The plaintiff was so ridiculous. He came in there leading with this story that the defendant controlled everything, including the date. Didn't make any sense whatsoever.

Part of the conversation is missing so I assume it happened over the phone and the texts don't specifically state that they agreed on either date on or before 02nd October! Maybe they initially asked her to move things around for the 20th by stupidly giving her a deposit without a confirmation and they moved the convesation over to texts when the sister couldn't make it on the 20th and the defendant gave the Rosetta room on the 21st which the she also reneged on over texts later on the 02nd. or may be the bride just asked if 21st isn't available anymore. Why would hey bring upthe 20th if they didn't atleast have a conversation about it. Either way the defendant is shady for accepting a deposit without a contract! and obviously the couple are stupid for giving it to her in the first place. Judge wanted them to learn a lesson I think! Record every business conversation over phone people it ain't that hard!

To add some flavor to this. I never went to court. I did try to buy a travel trailer once.. We agreed on price, and went to the DMV in US to finalize the sale. Turned out, the seller was not the owner. I had a $500.00 USD deposit paid to her, with the balance to be paid upon delivery. She did in fact know the currnet owner, but she wasn't the current owner according to DMV. I backed out of the deal, feeling it was way too shady for me. When I said I want a refund, she immediately sent a check for my deposit minus winterization of the trailer. I accepted the check.. Why? Because losing 150 USD of a deposit was worth avoiding the hassle to sue. Not to mention, it was creeping on winter, and they DE-winteriszed to show the trailer. Makes sense they had to winterize again.. I know.. Not my problem, but it was not worth my time to go after.

The couples' strategy was worse than trump's lawyers strategy. He was all over the place and really started to say the quiet parts loud, really loud. then came the Damage ctrl which was way too late. Also, who says a verbal agreement is more valid than series of Text messages? even if they are not admissible in some courts it still beats any spoken words. Some written things always better than nothing at all.

I kind of believe him. I think dates were just thrown around and nothing was set in stone. I think defendant said she had the 21st and they probably said thats fine and then defendant came back with the 28th and thats why she said is the 21st not available any more. So when they finally chose a date it went to she was booked. Defendant seems kinda off to me and I dont totally believe her. Judge M once again cut him off and wouldn't let him even finish his sentance. I hate when she already has her mind made up and don't let people talk.

I agree with you. From what JM was reading from the text messages doesn't line up with the conclusions shes coming to. Maybe theres more she didn't read. Also, it bothers me Defendant keeps saying "I have a contract" when she didn't have a contract at all.

They don't ever talk about this on PC but there is something called the parol evidence rule. And no it has nothing to do wtih being on parole from jail. It basically states that if you have a valid verbal contract but then sign a written agreement, anything in the written agreement always trumps the verbal, unless the person admits it in court. It doesn't apply if you make an oral agreement after the written one though. But good luck proving it!

so we are working without contracts now. I think she is going crazy! Other cases she very strict about contracts and verbal agreements don't hold. I would have hated for her to be my prosecutor.

I honestly think the Judge is wrong with this one. A deposit is a money you put down on a place or on a space at a specific time so that no one else can get it and the thing is is they gave her money hoping they could get a date on a specific place. She never gave them the okay that the date or that place was available so he gave her money in hopes that it would become available he gave her money not to hold any other time slot just hoping she had a Time spot for that specific space so therefore she is not out any money. They did not occupy the hold of any other place or any other time slot. I don't know what the rest of you guys are hearing but she never took their money and said that they had any specific date lockdown she took their money and said I will see what I can do therefore she was not hurting because she did not have to turn it down any other clients

they're both idiots no matter which side of the story is true. If his side is true, you don't give a deposit without having the ability to contract for what your trying to contract for, and if her side is true, you don't make a business deal like that without a contract and she says oh there was a contract, but if she didn't have him sign it, then it's the same as not having a contract

😮I don't agree with the verdict. Maybe it should have been half since both parties made a mistake with booking. Deposit for a possible future date vs no signed contract spelling out the terms. Wait a minute. I take that back. JM always stresses that litigants have to be made whole not enriched. Was there any proof that the room was not booked by someone else who had a SIGNED contract🤔🤔🤔
