You’re right, there needs to be some connection between police conduct and the consequences. Cities paying out thousands of dollars just punishes taxpayers for the conduct of police officers.

There's a whole chapter in the infamous police training course "Killology" which teaches cops that if you're nervouse, they have reasonable suspicion to detain you or even probable cause to arrest you.

That was the part for me too. That officer was clearly trying to get under his skin. Once the officer started to get a picture of what the guy didn't like about the interaction, it's like he was leaning into every point doing it more, notice how the officer kept getting super close and in his face after he knew about nervousness

This guy is going to become a lawyer within the next two years (at the time this incident happened). This man is not equipped to become a lawyer. It’s a classic DEI student & provides us with a clear example of how & why DEI is not a good thing as a whole.

@Guitargreat Are you oblivious? The reason for the nervousness is because cops like that have a tendency of looking for a reason to abuse or kill innocent citizens, Black Americans are disproportionately targeted by police.

Because the department was getting low on their overtime budget, so they were looking to rob motorists under civil asset forfeiture. In Roman times this sort of armed robber got crucified. Now he gets a commendation. 😡

Why are drug dogs even legal. Polygraphs are not acceptable in court because of the fact they are unreliable. If drug dogs are this unreliable I would strongly be arguing their use in this application. If all it take is for the handler to cue the dog then every stop would result in probable cause for search. That bypasses the 4th amendment.

And I also hate when they say they can’t determine the age of somebody as an excuse to hurt/charge them/use as safe way out or when they can’t tell when a dog/person is friendly or not. If you can’t point out certain things like that then you shouldn’t be an officer.

An armed government sanctioned enforcer that you’re only technically allowed to to defend yourself against but not practically with the ability to ruin your life make you homeless and lock you away in place you’ll be tortured for years thinking “why are you nervous” is way to dumb for the job They just have way more power over you and there’s nothing you can do of course it’s scary Send that officer by themselves unarmed in their uniform to a drug den with no back up on an uncover job and see if they’re not nervous

@@jakesmall8875 they have LAWFUL power which is the worst part of it. There’s a god damn loophole for them in almost any situation. Whereas if it was a random civilian in the same situation, they would get fucked. You can’t draw on a cop that draws on you, because they’re “performing official duties” by anyone’s account, but what if he isn’t??? What if it’s some deranged cop who tells everyone you started it, but in reality just shoots you dead for fun? Where as, if you did the same, you would have to FIGHT hard to prove you killed a cop for good reason. The fact that someone has that ability, is fucked up. You have no right to defend yourself simply because he’s uniform and essentially allowed to threaten your life. There’s something very wrong with that.

No they're not. I'm never nervous because I know I never did anything. There is nothing to be nervous about. If you don't do anything wrong there's never a reason to be nervous. Such excuses. Being nervous means you're hiding something.

I'm wondering why USA Vs. Rodriguez isn't brought up more on these cases. Far as this goes, he's allowed to be held as long as it takes to resolve the stop and no longer. Making someone wait for a drug dog is unconstitutional.

So from my understanding whenever a K9 hits and nothing is found you have to follow up and report it and once a K9 gets a certain number of reports of false hits it either gets retired or retrained. I'm not sure how true this is though as I haven't researched it myself

@@filmpolicesd6485 The problem isn't the dogs. When used by fully trained dog trainers they are very effective. The issue is K9 officers do not have enough training or experience to use the K9.

The “Clever Hans” effect. In the 19th century, a German sincerely believed his horse was able to do complex mathematics. Look up “Clever Hans” for the full story. German authorities became interested. A psychologist was commissioned to investigate. The psychologist was able to demonstrate that the horse was reacting to subtle clues from the owner. A study was done with drug dogs. Samples with no drugs, in a location that had never held drugs. Handlers were told drugs were placed in certain locations. Samples with no drug were placed. So any hit would be a false positive. Dogs hit where handlers were led to believe drugs were planted. Conclusion was dogs were reacting to subtle cues from handlers. The “Clever Hans” effect. As described, drug dogs were right about 50% of the time. As mentioned, as accurate as a coin toss. Investigator wanted to do further study, but police withdrew cooperation when they found out the investigator’s conclusion.

Yeah they should probably just shoot the dog. We all know that it’s bullshit but nobody’s gonna do anything to the animals. Maybe if the dog has several falls alerts than it has to be put out of commission and given away. Then it will cost a lot more money because they would have to get a new dog every month. You have to give him credit for not using the " my dads a judge" card. Also I've had panic attacks and generalized anxiety my entire life. It sucks when that is constantly being used against you and it's not something you have any control over. Imagine being stuck in fight or flight mode every waking hour and every night you have nightmares... So I feel for anyone who has any kind of anxiety issues. I've had it used against me before as well and it really sucks!

I like the k9 interaction. I want to mention that once a k9 is brought to the scene, your vehicle is being searched! The dogs don't need to indicate. The officers just say they did it. Or as was mentioned, the dog just wants to please it's handler. So when the handler's body language and/or vocal cues are telling the dog that there are drugs somewhere, the dog will indicate to please it's handler. In "Reason magazine" a test showed results of k9 units 100% accurately indicated there were drugs in a location the handler suspected drugs when there were never drugs in that location

Heck I know the guy lives in one city, goes to school in another, his mom does not like him driving at night, etc etc. Then the officer took all that cooperation and then pushed for a vehicle search, which of course was his plan all along. When I was in the USA for an internship, I was also extremely nervous for cops, and I'm just the average white. Look at it this way: Cops in the USA have a notoriously bad reputation (deserved or not). If I as much walk funny on the street, they can do whatever they want and take back my visa. By the time it is all sorted out that I did nothing wrong, I am back in my home country, missed the internship and if I want to go back I have to truthfully tell that my previous visa was (unjustly) terminated, meaning that getting a new visa will be practically impossible. Justice might be served, but I'm still fucked anyway... I MUCH RATHER be stopped by the German police...

In SFO airport, K9 dog sniffed something on me either chewing gum in my back pocket or candys in my backpack. So I if course was detained and searched and pat down in front of other people. When I asked if I can offer dog to sniff the chewing gum I have, just to check if dog would react, police officers start yelling that I can "break" their dog! WTF?

It is obvious that he is a racist. This young man did nothing wrong. This was right after the George Floyd murder. He has every right to be scared. The former judge is a wonderful human being. He is fair and he has no time for crooked cops and their b.s. I am sure that he raised his son right and you can tell by this demeanor in the video. The young man is polite and well mannered. He simply feared for his life and did not want to get shot. He states that in the video. Can't hold that against him! That cop was itching to find something. They all were. The thing is, that cop messed with the wrong individual that day and he needs to pay for it. I am quite sure that he will. Marion, Jr. has a team of intelligent professionals fighting for justice for him, including his father. They will make sure that this wrong is made right!

He did sue his father was a judge in a nearby county of 20 plus years and he's in law school I looked to see a update but haven't seen one yet the whole video is 2 hours long they did this man DIRTY this cop had a squashed ego whem they didn't find anything they even got screwdrivers and took parts of u haul apart and looked like they tested it they handcuffed him the whole hour and 45 mins while they searched

Theres an artical by the Arkansas Democrat Gazelle - Judge rules state trooper must stand trial for forcing motorist to wear handcuffs for too long The trooper was attempting to get the lawsuit Mr Humphry filed thrown out by claiming qualified immunity. A judge ruled he gets qualified immunity for the stop and snif but not for putting Humphry in handcuffs for far too long. It is going to trial and it seems unclear what the newest update is. I live in a different part of the world, but if I ever experienced/heard of anything of this kind, I would be totally negative towards the police. Fortunately I never have. We drive a camper 5 month of the year for the last 11 years, all over Europe, and have never been stopped once.

Bro I got pulled over as I was turning into my driveway. I stopped and the cop said I drove over the yellow line and suspected I was drinking. I stepped out and he searched my person and then asked if I would take a breathalyzer. If I denied he would take me to jail, I was nervous because I was trusting a mechanical tool with my freedom, anyways he made me take it 3 times I passed. He asked to search my truck, and I denied it, told him I would rather go to bed lol. I told him we were in my driveway and I live there with my parents, when he heard that he said oh well let's go and talk to your parents. It was 2 am and I had to wake my parents up, the cops just told them I was on drugs ect. It was rediculous. The cop was shocked I passed the breathalyzer too, he was just mad. But I grew up in a small town so it is a bit different

I always am annoyed that they have to know all the details of where you are going and why and then questioning why he didn't do this or that or stay here or there..that part was annoying here....like he wanted to know every single detail. I mean what if he was coming from doing something that was ethically or morally wrong but not against the law..for example cheating on his girlfriend or wife or a "booty call" or a one night stand. Who wants to explain "well I just came from being with a person I just met online. " I think details should only matter if there's a reasonable need to know basis ...

Unfortunately, they make many of us too nervous and we answer their probing questions and are too intimidated to tell them what they can do with their questions. *UPDATE:* Mr. Marion Humphrey Jnr. sued Trooper Payton, but in January, 2023 a District Judge dismissed two of his three claims because Trooper Payton was covered by qualified immunity. The third claim, that Trooper Payton kept Mr. Humphrey handcuffed for 9 minutes while he wrote a citation, was allowed to proceed.

My father was a minister, he along with 2 or 3 other black ministers would drive cross country to do revivals. On at least two separate occasions they were stopped while driving through Texas, they weren't driving erratically or suspected of any crime. Yet they were pulled over, forced to exit the vehicle, and a K9 unit was brought in to sniff for drugs. They were detained for at least 2 hours, while the officers stripped the insides of the vehicle bare, and went though all of their luggage . Of course they didn't find anything, but were still treated with hostility. And they didn't even attempt to put all the parts they stripped back in place, nor did they apologize for the permanent damage done to the vehicle. And they wonder why so many of us don't trust them.

@@tripplefives1402 if you watched the video you’d know he got pulled over for a lane change and “almost causing a wreck” not for speeding lol, it’s pretty simple if you think about it. If a truck is going 60mph of course you can’t go 60mph to catch up to it. The cop was going 100mph to catch up to the truck if you really think a uhaul can go 118+ then you’re just dumb 😂

His education didn't serve him very well. You NEVER consent to a search, you make them conduct the search illegally. If they did find something, say left over from pervious rental, he would be charged and probably convicted, or would plead out. If he refused the search and they find something, he can beat on an illegal search.

It amazes me how many cops across the country don't understand when they can or cannot legally escalate a normal traffic stop into a criminal investigation. I hope that cops are increasingly being held responsible for their illegal conduct during interactions with the public so crap like this never happens again. He was detained for almost 2 hours over nothing and I hope his complaint goes somewhere.

As someone who owns a U-Haul business, I could write a whole brief on how many procedural mistakes these officers made... and I hope they were billed for damaging the truck (Taking apart the flares) as those are property of U-Haul, not the renter.

I was thinking that when I saw them damaging the UHAUL in their desperate search for NOTHING!! They are damaging the vehicle. This trooper should be fired!! This is ridiculous and very possibly racially motivated, the dog hit 10 times on what, the dog and handler need to be checked too, is the handler signaling the dog to hit??
