@lildavidgarcia: I forgot to mention something: The BAR in California is the agency the cop referred to as the "Ref" or "Referee." They are the ones who do the exhaust inspection, if you were subject to that. The problem is, the agents who work for the BAR, I think, actually are lazy and incompetent, as there is a case involving a kid who owns a Hyundai Elantra-N. Keep in mind, the car is stock -- bought brand new, no mods. Kid got pulled over by a Riverside PD cop that basically made up stuff about California statute at the stop. What he told the kid was, "It's illegal to drive a car in "Track Mode" on California roads." Which was false. The problem became a lot harder when he took it back to the dealership, and got paperwork that literally says, "Already Stock." Kid then went to the BAR, which had an agent as lazy and incompetent as the cop that pulled him over. Why? Because California statute says that yes, 95 dB is the limit, but the car is to be tested at the default setting at idle -- not on the loudest setting at 2K RPM. Which the agent, had they been competent, would have known. But that's not what he did. The agent tested the car on its loudest mode, at 2K RPM -- and as a result, the kid now has an unregisterable car, since the registration was revoked, AND Hyundai won't buy the car back, claiming that this set of circumstances hadn't happened 3 times yet. So just saying, when it comes to cops and the exhaust statutes, your not the only one dealing with this. By the way, what kind of car do you have? It looked like, to me, a Nissan 350 or 370 Z, maybe even a Fairlady Z. Nice ride, regardless, though I am partial to Subies and the WRX and BRZ myself.

In other words, California lacks in personem jurisdiction against people from other states. And if they tried to say that other people from other states couldn't enter California, it would violate Edwards v California, a case from 1941, which involved a man who went to Texas, picked up another man who was indigent, i.e., poor, and then brought him to California. And SCOTUS held California cannot arbitrarily bar entry into the state for any reason. So in this situation, David, if that's his name, can take his Arizona registered car, and go visit California -- and in the process, because he does not reside in California, the emissions laws or exhaust noise laws don't apply to him. While California may have territorial jurisdiction, they don't have in personem jurisdiction, nor do they have subject-matter jurisdiction, because "David" doesn't reside in California.

California can’t dictate what Arizona chooses to require for registration. The only way they can enforce their motor vehicle regulations is if you are a resident of California for a certain period of time, then you have to register the vehicle in California.

Notice how you never see any shot of the plate so that you can't actually see if it's a California plate or in Arizona one, in fact anytime he gets close to the back license plate he cuts away.

The EPA has started enforcement and is actually going to exhaust shops and tuning clubs and fining or closing the businesses and using their records to locate customers who have used their services for modifications.
