The plaintiff brought his car into the defendant’s repair shop but claims the defendant caused problems and made it worse, so the plaintiff is suing for a refund. The defendant says the plaintiff self-diagnosed the car’s problems, and he fixed everything he was hired to do, so the defendant denies owing anything.

And plaintiff owes the defendant money for it should not have come out of the mechanic's pocket to pay back after fixing the car. $2,000.00 plaintiff should pay back, for he did replace what the plaintiff wanted. labor and cost.

Plaintif is SO frustrating. Takes forever to spit out a sentence and then it's not even an answer to the question asked. Not to mention he hasn't brought a lick of evidence!

It’s called getting old and he could have had a brain injury. My neighbor is 80 and though she is incredibly sharp for her age, she had brain surgery and afterwards couldn’t spit out a sentence to save her life. It’s horrible to not be able to get out what you’re trying to say let’s not shame people for aging and having possible health issues

Yeah, he honestly should have just got the diagnostic. The mechanic did his job, he may or may not have known some changes were necessary but if you go in to any mechanic confidently, parts in hand, and order just that done I doubt many would perform a diagnostic for no reason lol. Good verdict

He technically didn't do his job because he never actually gave the guy that diagnostic even if someone's giving you a diagnostic for their car and they're not a car mechanic you should do a diagnostic just in case so you're not doing extra work when you're not messing up the car also so in a way as a mechanic you should know your job you did something wrong as the old man he should have told him yeah I think you should the issues can you do a diagnostic and then fix my car but then the old man is also told him that he had the mechanic diagnose it so how are we supposed to believe either one when neither one of them had paperwork saying who diagnosed what

@@mahailiabrown3972 when vehicles get really old it gets more difficult for even the best mechanics to know the exact cause . diagnosing a problem and repairing a problem are actually two completely different things and there are alot of people out there that sue for a wrong diagnosis so some mechanics will not guarantee they know for sure what the exact cause is and multiple parts may have to be replaced until the problem is solved . mechanics are not magicians , they mostly just replace parts .

@@manthony777 the cars are not driving in the water. Roads are salted or brined in winter which causes a lot of problems with vehicles. My sister’s Ford Explorer is 25 yrs old and has no rust. She brought it to Canada from California. Mine is 10 yrs. old rust sprayed every year and still has rust on it.

I have had old vehicles. Sometimes you fix one problem, only to find out the next day that something ELSE went wrong. Old wires, old parts, things get and old and need to be changed. I'm glad he lost.

Emissions tests do NOT equate to how well the car is holding up. You can pass an emissions test by using soda cans to patch exhaust holes. They don’t care about the condition of the care for emissions, they just want to make sure there is no exhaust leaks or fume leaks.

It's like going to the doctor, saying you self diagnosed yourself and what antibiotics to give you and coming back 10 days later saying I'm still sick you gave me the wrong thing give me back my money. Why would you ever tell the person working on your car what you think it is when he is quite capable of finding out for himself the right way???

First of all, that mechanic should’ve never taken his word for it or anybody else’s. He should’ve told the guy to get a diagnostic test or move on to the next mechanic. I’ve been in the dental field for 25 years and because of people like him, you have to have your own rules and regulations within your business. As a dental professional, I would never take another doctors word for anything. I would do my own exam and go from there and give my own diagnosis. That mechanic should have never touched that car. The guy should’ve got the diagnostic test done or hit the road

When someone tells me to replace X on their car I generally refuse to until I've diagnosed it, and they're almost always wrong.

The plaintiff just looking at him in the opening I knew everything they were saying was gonna be true. He is a master of all doer of none. Knows everything except nothing at all. He also tried to mislead the judge by not mentioning the tow truck or bringing the emissions test. His whole testimony he was thinking of what he would say next. He knows he didn't get rid of that car. The defendant should've mentioned his business because he did what he was supposed to do and came prepared.

i went to a mechanic one time, he was really cheap. But, shortly after, something else went wrong. This happened about 5 times. I then took it to another mechanic and he showed me where the first guy used PAPER CLIPS to put stuff together!! I should have sued the first guy!!

I had new tires put on my truck, that was 5 years ago and they have 65,000 miles on them. They seem to be squirrely I think I'm going to bring a lawsuit on the tire company and I want my money back.

NOPE! that's not what they do nowadays (it's those computers that they put the cars on) It's 264$ in Canada for diagnosis of engine problems.. Afterwards they charge for the parts and labour.

I don’t know one shop that doesn’t put the diagnostic fee towards the repairs. 256 I hope you get the master tech but the diagnostic and repair legally binds the specific problem to be fixed the first time. Glad I work on my own vehicles.

Those cars are the exception, not the rule. Things age and get worn down, so yeah you're going to expect that a 21 year old car would have more issues than a 5 year old one. If it doesn't, that's great, but you can't just expect that it won't. There are so many factors that go into wear and tear of the car and the longer it's on the road, the more it's subjected to. That's like expecting an 80 year old person to be able to out run a 20 year old. Are there some that can do it? Sure as hell, but they're the exceptions.

@@momoni368 And that's great for them, but they're still the exceptions. Again, things age. Metal isn't invincible and gets worn down or rusts. Wires don't conduct electricity as well as they age. The older a car gets, the more likely something is going to go wrong because they do age.

Although the plaintiff comes off as a bit of a nutcase and definitely deserved to lose the case as JM laid it out for him, that defendant should have never accepted the work! You never do a repair for someone that brings in their own parts. What if the customer got the wrong part, who pays for the labour to put the original part back in after finding that out? What if the part is some ordered-online Chinese junk that fails in 2 months and needs to be replaced, who pays for that? What if the part is flat out defective and does more damage to the vehicle, maybe taking out the engine say with a defective no name low quality oil filter, who pays for that? What if the part is low quality defective junk and fails and causes an accident, who is ultimately liable for that? The ONLY reason someone brings in their own parts is because they found something cheaper than anywhere else and as we all know, there's a reason something is cheaper than anywhere else. Defendant is leaving himself open to a legitimate lawsuit doing this.

I think he took advantage of the plaintiff by fixing stuff that he knew did not need to be fixed. Instead of him telling the plaintiff that there's nothing wrong with the part, he went on and changed it anyway and took the plaintiff's money. That's why the defendant didn't want the name of his shop to be on national TV. Because he knew he did the old man wrong.

This is the classic example of I brought my car in for work and now they screwed up more stuff. Look it’s 21 years old things are probably starting to fail. The mechanic did his job replaced the items that needed replacing that’s it bud. Whatever else falls apart on the car is not the mechanics fault. The only thing a mechanical is liable to fix is the parts of the car the mechanic touched. That’s why most shops say no to customers parts so the shops can warranty the work done with the shops parts.

Plaintiff has no credibility, changes his statement multiple times, I think he has other cognitive issues. I don’t know of any shop that would install a customer bought part , if they did then they would state on invoice no warranty on parts or labor especially if customer came in and stated what he feels should be done/fixed.

Did you not hear plaintiffs testimony? Said he drove car in then admitted it was towed in then went back to saying he drove it in . Plaintiffs hand written notes on invoice proved defendant was telling the truth . Plaintiff had no credibility after that was taken into evidence.
