The plaintiff bought a car for his sister from the defendant. However, the defendant hasn't yet handed him the title, so the plaintiff is suing for his money back. The defendant argues the title is good on the car. The plaintiff just changed his mind because his sister passed away.

I sold 2 cars in my life, 1 to my sister, the other to a stranger. I had the title for both & Googled how to create a bill of sale for all the necessary information. Signed over the title in their presence & all.

Word of advice if you buy a car, motorcycle or boat get the title put into your name immediately (Don't wait). I heard a story once from a tags and title lady that a man bought a car 20 years prior from a gentleman and decided to get to work restoring it, but he never put the title into his name; he put money into making it roadworthy. He took the title to the tags and title in town; paid the fee but one major problem arose during the register process. The man he bought the car from passed away years prior and he had no estate. When someone passes away and has no estate it means any deals or handlings before are forfeited. So, the car was useless, the guy had to junk it. He lost a lot of money. So, when buying something with a title make sure it's the person on the title, you're buying it from and register it immediately.

Same goes in reverse. Make sure the proper agency is alerted that your name is no longer associated with a car you sold. I did that immediately on the internet - saved me a lot of problems down the road. (pun?)

@mikeyh0 Yes! I learned my lesson the hard way! I sold my car for $300 to a friend of my son, got the money, and never thought about it again! I moved soon after. Apparently, the girl I sold it to never registered or titled it in her name. 5 years later, we were buying a house, and a debt came up on my credit report that I did not understand. They checked it out and found that the car I sold 5 YEARS AGO must have broken down 1 year after the sale and she just abandoned it on the side of the road. It was towed away to the tow lot and started accumulating storage fees. It was still titled in my name. They had sent letters to me notifying me of this to my old address on record with DMV, but they were never forwarded to me for some reason. I would have handled it immediately if I had known. Eventually the tow lot scrapped the car, and filed a judgement against me which came up in the credit report check. I had to then pay about $2300 to clear this up so we could buy the house. I was SO mad and aggravated at myself for not notifying DMV of the sale. Believe me, I now RUN to DMV the instant I sell a car! 🤣

The defendant is woefully ignorant about titles. She seems to think that just handing an unsigned title, regardless of whether she or her sister were supposed to register it, to the buyer satisfies the requirement for transferring title. Lady, it's not simply the fancy piece of paper; it's taking all the steps that have to be followed to make that piece of paper mean something!

@dabdave9667 Dude, sorry 'bout that. Yeah, I imagine your healthcare team would want to have you on some heavy meds for reducing pain or relaxing muscles in that area. My apologies. I suffer from deep muscular pain from fibromyalgia... nothing helps it and there is no cure. Actually, walking reduces the pain a little, but not significantly. Stretching helps, but my pain is always at least 8/10 or above. In any case, I wish you as much of a recovery as is possible, and I wish you well. Peace and light to you and yours. 💐

Unfortunately, there are many plaintiffs that win judgements, but end up having to fight harder in court to collect on that judgement. In some cases the plaintiffs may still have to file a judgment with the clerk in their jurisdiction, and not every state allows this action. If the defendant moves out of state, don’t have any assets or a job it will be very difficult to even collect. The judgement is only the legal document that allows the plaintiff to collect. Actually receiving the money in a court case outside of Peoples court could be another hurtle. But this is Peoples Court, so fortunately the defendant will receive his money.

Here is a piece of advice for you all. When ever you buy a car from a private seller insist that he go with you to DMV to register the car before you pay. Once DMV looks over all the papers and says it's all good to be registered then you pay for the car
