If you are successful in the DUI diversion program then the charge is dismissed so there is no conviction to expunge. However, there will be a record of arrest which can not be expunged when the charge is dismissed through diversion. If the charge is dismissed for other reasons or you get an acquittal at trial then the record of arrest can be expunged.

That is a basis for not allowing you into diversion, but it would be discretionary with the judge. If the prosecutor objects to you entering diversion then we can have a hearing on it and let the judge decide. At the hearing we would present mitigating information.

Yes, and many people do. You can use nicotine and caffeine, as well as any controlled substance that you have a valid prescription for. Medical marijuana does not count as a valid prescription, but a prescription for Marinol (synthetic THC) is valid. At this time you can also use Kratom which is not a controlled substance. Certain beneficial psychedelics may not be screened for in the urine analysis but are technically not allowed if on the federal list of controlled substances. EGT testing can detect alcohol use several days prior to the test. Testing occurs at minimum at the beginning, middle and end of the mandatory "90 day demonstrated sobriety" period.
