Gulf war vet. Lupus rated, about to put in a supplemental since my vso failed to suggest or advise to send in the exacerbations lengths, so I could get the proper rating. Just because you were there, doesn’t mean a rating. Presumtives still need diagnosis and treatment supporting docs; that came straight from the benefits hotline. Warning, choose your VSO carefully, mine burned me…. I was denied for almost all the PACT act presumptive even though I am TERA “conceded “ by area and length of time there. Prepare for a lengthy fight with the VA. It’s not the cake walk the media and politicians make it sound like.

@@JohnRodriguez-zn4gf Sorry to hear about that. I’ve went from 10% to 60% by doing my own research and watching videos like this. I am now versed in the 38 CFR, M21-1 definitions, nexus and DBQs, supporting statements which are Buddy letters, and all because the VSOs couldn’t be bothered. I’ve filed for other Pact Act related issues, so my advice is educate yourself and do your own submittals. Read decision letters and then you can go back and see exactly what they are needing. I had to learn all this due about a VSO costing me about 25k. Sadly, they don’t care and even if paid by tax dollars and are county employees, there’s no accountability. Hope things work out for you, stay in the fight!

Question regarding the verbiage: "Undiagnosed Illnesses" and this is referring to Gulf War Presumptive conditions. Over several years I've developed many conditions, many of which are diagnosed that I never would have thought to be possibly linked to toxins and oil fires, etc. The fact that I was there is in my DD214, but curious as to how to submit for the conditions if they are already "Diagnosed". Some of the diagnoses could be considered secondary to some of my already existing conditions. Not sure how these are separated. All I've done so far is begin gathering medical information and have submitted an intent to file.
@TheVeteranCoach

If you have a diagnosis for any of the presumptive claims, you will want to file as a direct service connection. Just need the medical documentation and your DD214. Other issues not on the list that are secondaries should be filed a different route. Here's another video abt secondaries if you're interested! kzfaq.info/get/bejne/f9mfmLBknLy2XWg.html

I applied for the Pact Act since it first came out on August 10, 2022 and for the past two years was denied. My last denial letter was from November for (NHL), Non-Hodgkins Lymphoma because it dealt with CML bone marrow cancer which I have but it is leukemia cancer and not lymphoma cancer. The cancer conditions on the Pact Act list deal mainly in lung cancer or respiratory. I am a 💯% service connected navy veteran T&P and was exposed to toxics as a Radioman RM3 burning classified material in the burn room as well as being in Saudi Arabia in 1991. My only option is for my oncologist to write a nexus letter for a link between my service connection and the in-service disease. I'm scheduled for a hematology appointment for 4/16/2024. Hopefully the nexus will grant me this Pact Act.

I just saw someone in the regional office this week about the Pact Act and about my oncologist on writing up a nexus and she informed me that I can include my CML Leukemia as part of the Pact Act even if it was not on the presumption list of cancer conditions. My CML bone marrow cancer is what I was diagnosed for and it is service connected. When I saw the list of cancer conditions for Pact Act and my condition was not on there I just decided to choose the one that was closed to my condition (Non-Hodgkins Lymphoma, NHL) since it dealt with bone marrow cancer. But she also said that if I do receive the grant for the Pact Act it may lower my percentage rate. I thought the Pact Act was a compensation for veterans who were exposed to toxics while in the service and I already did the Toxic Exposure Risk Activity (TERA),exam last year and the VA has all my information including being in Saudi Arabia and my treatment record while in the Navy. If this is a compensation than this should be a one time thing and that's it right? The Pact Act is not something I get on a monthly basis. I already mentioned I'm 100% P&T and my rate should not be lowered. Please let me know the Pact Act will not lower my rate if I'm @ 100%.

While I was not in these active areas during OIF/OEF, I was an F-15 crew chief stationed in Okinawa Japan (Kadena AFB) I was *REGULARLY* drenched in hydro fluids, JP-8 fuel, MEK and other volatile chemicals. I have diagnoses of Allergic rhinitis, skin irritation/chronic dryness, sinusitis, and severe seboredic dermatitis. I strongly feel these are issues stemming from effectively bathing in these chemicals and vapor inhalation - my concern is that even though it was a pretty regular occurrence, it was pushed off as "suck it up" far too often. In this respect, there had been instances where I was pretty severely injured - left knee partial dislocation during a "war game" exercise - and there was no documentation, despite the prescription of very high dose Ibuprofen. I also suffer chronic migraines that are rated at *0* - so I'm dubious as to the ability to have these issues seriously addressed. Thank you for your time.

Sounds like you need to reach out to your local VSO and get a claim in. If you received medication, you have documentation. You may have secondary to migraines issues that will have a higher rating. I haven't been able to find info on having multiple conditions on the presumptive list and if they can be claimed in addition to one that has been approved and are being compensated for. Example: If I am being compensated for CPOD but also was diagnosed with Asthma after my time of service, can that also be claimed AND compensated for? Thanks for everything you do!
@TheVeteranCoach
@TheVeteranCoach 5 ай бұрын
Yes, depending on what your COPD percentage is. The VA does have "pyramiding" issues when symtoms overlap and they may not always double compensate. The highest combination of respiratory conditions I've seen in a decade is 60% (50% for Sleep apnea and SHOULD have been 30% by rating criteria for asthma, however they reduced to 10% for overlapping symptoms for total of 60% for respiratory issues)

What if we were deployed to other places that are not necessarily on the list, but were exposed to burn pits and other toxic fumes, or even exposed to toxic fumes while Stateside, and have been being treated by the VAMC for all of these symptoms/ailments over the last ten plus years?
@TheVeteranCoach
@TheVeteranCoach Жыл бұрын
The name of the game with the VA is "prove it". If you can prove that you were exposed to burn pits via personal/buddy statements, pictures, news articles etc it can certainly help you win your claim, but your claims will not be automatic or presumptive without proof of the locations on the Burn Pit Registry.

The PACT Act is an acknowledgement by the VA that if you were in certain locations at certain times, AND you have a medical condition corresponding to the listed contamination, it is PRESUMED or assumed to be caused by the exposure. I'm a Vet and Army brat, and was actually born at Fort Ord during the same time frame and am aware of the toxic exposure there. The PACT Act covers many state side contaminations, so starting with an exposure exam with your local coordinator will start your paper trail.

You'll want to do an environmental exposure exam (local environmental coordinator is the same for burn-pit, Agent Orange, nuclear exposure etc) to cover your specifics exposures. kzfaq.info/get/bejne/b56loppqqZrFYKM.html

There's a process to get there, but you can work towards getting compensation for your stroke! The CVA itself is not a presumptive, but if you get your ischemic heart disease service connected as a presumptive, THEN you can claim the CVA as a secondary to the ischemic heart disease. Hi. Do you think I would be covered under the PACT Act? I was exposed to Chemical Agent Resistant Coatings (camouflage spray paint) in 1983 while stationed in Germany. The paint contained hexavalent chromium, Isocyanate (HDI), Toluene diisocyanate (TDI), and other harmful solvents. Back then, we did not use (nor were aware of) the proper Personal Protective Equipment. I have nothing in my military medical records, as symptoms of my injuries did not arise until years after the exposure. However, I now have recent medical diagnoses from my private medical providers of lung nodules, collapsed lower lungs, nasal polyps and cysts, allergic conjunctivitis, and severe sleep apnea. My Army buddy and I recall how after the end of our shifts from painting vehicles we would blow paint out of our noses and have to wash the paint from our hair, eyebrows, and eyelashes. Opinions appreciated.

Reproductive cancer of any type is a presumptive claim under the Burn Pits. If your cancer is in remission and you had to have organ removal, you can claim both! Initially, claim the cancer which may be rated at 0% as service connected (since it is not active cancer). Once you have that primary, you can file the secondary issues. VC, what about veterans exposed to asbestos, via months long removal assignments, due to the congressional mandate to remove asbestos from federal properties, who now have respiratory diagnosed disease previously and routinely denied by the VA. Shouldnt we be allocated a disability as well, even if it is during the cold war?
@TheVeteranCoach
@TheVeteranCoach 11 ай бұрын
Exposure to asbestos and many other state-side toxins are covered in the PACT act!! You will still need to follow the steps in the video > meet with an environmental coordinator and start your documentation process! Do you have proof that you were exposed? Ex: Your occupation, buddy statements for others exposed etc. Once you have started your paper-trail, you can get your claims rolling as well. If previously denied see here: kzfaq.info/get/bejne/bcuorbqqna2beHU.html

If you are 100% P&T, you are locked in permanent and can not be reduced unless there is reason to suspect fraud, etc. I only suggest filing for life-threatening conditions if you are 100% P&T. It doesn't increase your payments, but if you pass away from a service connected issue, your family may qualify for survivor benefits they otherwise would not. The VA doesn't want to continue paying after we pass, so they discourage those claims. File away if they are life threatening, otherwise unnecessary!

@@1Andreait does but you have to meet criteria. Been married a certain length of time and also the Veteran that is 100% has to die of something specific to the rating. If I remember after a certain period of time it is irrelevant. It's called DIC, it's for life and it's tax free. Look up VA DIC and it should give an explanation.

The pact act is a great step but skips a lot of us who served between 1972 and 1991. During this “gap” thousands of sailors on aircraft carriers literally drank several gallons of JP -5 ( drank it, ate it, showered in it and breathed it daily on 7 month deployments, 24/7 ) we were also exposed to asbestos on the older ships. It seems this is forgotten today. No “presumptive” is even mentioned for this time period, yet every sailor is diagnosed with issues today. It’s a shame to here the “apologies “ today without a mention of exposures of epic proportions during those years. It was “ safe “ then and now it’s headlines. Someone needs to do the right thing…. At the very least, acknowledge those we have lost. As for the PACT Act legislation…..It’s your move…

Asbestos, firefighter foams, radiation and other contaminations are covered as well and have been for a few years! You will need to meet with an environmental coordinator to discuss your specific exposures. The most recent 2022 update covers burn pits specificatically, but isn't all inclusive

You should be good if you have a recognized diagnosis and were in a covered location. I was Navy as well, Gulf War-Red Sea:1991-1992. All the waterways are covered, there was an addendum to the locations that the VA hasn't published yet regarding this. What illness do you have, and is it presumptive under Pact? Although the VA "conceded" my toxic exposure as well as SW Asia service they still denied me, as Leukemia is not currently presumptive under PACT. So my lawyer is going for a direct service connection through a toxicology report now. So we shall c!

@@TheVeteranCoachI would like to know more about the stateside presumptions!!! I have been diagnosed with Sarcoidosis due to my time in the Marines. I was stationed at Camp Lejuene during 1986-87 for training at Camp Johnson but have been told by 2 different law firms that I due fall into the right time frame But Sarcoidosis is not a presumptive condition. I find that interesting as the entire medical industry does Not know what causes or how one contracts Sarcoidosis. Also according to the new Pact Act. Spouses and children "of the Veteran" that served in these areas of operation overseas might also be eligible for presumptive coverage as well. Due to the transmission from the veteran back to home being around them. If that's possible? That would open the door to other veterans who were around any other veteran who had been in the areas of operation and then transferred the presumptive condition to this mainland stationed veteran. So please clarify these items, as it has effected veterans who were not deployed. But the presumptions are vary vague as to the definitions of what is permitted and what is not. Supposedly a lot of the issues are due to "fine particulate matter" that is a wide open definition of cause for presumptions.

Get tested for MGUS which is now a presumptive condition from the toxic water you drank at Camp Lejuene. It can lead to multiple myeloma and all shorts of nasty conditions. Of course my case has been pending months now.

You won't receive any additional monthly payments, however there is a benefit to filing. (Not to be morbid) If you are to pass away from a service connected disability, your family may be eligible for survivor benefits, that they would not get if you pass away from something that is not related to service. Many say "don't poke the bear" but when its a claim or condition that could be life threatening (like most of the presumptives are) I suggest to file away!
