Being on the Fence About the Repair

The plaintiff hired the defendant to repair her car after an accident, but she believes the defendant didn’t properly fix the vehicle and ripped her off just because she’s a woman, so she’s suing. The defendant says he worked on the car, and the plaintiff was initially happy, but then she called a few days later to complain out of nowhere.

She was rightfully angry, it’s likely that he minimized the work from the beginning just to pocket most of the insurance payout. And when he tried to shut her up by fixing the last couple of things, they did it quick and poorly. Never pays to be greedy.

Body shops frustrate me. The have all kinds of excuses why they can't complete the job correctly before it leaves. They say it needs weeks to cure then bring it back for the buff. They hope you will never come back. I don't want to see the vehicle until the job is done and the car is ready to drive as was requested.

Once again people in the comment section don’t seem to understand that the Judge has already seen the evidence, in this case the defendant’s photos, before the actual hearing starts. It’s called ‘Preparing’. Apparently she wasn’t under the impression that his photos would change or add anything, so she didn’t need to see them again.
@KennuhWayne
@KennuhWayne 10 ай бұрын
Litigants are entitled to trials to seek damages as well as to fairly defend themselves against accusations (due process). Time dedicated to the case prior to the actual trial ("preparing") serves no justice to a litigant...especially if the evidence necessitates an explanation from either litigant. Imagine if the judge has unknowingly misinterpreted the evidence prior to the trial and enters the trial with bias? His evidence should've been considered by the judge.

The bodyman is right. I know he is because I'm a body and refinishing expert myself with decades of experience. Read on for possibly useful info if you ever decide to have your vehicle painted. It's far from concise, but it'll clue you in on what you can expect to be done to your car if you should decide to have it painted, and appreciate the multitude of steps and phases it goes thru in just a few days...and maybe more importantly, whether or not it's even worth the investment in time and cash. ***Word of advice: make sure it's mechanically safe and sound before dealing with its looks. Remember - they all look the same crashed... So, when painting a car or anything else for that matter, the first thing you have to do is prep all surfaces to be painted (including even those that aren't to cut down dust - a painter's 2nd worst enemy), so they'll both hold the paint, and show as few defects as possible. This eventually requires masking everything off, but NEVER until AFTER taking any plates, and/or all other such obstructions off the vehicle. This is imperative, and required for a "clean" paint job (one free of things like dirt, debris, or problems with the paint such as 'orange peel' or 'fish eye.' This is the main reason the surfaces beneath items such as plates need to be removed - to free them of dust and debris and every painters arch enemy - silicon (from car wax, rim cleaner, etc.) which is the cause of fish eye for example, that would otherwise end up in the paint. This is done with compressed air, then all surfaces to be painted will be scuffed with fine sandpaper, blown off, primed, scuffed some more, primed some more, and maybe even sealed, and then cleaned with solvent again, and then tack rags right before final color is applied. Many of these tasks can and will be repeated several times during each phase of the job. As you can see from this cursory explanation, it's a process that proceeds in phases, and not taking plates off a bumper is not lazy - it's just plain stupid - since it can only cause headaches from extra work and/or loss of money, by completely ruining the entire paint job. I've seen it happen many times, to the best of us if one isn't very careful. You also need to understand we are artisans,l and not just mechanics. So, it's utterly ridiculous to think any body person worth half his salt would be "too lazy" to remove simple things like a license plate. (We're only talking 10 to 15 seconds - max - to remove the 2 screws we seen in those photos. That's a fact.) In fact, some people do indeed get too lazy, but they're the ones who look for any and everything that can easily be removed in order to save time and materials during the masking phase. And license plates specifically, are so super simple to remove - being fastened with just 2 screws - and is a job any 9-year-old could do. I know this for a fact - because I was one of those 9-year-olds.

That's the kind of work you get done on a hooptie with negligible value. 30 years in business and never a complaint? My but! Her vehicle has lost value because of that low quality work. Anyone that's not half blind would be able to tell it was in an accident and not fixed properly and will adjust what they would pay for it. Any dealer taking it in on trade will pay less for it because of the low grade of work done to it. A thousand dollars returned was not enough to compensate the plaintiff.

Hard to deduce the problems from those pics but there are many reasons for sloppy work. A sub par technician, A tech paid on flat rate or commission who rushes, Cheaper insurance co's who refuse to pay what the body shop needs to do it right or making the shop use sub standard after market parts. (I've had to fight Ins agents especially when the economy is bad) As for the pic with the trunk open and filth all over the spare tire and jack that's from the prepper wet sanding the truck and not putting plastic to keep it clean as well as the car not being detailed after. Understand Ins co's don't pay that much for body labor last I worked it was $65 per hour $34 of which went to me while mechanic labor at the dealer was $150 that was 15 years ago at a specialized high end German car repair shop. every thing a tech deals with is bent, broken or simply doesn't want to fit right you have no idea the difficulties ot's not like a mechanic who unbolts a part and bolts on the new one take lining up a tail light you might have to pull it on and off 20 times before you get the fit right
