A police officer on his own would never approach a person they believe could be a terrorist with articles useful to a terrorist, ie guns, bombs, suicide vest etc. He would observe from a distance and wait for backup. He did this on his own, because he knew there was no danger and whom AB was. This cop tried to be a tough guy for the camera and it's backfired.

As an ex cop of 30yrs now retired , I’ll say it again ...... When at Police College ( Hendon) you had umpteen exams on law and powers and it carried on for 2 years during your probationary period. Fail exams and you’ll be very lucky to remain in the Police. I’ve seen TOO much footage of young cops THAT DO NOT KNOW THE LAW AND POWERS ! It’s so bloody frustrating to see this .... standards have lowered drastically!

Agree today they are satisfying a term known as moral panic by fast tracking youngters with force training and little law training. But hey, wouldnt you love to set up an enforcement company where your employees had no accountability or liable for their actions. Youd only need to set up a complaints body, put the pr phone on engaged and hire a lawyer to sheild off those brave enough to take the civil route.

You old school Police Officers were actually quite cool, Met Police actually. The uniforms were better, Police of that era were more mature and professional and commanded respect and were feared (and rightfully so). Police back in that era as a kid, growing up, circa mid-late 80s were also quite friendly I recall growing up as a young kid. So I guess sir what I'm saying here is, I respect your era of Police Officers.

I am an airline pilot. I (almost) constantly have my head in the books, to keep up to speed with company policy, rules and regs. I have 6 monthly sim checks to confirm my ability and I can lose my job if I’m not up to scratch. I believe I am a professional. This chap, throwing around his weight, citing regs that he isn’t authorised to use, and generally abusing his powers is very far from being a professional.

I think you should get a body worn camera like Auditing Houston has, it can’t be removed (atleast easily) and it can’t be turned off after it’s been activated! It has saved Dave alot of times, because they can’t snatch it, and it automatically goes live to his private KZfaq account, so if you’re ever arrested or searched they (the police) know everything we do or say even in the private parts of a police station are recorded! And they hate it.. but they can’t turn it off until the battery runs out..

A senior officer has to authorise the use of the act for a certain area and time frame, but any officer can apply it if authorisation is in place. The officer MUST also state that as fact before any detainment.

Your lawyer will have a field day with him admitting he knew who you are, a peaceful auditor. That would seem to constitute harassment at the least. If not "gross abuse of power". Furthurmore, it cheapens the legitimate fear of terrorism.

Section 47A allows police to stop and search someone or a vehicle, without reasonable suspicion, in order to prevent acts of terrorism. Searches under this power may only be authorised by a senior police officer, in a specific area for a defined period where the police reasonably suspect an act of terrorism will take place. Interesting section to use and one that could net you a good pay day......

Definitely abuse of power. He also freely admitted that he knew who AB was, therefore was reasonably aware that he wasn't a terrorist, and targeted him for an illegal search, and put the handcuffs on too tight, as a kind of punishment treatment.

The way he signed off at the end "have a 'loverly' day", he knew what he was doing. I think he was actually looking for some KZfaq fame 😅 It was the worst abuse of power we've seen. I imagine him driving past a few times, talking to himself, trying to get up the courage! Then he realised half way through that it was a big mistake. Open & shut case!

Straight in with an illegal search before any engagement whatsoever. I highly doubt section 47a had been authorised by a senior constable for that specific location. Search procedure not followed correctly (he didn’t say which station he is attached to or what he was looking for). He didn’t notify that he was recording. Said he couldn’t provide a stop & search slip without a name. Then admitted he knows who AB is which means he knows there’s no suspicion of terrorism. Disgraceful behaviour. Will they ever learn? Another successful claim for AB on the way.

AB needs to request a formal review of his use of force justification on this one. The officer has committed an assault and could easily have simply waited for another officer to arrive to do a search without restraining the suspect.

TACT 47a "A senior police officer may give an authorisation...... " - he's not a senior police officer. Everything that flows was illegal

Exactly. Section 47a can only be authorised by a constable with rank of at least assistant chief constable (or commander in London) and needs to be authorised for a specific area BEFORE any searches take place and there has to be very good reason for doing so. It’s not to be used on a whim to search an individual, which is why the Secretary of State must be notified of any authorisation (and must confirm any authorisation if section 47a is to remain in force for longer than 48 hours).
