the Air Force and my service years and I've always gotten an official letter back stating that they don't have anything. What are my options to file the appropriate claims without medical records? What can I file claims for without medical records?

I declined to file for any benifits when I got out in 2003. I've been suffering from ringing in the ears for years but not that bad. But in the last few years it's gotten a lot worse, like a lot. My dr referred me to a hearing test a couple years ago that showed hearing loss. Still I don't know if there's any reason to apply because it's been so long since my ETS.

I find some of the responses in the comments section to be lacking. You make reference to the statement or description the veteran must provide but, unless I missed it, I see no examples or recommendations of situations veterans can use to describe that aids in supporting the claim or words that may be considered red flags. The video does a better job at it but it leads to some additional questions that could use more detail in response.

I need some help or advice . I served in the Army from 2000-2003, my unit was deployed to Iraq February 2003 and was part of the initial push through Iraq right at the start of the war was literally sleeping on my cot on the border of Kuwait and Iraq the night the bombing started watching it from my sleeping bad. I EOS’ed December 2003 and came home, like a lot of people I just wanted to get out and come back and didn’t know about claims. My separation physical documented hearing loss from start to end of service. 2019 I finally was able to put myself together enough to realize I wasn’t okay and finally filed for benefits. I’m currently at a total of 70% however my hearing loss was rated at 0% they say there and talked to me about hearing aids and how they could help me but gave me a 0% I didn’t understand. Tinnitus claim was flat out denied and the explanation is absurd and I don’t understand, “ normal head noise “ was the explanation. I left it alone because I had been approved for other claims and didn’t want to creat problems. What is “ normal head noise “ ? I’ve never appealed i am going to now, but with my records showing hearing loss and the fact I’ve filed for this and shouldn’t have been turned down should I expect any back pay?

I know tis video is a couple years old, but with the changes to the law (M21 related), can a claim for tinnitus be sent in with the civi hearing test and or a DBQ? I filed in the 90's for hearing issue, ear infections, headaches, but it was denied then. I just took a civi test (out of pocket) and will be filing for tinnitus soon. My last C&P exam turned into a complaint with QTC, about the examiner, so I refuse to go to C&Ps now.

Here is a question. Before making any claims, I had a VA hearing exam and was provided a VA hearing aid. In the exams, Tinnitus was never mentioned. Now I have started claims for hearing loss and a second claim for Tinnitus. I have both mil STRs and private ENT exams and diagnosis for hearing loss and Tinnitus. Assuming I get claim approval for hearing loss and since I already have VA issued hearing aids, can I still earn a rating over zero? I have heard that if the VA gives you hearing aids, they see that as solving the problem and you end up with zero compensation.

While in the USMC, my MOS was 2533, Radio Operator/ Radio Technician and I failed a hearing test for Los Angeles Police Deptartment. I went to the VA and a VA doctor examined me and state my MOS was the cause of my loss of hearing. Based upon his claim of my MOS being the cause of my hearing loss, I applied for disability. VA denied my disability for 8 years from 2012. On April 13, 2016 I was awarded disability of 20% for loss of hearing and tinnitus. I was expecting back pay from 2012 but only received it from 2016. Under FOIA received VA Form 21-256EZ date April 13, 2016. Signature was not mine, forged. I have VA forms show controversial evidence proving VA Form was forged. Sent to VA Hot Line and they did nothing. Can there be anything done?

Hey ,, I have a question. So i went for my C&P exam yesterday and it was with a private party Doctor /Audiologist for my Tinnitus claim. It went astonishing well and he told me he was ruling in my favor and giving me the "service Connection". I was given a hearing test and he said it exactly matched the private party hearing test I was given months ago, and he said that's impossible to fake. But he also said that I have hearing loss and further said I should've filed for that along with my Tinnitus claim. He also said that if I decide to add the hearing loss claim within 3 months it would be approved and service-connected due to yesterday's C&P report he prepared and the fact that I was a NAVY Builder (BU) which is on the DOD Tinnitus presumption list. But he said it MAY not get me above the 10% threshold. So is it worth it to add the hearing loss claim and having it approved even if it doesnt raise my percentage? He also said I should go to the VA and get hearing aids. Thank you for your time .

Told my VA doc that I was hearing the ringing and it's gotten progressively worse over 12 years. he sent me to audiology and I made an appointment. 3 weeks later I had about a 20 min audio test, answered the questions about when and where and what... next day i saw the diagnosis on my record. Just like that.

What about something as simple as having your audiology report from entry and exit from the military for hearing loss?

My husband had bad tinnitus and vertigo? He put in claim , but got no answer? Now he dead? I spent 45 years with all his Va sufferings and was finally only just recently at 80 percent? He should been 100 percent with agent orange, ptsd, heart trouble and valve replacement and depression ? I think I deserve more?
